Hipcamp + REI + GearJunkie Save-A-Spot Sweepstakes Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.

OPEN ONLY TO ELIGIBLE LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA WHO, AS OF THE TIME OF ENTRY, ARE AT LEAST 18 YEARS OLD.

VOID IN ALL JURISDICTIONS OTHER THAN THOSE STATED ABOVE AND WHERE PROHIBITED OR RESTRICTED BY LAW.

The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram, Facebook, or TikTok (the “Social Channels”). You understand that you are providing your information to Sponsor, and not to any Social Channel. You agree to release the Social Channels from all claims arising out of, or in connection with, the Sweepstakes. Any questions, comments or complaints regarding the Sweepstakes should be directed to Sponsor and not to any Social Channel.

Eligibility

The Hipcamp + REI + GearJunkie Save-A-Spot Giveaway (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. Void where prohibited or restricted by law.

The following individuals are not eligible to enter or win a prize: (i) employees, representatives, agents, directors, and officers of the Sponsor, its parents, subsidiaries, affiliated companies, and marketing agencies, or of any other parties involved in the administration of the Sweepstakes; (ii) employees, representatives, agents, directors, and officers of Hipcamp, Inc. (“Hipcamp”) or Recreational Equipment, Inc. (“REI”) , their parents, subsidiaries, affiliated companies, and marketing agencies (the Sponsor, Hipcamp, and REI, along with the foregoing individuals and entities identified in (i) and (ii) are collectively referred to herein as, the “Sweepstakes Parties”) and (iii) each of the immediate family members of such excluded individuals (i.e., spouses, parents, children, siblings and the “steps” of each) and all persons living in the same household of each. By participating in the Sweepstakes, entrants agree to be bound by these official rules (“Official Rules”) and by the decisions of the Sponsor, which shall be final in all matters relating to the Sweepstakes. Hipcamp and REI are not sponsors and are not responsible for the administration of the Sweepstakes, the collection or processing of entries, the selection of winners, or the fulfillment of prizes.

 Sweepstakes Entry Period

The Sweepstakes begins on April 3, 2023, at 9:00 AM PDT and ends on May 7, 2023, at 9:00 AM PDT (“Entry Period”), but interim entry deadlines apply for each weekly drawing that is held during the Entry Period. On a weekly basis beginning or about April 10, 2023, and ending on or about May 7, 2023, Sponsor will select five (5) winners in a random drawing (each, a “Weekly Drawing”) for 5 weeks from all eligible entries received from the start of the Entry Period up to the date of the drawing, for a total of 25 Weekly Drawing winners. Sponsor will select one (1) grand prize winner in a random drawing (the “Grand Prize Drawing”) on May 7, 2023. Sponsor’s computer is the official time keeping device for the Sweepstakes.

How to Enter

NO PURCHASE NECESSARY AND NO ENTRY FEE, PAYMENT OR PROOF OF PURCHASE IS NECESSARY TO PARTICIPATE.

To enter, you must take the following steps:

Provide Sponsor with your full name and email address through the form available at gearjunkie.com/saveaspot (the “Entry Form”). Each entrant must submit an Entry Form for their entry to be valid. After you timely submit the Entry Form, you may also earn the following number of additional entries by taking  the following steps in the manner indicated on the Entry Form:

1)     One (1) entry: Visit REI on Facebook

2)     One (1) entry: Visit Hipcamp on Facebook

3)     One (1) entry: Visit GearJunkie on Facebook

4)     One (1) entry: Visit REI on Instagram

5)     One (1) entry: Visit Hipcamp on Instagram

7)     One (1) entry: Visit REI on TikTok

8)     One (1) entry: Visit Hipcamp on TikTok

9)     One (1) entry: Visit GearJunkie on TikTok

10)      One (1) entry: Answer the question “Are you an REI Co-op Member?”

11)     One (1) entry: Answer the question “Are you part of the Hipcamp Community?”

12)    One (1) entry: Refer a friend

You may receive a maximum of 12 entries in the Sweepstakes. Non-winning entries will be retained for subsequent Weekly Drawings and the Grand Prize Drawing. You may only win once.

Compliance with the entry requirements will be determined by Sponsor in its sole discretion. Entries that do not comply with these entry requirements, as determined by the Sponsor in its sole discretion, or that do not meet the entry deadlines, will be disqualified from the Sweepstakes.

Odds of Winning

Odds of winning depend on the number of eligible entries received.

Winner Selection and Notification

Five (5) entrants will be selected as the winner in each Weekly Drawing. One (1) entrant will be selected as the winner in the Grand Prize Drawing.

