1. You must be aged 18 or over to enter the Contest. People from all countries are eligible to enter and win.

2. Eligibility: The FUJIFILM x CineD Filmmaking Contest (the “Contest”) is only open to those who sign up and submit their entry via https://app.viralsweep.com/contest/full/e3ebb5-113743?framed=1 (Instagram) OR https://app.viralsweep.com/contest/full/b7b53f-113752?framed=1 (YouTube). The Contest is open worldwide and is void where prohibited by law. Employees, independent contractors, interns, officers, directors, and agents of FUJIFILM and CineD (the “Promoter”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household of each are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

3. To participate in this Contest, users must share their up-to-10-second video on their Instagram/YouTube using the hashtag #10xFUJIFILMxCINED. Video must be publicly visible and not marked as private. The topic of this Contest is “Why do I deserve to win the new FUJIFILM X-H2S plus USD$1000”. The entrants can select the genre of their film freely. Each user is permitted one entry per video. Secondary or more Instagram profiles / YouTube channels may not be newly created in order to participate in the contest. If so, all entries by that person and any future entry by that person for this and any future competition will be disqualified. 

4. No purchase is necessary, however you will need an internet connection and access to Instagram. No refund may be claimed for expenses incurred in participating in the promotion, including in relation to the use of the internet.

5. Entry Period: Entries can be made from June 1st, 2022 up until June 30th, 2022, 23:59 PST. No entries will be accepted after this time. Promoter accepts no liability for any entries lost, delayed or damaged in transmission.

6. How to Enter: The entry must fulfill all requirements as specified, to be eligible to win a prize. Hence, you need to upload your video on Instagram/YouTube using the hashtag #10xFUJIFILMxCINED and sign-up for the CineD newsletter, as well as the FUJIFILM newsletter (please see #7 for further details). In the case of participating via Instagram, it is also required to follow the Instagram accounts @CineDnews and @fujifilmx_us, as well as tag 5 friends. In the case of participating via YouTube, it is also required to follow CineD’s YouTube channel. Entries that are incomplete or do not adhere to the rules or specifications of the Contest may be disqualified at the sole discretion of the Promoter. You must provide the information requested. If you use fraudulent methods or otherwise attempt to circumvent the rules of the Contest, your submission may be disqualified at the sole discretion of the Promoter.

7. When signing up for both of the CineD and FUJIFILM newsletters, it is required to confirm the subscriptions via the e-mail from CineD you will receive within 24h after sign-up. By signing up to the CineD newsletter, as well as the FUIJFILM newsletter, you agree that CineD may give you personal information to FUJIFILM and FUJIFILM only. You can unsubscribe from these e-mails separately at any time.

8. Prizes: The winners of the Contest (the “Winner”) will receive the following prizes:

• 10 winners will each receive the FUJIFILM X-H2S (approximate retail value USD$2.499 USD) and USD$1000.

Actual/appraised value of prizes may differ at time of prize award. The specifics of the prize shall be solely determined by the Promoter. No cash or other prize substitution shall be permitted except for at the Promotor’s discretion. The prize is non transferable. Substitution of the prize or transfer/assignment of the prize to others or request for the cash equivalent of the prize by the Winner is not permitted. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the Winner. Acceptance of the prize constitutes permission for the Promoter to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

In the event of a prize becoming unavailable, for whatever reason, the Promoter reserves the right to provide an alternative prize of similar or equivalent value. The cameras will be shipped to each winner and by FUJIFILM as soon as possible and are subject to availability by FUJIFILM.

8. If you are one of the lucky winners, you will need to provide your bank account, contact phone number and home address as instructed at the time of being announced as our winner. Further details will then be provided by CineD as to how you claim your prize.

9. The CineD jury will select the ten winners and the announcement of the winners will take place in July 2022. The CineD jury consists of CineD team members who will work at their sole discretion. The prize announcement may be streamed live on the official CineD site.

