The following Sweepstakes is intended for the 50 United States and D.C. only and will be construed and evaluated according to United States laws. Do not proceed in this site if you are not a legal resident of the 50 United States or D.C., 18 years or older.

Welcome to the DealNews.com (“DealNews”, "we," "us," or "our") Sweepstakes (the “Sweepstakes”). Our Sweepstakes Terms governs your participation in any Sweepstakes made available to visitors to DealNews.com, our Site (collectively the “Site” or “Sites” and “Service”).

By registering for, accessing, browsing, or participating in the Sweepstakes, you acknowledge that you have read, understood, and agree, to the rules described herein.  You also agree to the Site’s Privacy Policy (which is incorporated into these rules) and to the Site’s Terms of Service (which are also incorporated into these rules). Your participation in the Sweepstakes and any personal information you provide are subject at all times to these rules, our Privacy Policy and our Terms of Service.

SWEEPSTAKES RULES

1. HOW TO ENTER.

No purchase necessary. To enter the sweepstakes, access DealNews online at https://www.dealnews.com. Follow all instructions and complete the online entry form by the end date and time above. All sweepstakes entrants are automatically subscribed to DealNews newsletter and other communications, by participating in the Sweepstakes you hereby consent to receiving such communications. Entrants can unsubscribe from these emails at any time.  You may also receive emails from DealNews’ partners who may be partnering with DealNews in any given sweepstakes. If you do not wish to receive partner emails, you can uncheck the opt-in box on the entry form. If, after subscribing, you wish to stop receiving emails from any DealNews partner, you can follow the unsubscribe directions in any of those partner emails.

Incorrect and incomplete entries are void. Multiple entries are allowed but secondary entries must come from taking a specified action on a DealNews social media platform or a partner’s website.  Multiple participants are not permitted to share the same email address. Any attempt by you to obtain more than one (1) entry per day by using multiple/different email addresses, identities, registrations or logins, or any other methods not allowed under this paragraph may void your entries and you may be disqualified from the Sweepstakes. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents (including, but not limited to, sweepstakes entry services) will void all entries by you. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder.

Entry materials that have been tampered with or altered are void. If, in DealNews’ opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, DealNews reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify, suspend, or terminate the Sweepstakes, or to conduct a random drawing to award the prizes using all eligible, non-suspect entries received as of the termination date. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on the Website. In the event of a dispute as to the identity of the winner based on an email address, the winning entry will be declared made by the authorized account holder of the email address submitted at time of entry. CAUTION: ANY ATTEMPT BY YOU TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM YOU TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

2. PRIZE(s).

3. DRAWING.

DealNews will select the Winner(s) for the prize(s) in a random drawing conducted from all eligible entries, held no later than thirty (30) days following the Sweepstakes' end. The Winner(s) and entrants will be notified by email. Failure to respond to the email notification within seven (7) days will result in the disqualification of Winner(s) and entitle DealNews to select alternate Winner(s) at random. Should the alternate Winner(s) not redeem the prize(s) within seven (7) days of email notification, DealNews reserves the right to return the prize(s) to the provider or dispose of it at their discretion. All prize(s) are guaranteed to be delivered to Winner(s) within ninety (90) days of the end of the Sweepstakes. Odds of winning depend on the total number of entries received. All decisions by DealNews in regard to this sweepstakes are final and binding.

4. GENERAL.

Winner(s) may be required to sign and return an Affidavit of Eligibility/Liability, W9, and Publicity Release within seven (7) days of date printed on notification and prior to receiving prize. Failure to sign and return the Affidavit of Eligibility/Liability and Publicity Release will result in the disqualification of a Winner and entitles DealNews to select an alternate Winner at random or dispose of the prize at the discretion of DealNews. Unclaimed or undeliverable prize(s) will be forfeited and may be awarded to an alternate winner(s) in a random drawing. Winner(s) may not substitute or transfer prize(s). All federal, state and local taxes on the Prize, including any additional costs, are the winner’s responsibility. The prize cannot be transferred or substituted. DealNews reserves the right to substitute the Prize, or portions thereof, with a prize of equal or greater value.

