CONTEST TERMS AND CONDITIONS

Subject of the Terms and Conditions and Organizer

(1) These terms and conditions govern the conditions for participation in the draw as well as any necessary transfer of rights. The description and process of each draw will be detailed as part of the specific raffle action on the Facebook page and Instagram page.

(2) The organizer of the contest is Giesswein Walkwaren AG.

(3) By participating in the contest, these terms and conditions are acknowledged.

(4) The contest is neither affiliated with Facebook or Instagram, nor is it sponsored, supported, or organized by Facebook or Instagram.

2. Participation

(1) Eligible to participate in the contest are all individuals who have reached the age of 18 and are residents of Germany or Austria. Participation with false identities or third-party identities is not permitted.

(2) All individuals who follow the instructions described in the announcement to enter the contest are eligible to participate.

(3) Participation is possible within the period specified in the announcement.

3. Prizes and Notification of Winners

(1) We will raffle the prizes among all eligible participants.

(2) Winners will be selected by random draw from all eligible participants after the submission deadline. Winners will be notified, provided their personal data is submitted accurately and truthfully. This information will be used to send the prize.

(3) If we do not receive a response from the winner within 2 weeks, the claim to the prize expires. In this case, we are entitled to conduct a replacement draw.

(4) Only one prize per participant is possible.

(5) The prize is neither transferable nor can it be exchanged or paid out in cash.

(6) Should circumstances arise that we are not responsible for, the respective winner accepts a reasonable replacement prize.

(7) Prizes will be sent to the winner by post to the specified address. The risk passes to the winner upon handover of the prize to a transport person. We are not responsible for delivery damages.

5. Exclusion

(1) Any violation of these terms and conditions entitles us to exclude the respective participant from participation. This applies particularly if the participant provides false information or if used photos or other content (e.g., comments) violate applicable law or third-party rights. The same applies to comments that may be considered as glorifying violence, offensive, harassing, or degrading or otherwise violate good morals.

(2) If the excluded participant is an already drawn winner, the prize can be subsequently withdrawn.

6. Early Termination and Changes

We reserve the right to end the contest early in whole or in part, or to change its course, at any time without notice, if it is not possible to ensure the proper execution of the contest for technical (e.g., computer virus, manipulation or errors in software/hardware) or legal reasons (e.g., prohibition by Facebook).

7. Data Protection

We are responsible for the collection, processing, and use of participants' personal data, provided we process it ourselves. We will use the personal data of the participants and other personal data only within the scope of the legal provisions of data protection law.

Participants agree that their name may be published on the page of the contest provider in case of winning.

8. Final Provisions

(1) If these terms and conditions contain invalid provisions, the validity of the remaining conditions shall not be affected.

(2) German law applies. Legal recourse to review the draw procedure is excluded.
