Excellence NB Contest 2022

OFFICIAL RULES - ENGLISH

THIS CONTEST IS OPEN ONLY TO RESIDENTS OF NEW BRUNSWICK AND IS GOVERNED BY CANADIAN LAW.

Standard data rates apply to participants who choose to participate in the Contest via a mobile device.  Please contact your service provider for pricing and service plan information and rates before mobile device participation.

The Excellence NB Winter Photo Contest (the “Contest”) is in no way sponsored, endorsed or administered by, or associated with Facebook. You understand that you are providing your information to Excellence NB (the “Sponsor”) and not to Facebook. The information you provide will only be used for the administration of this Contest and in accordance with the Sponsor’s privacy policy (see below). Facebook is completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Facebook. You may only use one (1) Facebook account (the “Account”) to participate in this Contest.

1.   CONTEST PERIOD:  The Contest begins on January 20, 2022 at 12 a.m. Atlantic Standard Time  (“AST”) and ends on January 26, 2021 at 11:59 p.m. AST (the “Contest Period”). Voting begins on January 20, 2022 at 12 a.m. Atlantic Standard Time  (“AST”) and ends on January 30, 2022 at 11:59 p.m. AST (the “Voting Period).

 2.    ELIGIBILITY: The Contest is open to residents of New Brunswick 18+ at the time of entry, except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of the Sponsor, its subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and any other individual(s), entity or entities involved in the development, production, implementation, administration or fulfillment of the Contest (collectively, the “Contest Parties”). Groups, clubs, organizations, businesses and commercial/non-commercial entities are not eligible to enter the Contest.

 3.    HOW TO ENTER: NO PURCHASE NECESSARY.  To enter, (i) go to NBMade.ca and submit your email address and your photo. The photo with the most votes from the public wins. To be eligible to earn an Entry, your actions must: (i) be submitted and received within the applicable Entry Period and in accordance with these Rules; (ii) be in accordance with these Rules, including, but not limited to, the specific Submission Requirements listed below in Rule 5; and (iii) be in accordance with the applicable terms, rules, policies and guidelines of Facebook (the “Facebook Rules”) (all as determined by Sponsor in its sole and absolute discretion).  Any Response, as determined by Sponsor in its sole and absolute discretion, that does not comply with these Rules (including, but not limited to, the specific Submission Requirements listed below in Rule 5) and/or the Facebook Rules will be discarded and will not be eligible for entry in this Contest.

4.   AGREEMENT TO BE LEGALLY BOUND BY RULES:  The contest page will include a hyperlink to these Official Rules and Regulations (the “Rules”). By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by the terms and conditions of these Rules.

5.   SUBMISSION REQUIREMENTS:

BY SUBMITTING AN ENTRY, YOU AGREE THAT THE ENTRY (AND ANY AND ALL CONTENT ASSOCIATED WITH YOUR ENTRY) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES (DEFINED BELOW) WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF YOUR ENTRY (OR ANY CONTENT ASSOCIATED WITH YOUR ENTRY); (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (IV) IF DECLARED A WINNER, ANY PRIZES (INCLUDING ANY USE OR MISUSE OF ANY PRIZES).  THE RELEASED PARTIES (DEFINED BELOW) SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES OR THE FACEBOOK  RULES. THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY PRIZE.

By participating in the Contest, each entrant hereby warrants and represents that any Response he/she submits:

 ●      is original to him/her and that the entrant has obtained all necessary rights in and to the Response for the purposes of entering such Response in the Contest;

●      does not violate any law, statute, ordinance or regulation;

●      does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the legal age of majority in their jurisdiction of residence;

●      will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party; and

●      is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups (including, without limitation, any competitors of Sponsor); content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of Sponsor; any identifiable third party products, trade-marks, brands and/or logos, other than those of Sponsor (e.g. any clothing worn and/or products appearing in your Response must not contain any visible logos, trade-marks or other third party materials unless the appropriate consents have been obtained --- note: all identifiable third party products, trade-marks, brands and/or logos for which consent has not been obtained by the entrant must be blurred out so as to be unrecognizable); conduct or other activities in violation of these Rules; and/or any other materials that are or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.

The Sponsor and/or its designated content moderator (the “Reviewer”) reserves the right to screen all Responses.   Any Response that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules and/or the Facebook Rules is subject to disqualification.  The Reviewer reserves the right, in its sole and absolute discretion at any time and for any reason, to request an entrant to modify, edit and/or re-submit his or her Response (or any part thereof) in order to ensure that the Response complies with these Rules, or for any other reason.

If such an action is necessary at any point during or after the Contest, the Sponsor reserves the right, in its sole discretion, to take whatever action it deems necessary based on the circumstances – including, without limitation, disqualifying the Response (and therefore the corresponding Entry and/or the associated entrant) – to ensure that the Contest is being conducted in accordance with the Sponsor’s interpretation of the letter and spirit of these Rules.

By entering the Contest and submitting an Entry, each entrant: (i) without limiting the Facebook Rules, grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her Response (and each component thereof), in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her Response (and each component thereof) in favour of the Sponsor (and anyone authorized by the Sponsor to use such Response); and (iii) agrees to release and hold harmless the Released Parties from and against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Response (or any component thereof), including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related or other cause of action whatsoever. 