Sponsor will attempt to notify each winner by sending an email to the email address provided on the entrant’s Entry Form. In order to claim the Weekly Drawing prize, the winning entrant must respond to Sponsor’s email within twenty-four (24) hours after Sponsor sends the winner notification email to the entrant. In order to claim the Grand Prize Drawing, the winning entrant must respond to Sponsor’s email within four (4) days after Sponsor sends the winner notification email to the entrant. 

Each winner is subject to verification, including verification of age and residency.

If a winner (i) is determined to be ineligible or otherwise disqualified by Sponsor, (ii) fails to respond to Sponsor’s first winner notification message within (a) 24 hours of notification, in the case of a Weekly Drawing, or (b) four (4) days, in the case of the Grand Prize, (iii) fails to timely provide any information requested by Sponsor (e.g., information needed by Sponsor to deliver the prize or for verification purposes) or timely execute and return any documents requested by Sponsor to accept the prize (e.g., any prize agreements required by Sponsor) (with such timeliness to be determined in Sponsor’s sole discretion), such winner will be disqualified and forfeit all interest in the prize (and for the avoidance of doubt, no compensation is due to winner from Sponsor). If a winner is disqualified, Sponsor reserves the right to either (A) select a substitute winner through a random drawing or (B) not award the unclaimed prize, in Sponsor’s sole discretion.

Prizes

Up to twenty-five (25) prizes are available for the Weekly Drawings, as well as one (1) prize for the Grand Prize Drawing.

Each qualified winner of a Weekly Drawing will receive: (i) one (1) $100.00 Hipcamp gift card; and (ii) products selected by REI. Approximate Retail Value: $3095. Actual value may vary based on cost fluctuations and seasonal sales. Site stays are subject to availability. Winner will not receive the difference between actual and approximate retail value.

The qualified winner of the Grand Prize Drawing (the “Grand Prize Winner”) will receive: (i) a two (2) consecutive night stay for the Grand Prize Winner and up to four (4) guests at a winner-selected Hipcamp site (the “Destination”); (ii) a $1,000.00 stipend for use to travel to and from the stay provided in (i); and (iii) products selected by REI. Approximate Retail Value: $4,500.00. Actual value may vary based on cost fluctuations and seasonal sales. Site stays are subject to availability. The Grand Prize Winner will not receive the difference between actual and approximate retail value. Guests will be required to sign a release.

The Grand Prize Winner may only bring up to four (4) guests to the Destination. Additional guests may be billed to the Grand Prize Winner by the owner or proprietor of the Destination, in such owner’s or proprietor’s sole discretion. By accepting the prize, the Grand Prize Winner agrees to abide by the rules of the applicable Destination and any limitations or restrictions imposed by the owner or proprietor thereof, in addition to the Hipcamp Terms of Service.

Sponsor will not provide any transit or other assistance in connection with a prize. Each winner is solely responsible for travel to and from the applicable Destination, including without limitation any costs associated with such travel.

 Winner is responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledges that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Sponsor is not liable for any travel cancelled or prizes forfeited due to a force majeure event (including without limitation, events related to the propagation of the COVID-19 virus or war).

 The right to receive a prize cannot be transferred or assigned. No cash or other prize substitution is permitted, except at the sole discretion of the Sponsor. The prize is subject to availability and if the prize cannot be awarded for any reason, Sponsor reserves the right in its sole discretion to substitute the prize with one of comparable or greater retail value.

THE WINNER AGREES TO ACCEPT THE PRIZES “AS IS”, AND ENTRANTS HEREBY ACKNOWLEDGE THAT SWEEPSTAKES PARTIES HAVE NEITHER MADE NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE PRIZES OR THE SWEEPSTAKES, INCLUDING BUT NOT LIMITED TO (A) ANY EXPRESS WARRANTIES PROVIDED EXCLUSIVELY BY A PRIZE SUPPLIER THAT ARE SENT ALONG WITH THE PRIZE OR (B) THEIR QUALITY OR MECHANICAL CONDITIONS. SPONSOR HEREBY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT.

Each Hipcamp gift card is subject to the terms and conditions that apply to such gift cards. By participating in the Sweepstakes, participant acknowledges and agrees that such gift card shall be used only in compliance with such terms & conditions.

In order to use any prize at Hipcamp, the winner is required to create a Hipcamp account and accept the then-current Hipcamp Terms of Service. 

The winner is solely responsible for all federal, state, local, or other applicable taxes associated with the acceptance and use of the prize, and agrees to defend, indemnify, and hold harmless the Sweepstakes Parties against any third-party claims for such taxes

All costs and expenses associated with prize acceptance and use not specifically provided herein are the responsibility of the winner. Any details of prizes not specified will be determined by Sponsor in its discretion.

