Official Rules for the JOLLY TIME Pop Corn Bourbon & Beyond VIP Ticket Giveaway

1. Sponsor:
The JOLLY TIME Pop Corn Bourbon & Beyond VIP Ticket Giveaway ("Sweepstakes") is sponsored by JOLLY TIME Pop Corn ("Sponsor"), with JetFuel running the Sweepstakes on behalf of JOLLY TIME Pop Corn. The Sponsor's address is 77 Water Street, Suite 1603, New York, NY 10005.

2. Eligibility:
The Sweepstakes is open only to legal residents of the United States who are 18 years of age or older at the time of entry. Employees, officers, and directors of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members (spouse, parents, siblings, and children) and/or those living in the same household of each are not eligible to participate. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited by law.

3. Sweepstakes Period:
The Sweepstakes begins on September 4, 2024 and ends at 11:59 PM Eastern Time on September 15, 2024 ("Sweepstakes Period"). Entries submitted before or after the Sweepstakes Period will not be eligible.

4. How to Enter:
To enter, participants must fill out the Viral Sweeps form, providing their name and email address. After the initial entry, participants will have opportunities to earn bonus entries through the methods outlined in the Viral Sweeps platform. No purchase is necessary to enter or win. Limit one initial entry per person. Any attempt to obtain more than the stated number of entries by using multiple/different identities, registrations, or any other methods will void that entrant's entries, and that entrant may be disqualified.

5. Consent to Marketing:
By entering the Sweepstakes, participants consent to the use of their email address by the Sponsor for future marketing and promotional purposes. Participants may opt out of receiving such communications at any time by following the unsubscribe instructions in the emails or by contacting the Sponsor directly.

6. Prize:
One (1) winner will receive four (4) VIP tickets to the Bourbon & Beyond festival in Louisville, Kentucky, scheduled to take place from September 19 to September 22, 2024 ("Prize"). The total approximate retail value ("ARV") of the Prize is $4,000. The Prize is for tickets only and does not include travel, accommodations, meals, or any other expenses. The Prize is non-transferable, and no substitution or cash redemption is permitted, except at the Sponsor's sole discretion. The Sponsor reserves the right to substitute a prize of equal or greater value if the advertised Prize becomes unavailable.

7. Winner Selection and Notification:
One (1) potential winner will be selected in a random drawing conducted by the Sponsor or its designated representative on or about September 16, 2024, from all eligible entries received during the Sweepstakes Period. The odds of winning depend on the number of eligible entries received. The potential winner will be notified via email within 48 hours after the drawing. The potential winner must respond within 24 hours of the notification attempt. If a potential winner cannot be contacted, fails to respond within the required time period, fails to provide any requested information, or if the Prize or prize notification is returned as undeliverable, the potential winner forfeits the Prize. In the event that a potential winner is disqualified for any reason, the Sponsor may, at its discretion, award the Prize to an alternate winner by random drawing from among all remaining eligible entries.

8. Prize Delivery:
The Prize will be sent to the winner via mail with tracking to the address provided by the winner. Sponsor is not responsible for any delays, misdelivery, or loss of the Prize during transit. The winner is solely responsible for providing accurate contact and delivery information.

9. Publicity:
Except where prohibited by law, participation in the Sweepstakes constitutes the winner's consent to Sponsor's and its agents' use of the winner's name, likeness, photograph, voice, opinions, and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

10. General Conditions:
Sponsor reserves the right to cancel, suspend, and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

11. Release and Limitations of Liability:
By participating in the Sweepstakes, entrants agree to release and hold harmless the Sponsor, its affiliates, subsidiaries, and each of their respective officers, directors, employees, and agents (collectively, the "Released Parties") from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the Prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt of the Prize. Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorneys' fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

12. Disputes:
Except where prohibited, entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Southern District of New York or the appropriate New York Court located in New York, NY; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.

13. Privacy:
Information collected from entrants is subject to Sponsor's privacy policy.

14. Winner's List:
To obtain a copy of the winner's name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: JetFuel, 77 Water Street, Suite 1603, New York, NY 10005. Requests must be received no later than October 31, 2024.

By participating, you agree to these Official Rules and the decisions of the Sponsor, which are final and binding in all respects.