In the event that DealNews accidentally delivers the wrong prize to Winner, Winner is responsible for returning the incorrect prize to DealNews. DealNews will not send the correct prize until the Winner returns the incorrect prize in satisfactory condition. To be satisfactory condition, the incorrect prize must be unused, undamaged, and complete, in the original packaging and in the same physical condition as the prize was delivered to Winner. (If the prize was software[KL1] or equipment, its packaging must not be opened.) Upon inspection, if DealNews determines that the prize was not returned in satisfactory condition, DealNews reserves the right to withhold delivering the correct prize and void the sweepstakes in its entirety; otherwise, DealNews will ship the correct prize to the Winner.

5. ELIGIBILITY.

Open to legal residents of the 50 United States, including the District of Columbia, age 18 or older as of the Sweepstakes start date. Void where prohibited. Employees and their immediate families (spouses, parents, children and siblings and their spouses) of DealNews, its affiliates, advertising, promotion, or consulting agencies, and paid advertisers of DealNews web sites are not eligible. All federal, state and local laws and regulations apply. Sweepstakes governed by U.S. law.  Void where prohibited by law.

7. PRIVACY. 

In connection with the Sweepstakes entry process, DealNews will be collecting personal data about entrants in accordance with its privacy policy. Please review DealNews’ privacy policy located at: https://dealnews.com/privacy. By participating in the Sweepstakes, you hereby agree to DealNews’ collection and usage of your personal information and acknowledge that you have read and accepted DealNews’ privacy policy. Except where prohibited, participation in the Sweepstakes constitutes your consent to Sponsor’s use of your name, likeness, entry, and state of residence for promotional purposes in any media without further payment or consideration.

7. DISCLAIMER.

DEALNEWS.COM INC. MAKES NO WARRANTIES, EITHER EXPRESS OR IMPLIED, AS TO THE PRIZE(S), INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. DEALNEWS SHALL NOT BE LIABLE FOR ANY CLAIMS, DAMAGES, OR LIABILITIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING OUT OF OR RELATING TO THE DELIVERY, USE, OR PERFORMANCE OF THE PRIZE(S).

8. LIMITATION OF LIABILITY.

DealNews (including other participating partners) and their respective affiliates, subsidiaries, parent, advertising and promotion agencies, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omissions, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to your or any other computer relating to or resulting from participation in the Sweepstakes; inability to access the Site; theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any web site; printing or human or other errors; and any entries which are late, lost, incomplete, misdirected, stolen, or any combination thereof. Online submission is not considered proof of delivery or receipt. By entering, you agree to release, discharge, indemnify and hold harmless the DealNews, and their respective parent companies, subsidiaries, their respective representatives and agents, advertising and promotion agencies, promotion partners and prize suppliers, and all of their respective affiliated companies, employees, officers, directors and shareholders, from and against all claims and damages or liability arising in connection with your participation and/or entry in the Sweepstakes and/or your receipt or use of any prize awarded in this Sweepstakes or due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes. Except where prohibited by law, the winner’s entry and acceptance of the prize constitutes permission for DealNews to use said winner’s name, photograph, likeness, statements, biographical information, voice, and city and state address on a worldwide basis, and in all forms of media, in perpetuity, without further compensation. If by reason of a printing or other error, more prizes are claimed than the number set forth in these rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded. You further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. You acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.  ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS PROMOTION. YOU HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, IDENTIFIABLE PERSONS, OR THIRD PARTY PARTICIPANTS, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.

8. DISPUTES/GOVERNING LAW:

All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of any entrant or DealNews in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions which would cause the application or the laws of any jurisdiction other than the State of New York. Any action or litigation concerning this Agreement shall take place exclusively in the federal or state courts sitting in New York, New York, and you expressly consent to the jurisdiction of and venue in such courts and waive all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action. You agree to service of process by mail or other method acceptable under the laws of the State of New York.

9. CLASS ACTION WAIVER.  

No Class Actions. YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
