Official Rules for the Kendra Scott & Dallas Cowboys Sweepstakes

No purchase is required to enter.

Eligibility:  The Sweepstakes is open only to legal residents of the Dallas/Fort Worth metropolitan area who are at least eighteen (18) years old. Employees of Kendra Scott, LLC (“Sponsor”) or the Dallas Cowboys Football Club, Ltd., as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, are not eligible to enter.

Entry Period:  The Entry Period begins upon launch of the Sweepstakes on October 12, 2020 and ends at 11:59 PM CT on October 19, 2020 (the “Entry Period”). Administrator’s computer is the official time-keeping device for the Sweepstakes.

How to Enter:  There are two (2) ways to enter.

Online:  Visit http://www.kendrascott.com/dallascowboyssweepstakes, complete the entry form, and you will receive one entry (1) daily during the dates of the Entry Period.

In Stores:  Visit a participating Kendra Scott store in the DFW metropolitan area, scan the QR code to visit http://www.kendrascott.com/dallascowboyssweepstakes, complete the entry form, and you will receive one entry (1) daily during the dates of the Entry Period.

For all Entries:  By entering, you agree to receive promotional email messages from Kendra Scott. There is a limit of one (1) entry per person, regardless of method of entry. The use of multiple email addresses, an agency, or any automated system to enter is strictly prohibited, and Sponsor reserves the right to disqualify any entries received through such methods. By entering, you indicate your full agreement to these Official Rules and Sponsor’s decisions regarding the Sweepstakes, which are final and binding. Winning a prize is contingent upon fulfilling all requirements in these Official Rules.

Drawing:  On or about October 20^th, Sponsor will select one (1) winner in a random drawing of all entries received. The odds of being selected depend on the number of eligible entries received. Sponsor will attempt to contact the potential winner via email/phone within one (1) day of the drawing.

Potential Winner Requirements:  A potential winner may be required to complete and return a declaration of eligibility and liability/publicity release. If a potential winner fails to sign and return these documents within the time period specified by Kendra Scott, and time permits, Sponsor may select an alternate potential winner in his/her place in a random drawing of all remaining entries.

Prize:  One (1) winner will receive a tailgate party, which must take place on October 25^th, 2020, for up to ten (10) people at his/her house in the DFW metropolitan area. The prize will include food, beverages, Kendra Scott jewelry, décor, and Dallas Cowboys merchandise. The approximate retail value of the prize is $5,000, but will vary depending on various factors, including the number of attendees. Any attendee who is ten (10) or older must wear a mask in indoor public spaces or when outside if a six-foot distance from others cannot be maintained. The winner will be required to allow press to attend the event and take photographs or videos of the party. Attendees (or their parents/guardians) may be required to sign a liability/publicity release. A winner is responsible for paying taxes any costs and expenses not specified above. Any prize details not specified above will be determined by Sponsor, in its sole discretion. A prize may not be transferred. A winner may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor, in its sole discretion.

General Conditions:  In the event that the operation, security, or administration of the Sweepstakes is impaired in any way, Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that conforms to the spirit of these Official Rules; or (b) award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the operation of the Sweepstakes, violates these Official Rules, or acts in a disruptive manner. Sponsor reserves the right to seek damages from any person who seeks to undermine the legitimate operation of the Sweepstakes. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. In the event of a dispute as to the owner of an online entry, the authorized account holder of the email address used to enter will be deemed to be the owner. The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited.

Release and Limitations of Liability:  By entering, you agree to release and hold harmless Sponsor, the Dallas Cowboys Football Club, Ltd, the NFL Entities (as defined below) their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or the prize, including, but not limited to: (a) unauthorized intervention in the Sweepstakes; (b) technical errors that may impact the Sweepstakes; (c) printing errors; (d) errors in the administration of the Sweepstakes or the processing of entries; or (g) any illness, injury, or damage to persons or property that may occur during the tailgate party. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

Privacy and Publicity:  Any information you submit as part of the Sweepstakes will be treated in accordance with Sponsor’s Privacy Policy. Participation in the Sweepstakes constitutes an entrant’s consent to Sponsor’s use of his/her name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration.

Disputes:  You agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Texas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Texas, without giving effect to any choice of law or conflict of law rules (whether of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Texas. 

Winner Information:  For the name of the winner, send a self-addressed, stamped envelope to Kendra Scott Marketing Department, 3800 N Lamar, Suite 400, Austin, Texas 78756. Requests must be received by November 30, 2020.

THE NFL ENTITIES WILL HAVE NO LIABILITY OR RESPONSIBILITY FOR ANY CLAIM ARISING IN CONNECTION WITH PARTICIPATION IN THE SWEEPSTAKES OR ANY BENEFITS AWARDED. THE NFL ENTITIES HAVE NOT OFFERED OR SPONSORED THIS SWEEPSTAKES IN ANY WAY. “NFL ENTITIES” SHALL MEAN COLLECTIVELY, NFL VENTURES, L.P., NFL VENTURES, INC., NFL PRODUCTIONS LLC, NFL ENTERPRISES LLC, NFL PROPERTIES LLC, NFL INTERNATIONAL LLC, ALL OF THE NFL MEMBER CLUBS (INCLUDING DALLAS COWBOYS), ANY SUCCESSOR OR FUTURE ENTITY THAT IS, DIRECTLY OR INDIRECTLY, JOINTLY OWNED AND/OR CONTROLLED BY ALL OR SUBSTANTIALLY ALL OF THE NFL MEMBER CLUBS, OR OWNS ASSETS THAT PRODUCE REVENUES THAT ARE REQUIRED TO BE SHARED WITH OTHER NFL MEMBER CLUBS UNDER THE NFL CONSTITUTION (INCLUDING ANY SUCH ENTITY CONTROLLED BY THE NFL MEMBER CLUBS AND THE DALLAS COWBOYS COLLECTIVELY) AND EACH AND ALL OF THEIR RESPECTIVE AFFILIATES, SUBSIDIARIES, SUCCESSORS AND ASSIGNS.
