ELIGIBILITY: The Red Tricycle 30-Day Toy Giveaway (“Sweepstakes”) is open to legal residents of the 48 contiguous United States, the District of Columbia (excluding Alaska and Hawaii), and U.S. Military personnel (and their families) with APO/FPO addresses, who are at least eighteen (18) years of age or older and the age of majority in their jurisdiction of residence (19 in the states of Alabama and Nebraska, 21 in the state of Mississippi and 18 in all other states). The Sponsor of this Sweepstakes is Red Tricycle, Inc. (the “Sponsor”). Promotional Parties of this Sweepstakes are: Tinybeans USA, The Toy Insider, Evite, Inc., and Hanna Andersson. (collectively “Promotional Parties”). Prizing provider(s) for the Sweepstakes are: Red Tricycle, Inc., and The Toy Insider (collectively, “Prizing Providers”). Sponsor, Promotional Parties and Prizing Providers, each a “Sweepstakes Party” and collectively, the “Sweepstakes Parties”, the officers, directors, employees, contractors and agents of the Sweepstakes Parties, their parent companies (if any), subsidiaries and affiliated companies, advertising, promotional and judging agencies, persons engaged in the development, production or distribution of materials for this Sweepstakes and their immediate family members (parent, child, sibling, and spouse of each)  and/or persons living in the same household as such individuals (whether related or not) are not eligible to participate. Participation in this Sweepstakes constitutes entrant’s full and unconditional acceptance of these Official Rules. Void wherever prohibited or restricted by law. This Promotion is subject to all applicable federal, state, and local laws and regulations.

SWEEPSTAKES PERIOD: The Sweepstakes begins at 12:00 AM ET on November 16, 2020 and ends on December 15, 2020 at 11:59 PM ET (the “Sweepstakes Period”). The Sweepstakes Period is further divided into thirty (30) daily entry periods (each a “Day”), with each Day corresponding to a prize draw. For purposes of this Sweepstakes, a Day is defined as a 24-hour period beginning at 12:00 am ET and ending at 11:59 PM ET. The Sponsor’s computer, or that of its designee, is the official timekeeping device for the Sweepstakes. 

HOW TO ENTER: During the Sweepstakes Period, visit https://redtri.com/30-day-toy-giveaway-2020/ and follow the online instructions to complete and submit an entry form to receive one (1) entry into the prize draw that corresponds to the Day in which your entry was received as well as one (1) entry into all subsequent prize draws (as defined below). Limit one entry per person; a person can only use one email address to enter. By participating in this Sweepstakes, you are agreeing to be fully and unconditionally bound by these Official Rules and the decisions of the Sponsor. The information you provide is subject to the privacy policies of the Sponsor and Promotional Parties (linked herein); by entering, you agree to receive email communications from the Sponsor and Promotional Parties as outlined on the signup form: Red Tricycle, Inc., Tinybeans USA, The Toy Insider, Evite, Inc. and Hanna Andersson.

DAILY RANDOM DRAWINGS:  One (1) daily prize winner will be selected for each Day of the Sweepstakes Period, with the exception of 11/26 on which Day there will be two (2) daily prize winners selected, in a random drawing (each a “Prize Draw”). All Prize Draws will be conducted within 72 hours of the applicable Day’s entry deadline by representatives of the Sponsor. All nonwinning entries will carry forward to subsequent daily Prize Draws. Odds of winning a prize depend upon the number of eligible entries received for each Prize Draw.  Limit one prize per person throughout the Sweepstakes Period.

PRIZE(S) AND APPROXIMATE RETAIL VALUE(S): Thirty-One (31) Prizes are available to be won [one (1) per Day, except for the 11/26 Prize Draw when there will be two (2) prizes available] as follows:

Prizes will be awarded provided there are enough entries received, and prizes are claimed properly in accordance with these Official Rules. Prizes are nontransferable, non-assignable and may not be substituted in whole or in part except as provided herein. Sponsor reserves the right, in its sole discretion, to substitute a prize (or a portion thereof) with another prize of equal or greater value in the event the advertised prize (or a portion thereof) becomes unavailable for any reason. All taxes and other expenses related to the acceptance or use of the prize not specified herein, including without limitation, income taxes, are the sole responsibility of the winner. Prizes are awarded “AS IS” with no warranty or guarantee, either express or implied by Sponsor, except for manufacturer’s standard and written warranty included in the prize packaging. Prizes consist of only the item(s) specifically listed as part of the prize. In no event will more than the stated number of prizes be awarded.

WINNER NOTIFICATION:  Potential winners will be notified via the email submitted at time of entry and may be required to complete an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law) and any other documents required by Sponsor, which must be returned to and received by Sponsor within three (3) calendar days of issuance. If a winner does not respond to such notification within 72 hours, declines to accept a prize, or in the event that a prize or prize notification is returned as undeliverable, the winner will be disqualified and forfeits all rights to be deemed a winner, and the Sponsor may elect, at its own discretion, to select an alternate winner. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or e-mail client or for insufficient space in user's e-mail account to receive e-mail.

TAXES:  ALL FEDERAL, STATE, AND LOCAL TAXES RELATING TO ACCEPTANCE OF A PRIZE ARE THE SOLE RESPONSIBILITY OF THE PRIZE WINNERS.