Publicity

Except where prohibited by law, by accepting a prize, the winner hereby grants the Sweepstakes Parties, and each of their representatives, an irrevocable, perpetual, worldwide, royalty-free, non-exclusive and sub-licensable right and license to use, distribute, and publicly display the winner’s name, likeness, and information about the prize award, in any way, at any time, in any and all media, including without limitation, for use in advertising and marketing, without any additional approval, notification, compensation, or consideration. By accepting a prize, the winner represents and warrants that he or she has the right to grant the foregoing license.

 Limitations of Liability of Sweepstakes Parties

TO THE FULLEST EXTENT PERMITTED BY LAW, EACH ENTRANT AGREES (I) THE SWEEPSTAKES PARTIES SHALL NOT BE RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES, LIABILITY, OR INJURIES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURIES OR DEATH, ARISING OUT OF OR CONNECTED WITH (A) THE SWEEPSTAKES OR (B) ANY PRIZE AWARDED, ACCEPTED, POSSESSED, MISUSED, DELIVERED, OR USED, AND (II) YOUR REMEDIES FOR ANY CLAIMS RELATING THE SWEEPSTAKES ARE LIMITED TO YOUR ACTUAL OUT-OF-POCKET EXPENSES, IF ANY, TO ENTER THE SWEEPSTAKES (BUT IN NO EVENT ATTORNEYS’ FEES). 

The Sweepstakes Parties assume no liability and are not responsible for, and by entering the Sweepstakes you hereby waive and release the Sweepstakes Parties from, any actions, claims, damages, losses or injuries of any kind (collectively “Claims”) arising in connection with the Sweepstakes and/or the receipt, use or misuse of any prize, including without limitation, Claims relating to: (i) the malfunction of any computer, telephone, mobile device, network, satellite, hardware, software or communications line; (ii) unauthorized human intervention; (iii) incorrect, delayed or inaccurate transmission, winner notifications, prize claims or other information or communications relating to the Sweepstakes, or the failure to capture or transmit any such information; (iv) damage to any person’s computer or mobile device; or (v) any errors in these Official Rules, winner notifications or other announcements or communications relating to the Sweepstakes. In the event of any ambiguity or error(s) in these Official Rules, Sponsor reserves the right to clarify or modify these Official Rules however it deems appropriate to correct any such ambiguity or error(s). If due to an error or for any other reason, more legitimate prize claims are received than the number of prizes stated in these Official Rules, Sponsor reserves the right to award only a single prize from a random drawing of all eligible entries. In no event will more than the stated number of prizes be awarded.

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. 

Sponsor may prohibit an entrant from participating in the Sweepstakes or winning the prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or any Sweepstakes Parties.

Sponsor’s Reservation of Rights

If the Sweepstakes is not practically capable of running as planned for any reason outside the control of the Sponsor, including without limitation, due to a force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, government orders, war, natural disasters, the effects of COVID-19 or any pandemic or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to modify, suspend, or cancel the Sweepstakes. In the event of cancellation, Sponsor reserves the right to select a winner from a random drawing of all non-suspect, eligible entries submitted as of the time of cancellation.  

Governing Law

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the rights and obligations of entrants and the winner, and the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Minnesota, without giving effect to any choice of law or conflict of law rules. Any action at law or in equity arising out of or relating to the Sweepstakes, or awarding of the prizes, shall be filed only in the state or federal courts located in the State of Minnesota, and the entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.

 Privacy

Any personally identifiable information collected during an entrant’s participation in the Sweepstakes will be collected and used by Sponsor, REI, and Hipcamp, and their respective designees, for the administration and fulfillment of the Sweepstakes and as otherwise described in these Official Rules, Sponsor’s privacy policy available at https://gearjunkie.com/privacy. Entrants’ entry information will be shared with REI and Hipcamp, in which case such information will be respectively subject to REI’s privacy policy available at https://www.rei.com/help/privacy-policy and Hipcamp’s privacy policy available at https://www.Hipcamp.com/en-US/privacy. Each entrant irrevocably consents to (i) the use of Entrant’s entry information by each of Sponsor, REI, and Hipcamp for business purposes, and (ii) being added to email lists maintained by Sponsor, REI, or Hipcamp.

Winner List

For any legally-required list of winners, or a copy of the Official Rules, mail your request to GearJunkie LLC, 729 N. Washington Ave, Ste 600, Minneapolis, MN, together with a self-addressed stamped return envelope (Residents of Vermont can omit return postage for Official Rules requests), prior to the end of the Entry Period for a copy of the Official Rules, or within sixty (60) days after the end of the Entry Period for the list of winners.
