Rules

1. Eligibility: The John Malecki LLC (the “Sponsor”) The Tooltastic DeWalt Giveaway (the "Sweepstakes") is open to legal residents of the continental United States who are at least 18 years old at the time of entry. Employees of John Malecki LLC and JM Custom Builds LLC, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members or persons living in the same household are not eligible to participate. The sweepstakes is void where prohibited or restricted by law.

2. How to Enter:
   b. No Purchase Entry: To receive one (1) entry into the Sweepstakes, eligible individuals may submit their email address via the form located at https://johnmalecki.com/pages/tooltastic-dewalt-giveaway]  Limit one (1) no purchase entry per person via email and/or online. Additional entries can be submitted via postcard to:
   John Malecki PO Box 899 Gibsonia PA 15044. Photocopies will not be accepted. Mass entries and entries generated by script, macro, or other automated means or by any means that subvert the entry process will be void. All entries become the official property of the sponsor and none will be acknowledged or returned. Proof of submission will not be deemed proof of receipt of entry by Sponsor.

2. Prize: Two (2) winners will receive a DeWalt 20V Tool Combo Kit valued at $499 (the "Prize"). The Prize is non-transferable and cannot be exchanged or substituted for cash. Prizes must be accepted as awarded, and the prize is awarded “AS IS” with no warranty, representation, or guarantee, express or implied, in fact or in law, made by sponsor or for which sponsor shall be liable, including without limitation, any implied warranties of merchantability, non-infringement or fitness for a particular purpose. 

3. Winner Selection and Notification: The 1st winner will be selected in a random drawing from all eligible entries received during the Sweepstakes Period. The 2nd winner will be selected by the participant that refers the most people who enter the giveaway. The Sweepstakes Period shall begin on July 16, 2023 and shall end on August 1, 2023 at midnight. Odds of winning a prize depend on the number of eligible entries received during the entry period. The drawing will be conducted within [2] days following the end of the Sweepstakes Period.  The winner will be notified by email within [5] days after the drawing. If the selected winner does not respond within [5] days of notification or fails to comply with the Official Rules, the winner will be disqualified and an alternate winner will be selected.

4. General Conditions: By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding. The Sponsor reserves the right to terminate, modify, or suspend the promotion if, in Sponsor’s sole discretion, there is any suspected or actual evidence of electronic tampering with any portion of the promotion, or if viruses, bugs, unauthorized intervention, fraud, technical difficulties or failure or any other factor beyond Sponsor’s reasonable control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion. Sponsor reserves the right to disqualify any individual who violates these Official Rules or tampers with the entry process. Sponsor reserves the right to seek damages and other remedies from any such person that deliberately damages or undermines the legitimate operation of the promotion to the fullest extent permitted by law.  Except where prohibited by law, participation in the Sweepstakes constitutes the winner’s consent to Sponsor’s use of winner’s name, likeness, voice, statements, hometown, state, and country, for promotional purposes in any manner or media (including online), worldwide, in perpetuity, and without further payment, consideration, notice, review or consent. 

5. Release and Limitations of Liability: By entering the Sweepstakes, entrants agree to forever, fully and irrevocably release, indemnify, defend  and hold harmless the Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and their respective officers, directors, employees, and agents from any and all liability for any injuries, losses, or damages of any kind arising from or in connection with the Sweepstakes or the acceptance, use, or misuse of any prize. In no event will any entrant be entitled to rescind this agreement or seek injunctive or other equitable relief. Sponsor is not responsible for an incorrect or inaccurate transcription of entry information, or late, lost, stolen, unintelligible, illegible, damaged, mutilated, altered, incomplete or misdirected entries or entries received through impermissible channels, all of which will be disqualified. Sponsor is not responsible for technical failures of any kind or the unavailability or inaccessibility of any website or service 

6. Disputes: As a condition of entering the Sweepstakes, entrant agrees that any and all disputes, claims and causes of action arising out of or connected to this promotion, or any prizes awarded, shall be resolved individually and exclusively in the federal or state court located in the Commonwealth of Pennsylvania, Allegheny County. Entrants hereby waive all claims for attorneys fees, punitive, incidental, consequential, or any other damages, other than actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased, unless prohibited by the jurisdiction.