10. The CineD team will dedicate a number of days to judge ALL entries, under the following criteria, in no particular order. The team will vote at their sole discretion.

• originality and creativity
• interpretation of the theme “Why do I deserve the new FUJIFILM X-H2S plus USD$1000”
• storytelling
• cinematography

11. The ten winners will be announced on CineD and Instagram & YouTube in July 2022.

12. One entry per person only is permitted in this Contest. More than one entry per person – either through the same or another Instagram account – will automatically lead to disqualification of all entries from the Contest.

13. The Promoter reserves the right, at its sole discretion, to disqualify and remove any entry that does not comply with these terms and conditions, even after a video is submitted. The Promoter also reserves the right to change the judging rules above at any time at its sole discretion, in which case all entrants will be notified via email.

14. You warrant and represent that, in respect of your entry:

a) it does not exceed ten seconds (10 seconds) in length and was shot for the purpose of entering this Contest, fitting with the topic of a “Why do I deserve the new FUJIFILM X-H2S plus USD$1000” short film around this topic and what inspires you;

b) you are the sole owner and author of each video picture submission and own all rights to the images and footage;

c) each person depicted in the entry has granted permission to be portrayed as shown;

d) it does not contain any infringing, threatening, false, misleading, abusive, harassing, libelous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane content;

e) it does not infringe upon the copyrights, trademarks, contract rights, or any other intellectual property rights of any third person or entity, or violate any person’s rights of privacy or publicity, and does not include trademarks owned by third parties; copyrighted materials owned by third parties; names, likenesses, voices or other characteristics identifying celebrities or other public figures, living or dead;

f) you own the license of the music tracks used in your film (if any), and you and the Promoter have the right to publish and distribute that music as part of your film through the Internet globally and indefinitely;

e) you agree to fully indemnify the Promoter in respect of all royalties, fees and any other monies owing to any person by reason of your breaching any of the terms detailed herein.

15. The Promoter reserves the right to remove and disqualify entries that contain commercial content in conflict with the interests of the Promoter.

16. By entering this Contest you hereby grant the Promoter a non-exclusive worldwide royalty-free license to use, copy, modify or alter any materials submitted in connection with the Contest.

17. The Promoter assumes no responsibility and is not liable for any image or music misuse.

18. The Promoter assumes no responsibility for any incorrect, inaccurate or incomplete information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest, and the Promoter assumes no responsibility for technical, hardware or software failure of any kind, for lost network connections, garbled computer transmissions, other problems or technical malfunctions with regard to the Contest.

19. The Promoter assumes no responsibility for any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries.

20. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, computer equipment, software, human error or traffic congestion on the internet or any website, or any combination thereof, including any injury or damage to your or any other person’s computer related to or resulting from participation or downloading any materials in the Contest.

21. If for any reason an entry cannot be viewed or is not capable of opening as planned, including infection by computer viruses, bugs, tampering, unauthorized intervention, fraud or technical failures, the Promoter assumes no responsibility.

22. The Promoter will select the winning entry. The judges’ decision will be final and no correspondence will be entered into.

23. If no response is received from the winners of the Contest to the notification of their win after 7 days, the Promoter reserves the right to award the prize to alternative winners.

24. There are no cash or credit alternatives available.

25. The winner agrees to participate in related publicity and to the use of their names and likenesses and the winning images for the purposes of advertising, promotion and publicity across the world.

26. By entering the Contest, you agree and acknowledge that the Promoter is permitted to receive your registration data. All personal information will be used by the Promoter in accordance with its Privacy Policy.

27. The Contest is managed under the control of cinema5D GmbH (CineD). The rules are governed by the laws of Austria. By entering this Contest you agree to submit to the laws of Austria in respect to the operation of the Contest regardless of your country of residence.

28. This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram, or YouTube.

29. By entering the Contest you hereby accept these terms and conditions, which are subject to change at any time.