GENERAL: Sweepstakes Parties assume no responsibility or liability for (1) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (2) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (3) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Sweepstakes; (4) inaccessibility or unavailability of the Internet or any combination thereof, or; (5) any injury or damage to participant’s or to any other person's computer which may be related to or resulting from any attempt to participate in the Sweepstakes or download any materials in the Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned for reasons which may include without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part.  In the event of termination, a notice will be posted online and a drawing to award all remaining prizes will be conducted from among all eligible entries received prior to termination, at Sponsor’s sole discretion.

In the event of a dispute, eligible electronic entries will be considered made by authorized account owner of the email address submitted at the time of entry. Entries generated by robots or scripts are considered to be a direct violation of Sweepstakes policy and will result in immediate disqualification of any and all associated entries.

Sponsor reserves the right at its sole discretion to disqualify any individual suspected of tampering with the entry process or the operation of the Sweepstakes; or to be acting in any manner deemed by Sponsor to be in violation of the Official Rules; or to be acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A USER OR PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING WITHOUT LIMITATION, ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a discrepancy or inconsistency between disclosures or other statements contained in any promotional materials and the terms and conditions of these Official Rules, the Official Rules shall prevail, govern and control. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prize(s).

By participating, Entrants release Sweepstakes Parties, and their respective parents, subsidiaries, affiliated businesses, advertising and promotion agencies and the officers, directors, employees and agents of each (the “Released Parties”) from any and all liability, damages or causes of action (however named or described) for injuries, damages or losses to persons and property which may be sustained in connection with accessing, submitting an entry or otherwise participating in the Sweepstakes as well as receipt, enjoyment, ownership or use of the prizes. Sponsor makes no representations or warranties of any kind concerning the appearance, safety, or performance of any prize. Acceptance of a prize constitutes permission for the Sponsor and its agencies to use winner’s name, city, state, photograph or likeness for advertising and promotional purposes, including a winners list, without compensation or approval (where lawful).

There are NO WARRANTIES express or implied made by Sponsor and, additionally, no implied indemnities of any kind.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPONSOR, ITS AGENTS, REPRESENTATIVES AND CONTRACTORS HEREBY DISCLAIM ANY WARRANTIES, OBLIGATIONS, LIABILITIES, RIGHTS AND REMEDIES, EXPRESS OR IMPLIED, ORAL OR WRITTEN, ARISING BY LAW OR OTHERWISE, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE, INFRINGEMENT OR ANY IMPLIED INDEMNITIES. YOU UNDERSTAND AND ACKNOWLEDGE THAT SPONSOR HAS NOT MADE, AND YOU ARE NOT RELYING ON, ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS TO YOU REGARDING THE VALUE OF THIS SWEEPSTAKES OR THE ODDS OF YOU BECOMING A WINNER, OR ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, LACK OF VIRUSES OR OTHER HARMFUL COMPONENTS AND ACCURACY OF THE INFORMATION, PRODUCTS, SERVICES AND RELATED GRAPHICS USED IN CONNECTION WITH THE SWEEPSTAKES, THESE OFFICIAL RULES OR ANY WEBSITES. ALL DATA, INFORMATION, PRODUCTS, SERVICES AND GRAPHICS RELATED TO THE SWEEPSTAKES, THESE OFFICIAL RULES AND ANY WEBSITES ARE PROVIDED "AS-IS, WHERE-IS" WITHOUT TECHNICAL SUPPORT OF ANY KIND.

IN NO EVENT SHALL SPONSOR, SWEEPSTAKES PARTIES, OR THEIR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS OR REPRESENTATIVES BE LIABLE TO YOU OR ANY THIRD PARTY FOR INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS OR LOST PRIZES) RELATED TO THE SWEEPSTAKES. THESE OFFICIAL RULES, THE PERFORMANCE OR BREACH OF THESE OFFICIAL RULES BY SPONSOR, THE USE OR EXPLOITATION OF ANY CONTENT, OR OTHERWISE, EVEN IF SPONSOR IS AWARE OF THE POSSIBILITY OF SUCH DAMAGES OR IF THE EXCLUSIVE REMEDIES STATED HEREIN FAIL OF THEIR ESSENTIAL PURPOSE. SWEEPSTAKES PARTICIPANTS AGREE AND UNDERSTAND THAT THE TERMS AND CONDITIONS OF THESE OFFICIAL RULES AND THE SWEEPSTAKES REPRESENT AN AGREED ALLOCATION OF RISK BETWEEN SPONSOR, THE SWEEPSTAKES PARTIES AND THE RELEASE PARTIES ON THE ONE HAND, AND PARTICIPANTS, ON THE OTHER. SPONSOR COULD NOT PUT ON THIS SWEEPSTAKES “BUT FOR” PARTICIPANTS’ AGREEMENT AND COMPLIANCE WITH THESE OFFICIAL RULES AND SPONSOR IS RELYING ON EACH PARTICIPANT’S COMPLIANCE WITH THE OFFICIAL RULES TO ENSURE THAT THE SWEEPSTAKES IS RUN IN ACCORDANCE WITH APPLICABLE LAW.

GOVERNING LAW:  All federal, state and local laws and regulations are applicable. Each Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of New York; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased THE NEW YORK COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THESE SWEEPSTAKES AND THE LAWS OF THE STATE OF NEW YORK SHALL GOVERN THE SWEEPSTAKES. Each entrant waives any and all objections to jurisdiction and venue in those courts and hereby submits to the jurisdiction of those courts.

WINNERS LIST:  To request the names of the winners, send an e-mail with subject line: "2020 30-Day Toy Giveaway" to promowinners@redtri.com. Requests must be received by January 15, 2021. The winners list will be available on/about January 15, 2021 or after all winners have been verified.