YOUR ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE RESPONSE) SHALL NOT BE DEEMED TO BE CONFIDENTIAL.  FOR THE AVOIDANCE OF ANY DOUBT, THE SPONSOR (AND THOSE AUTHORIZED BY THE SPONSOR) SHALL BE FREE TO USE YOUR ENTRY (OR ANY INDIVIDUAL COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE RESPONSE) ON AN UNRESTRICTED BASIS – INCLUDING, BUT NOT LIMITED TO, USING ANY AND ALL IDEAS YOU SUBMIT IN ANY MANNER THAT SPONSOR CHOOSES, WITHOUT ANY NOTICE OR OBLIGATION TO YOU WHATSOEVER.

6.   ENTRY LIMIT: There is a limit of one (1) Entry per person. For greater certainty and the avoidance of any doubt, you can only use one (1) Social Media Account to enter the Contest. Under no circumstances will any participant be eligible to earn more than one (1) Entry.  If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) obtain more than one (1) Entry; and/or (ii) use multiple names, identities, email addresses, Accounts, any automated, macro, script, robotic or other system(s) or program(s) and/or any other means not in keeping with the Sponsor’s interpretation of the letter and spirit of these Rules to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. Your Entry may be rejected if (in the sole and absolute discretion of the Sponsor) the Entry is not fully completed with all required information and submitted and received during the applicable Entry Period in accordance with these Rules. The Sponsor, Contest Parties, Facebook Inc., and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void).  

7.   VERIFICATION: All Entries are subject to verification at any time and for any reason.  The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry and/or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the Sponsor’s interpretation of the letter and spirit of these Rules.  Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of this Contest will be the Sponsor’s official time-keeping device(s). Proof of transmission (screenshots or captures etc.) or attempted transmission of a submission or of attempted submission of any communication, does not constitute proof of delivery or receipt by the Contest computers or Sponsor.

8.   PRIZES AND APPROXIMATE RETAIL VALUE: There will be one prize available to be won at the end of the Contest Period. The prize consists of an Excellence NB cloth bag with a hoodie, t-shirt and hat and is valued at approximately $175. All characteristics and features of the Prize, except as otherwise explicitly stated in the Post, shall be selected by the Sponsor in its sole and absolute discretion and are subject to availability.

Without limiting the generality of the foregoing, the Prize must be accepted as awarded and is not transferable, assignable or convertible to cash. No substitutions except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute any Prize or any component(s) thereof with an item or items of equal or greater retail value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award. A Prize will only be awarded to the person whose verifiable full name and valid e-mail address appears on the Account associated with the Entry in question. By accepting a Prize, the confirmed winner agrees to waive all recourse against the Released Parties if the applicable Prize or a component thereof does not prove satisfactory, either in whole or in part. Prize winner is solely responsible for all costs not expressly described herein.

None of the Released Parties makes any representation or offers any warranty, express or implied, as to the quality or fitness of a Prize awarded in connection with the Contest. To the fullest extent permitted by applicable law, the confirmed winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the Released Parties should the applicable Prize or any portion thereof fails to be fit for its purpose or is in any way unsatisfactory. For greater certainty and the avoidance of any doubt, by accepting the applicable Prize, the confirmed winner agrees to waive all recourse against the Released Parties if the applicable Prize or a component thereof does not prove satisfactory, either in whole or in part.

9.   WINNER SELECTION AND ODDS OF WINNING:  The Winner is the photo with the most votes by the general public as of January 30, 11:45pm. If for any reason whatsoever, no eligible Entries are received within the Entry Period then the Prize for the Entry Period will not be awarded.

10. ELIGIBLE WINNER NOTIFICATION AND CONFIRMATION PROCEDURE: The Sponsor or its designated representative will attempt to contact the eligible winner through email within twenty-four (24) hours of the Draw Date.  If the eligible winner does not respond or follow the instructions in the comment within forty-eight (48) hours of the Draw Date, or if there is a return of any notification as undeliverable; then he/she will be, in the sole and absolute discretion of the Sponsor, disqualified (and, if disqualified, will forfeit all rights to the applicable Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate eligible entrant with the second highest number of votes, from among the remaining eligible Entries submitted in accordance with these Rules during the applicable Entry Period immediately preceding the applicable Draw Date (in which case the foregoing provisions of this section shall apply to such newly selected entrant).

NO ONE IS A WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS HIM/HER AS A WINNER IN ACCORDANCE WITH THESE RULES. BEFORE BEING DECLARED A CONFIRMED PRIZE WINNER, each eligible winner will be required to: reply by email within two (2) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Released Parties from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertising carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet (including, but not limited to, any social media platforms).  If an eligible winner: (a) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to the Prize without any liability to the Sponsor) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries submitted and received in accordance with these Rules during the applicable Entry Period immediately preceding the applicable Draw Date; (in which case the foregoing provisions of this section shall apply to such newly selected entrant).

11. GENERAL CONDITIONS:

 ·           All Entries become the property of the Sponsor and emails collected will be added to the newsletter email distribution list. This Contest is subject to all applicable federal, provincial and municipal laws.  The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants.  ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.

·           The Released Parties will not be liable for: (i) any failure of the Fanpage, any website or any platform during or after the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; (v) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; and/or (vi) any combination of the above. 

·           In the event of a dispute regarding who submitted an Entry, Entries will be deemed to have been submitted by the authorized account holder of the Facebook Account used at the time of entry.  “Authorized account holder” is defined as the person who is assigned to an Account by Facebook. An entrant may be required to provide proof (in a form acceptable to the Sponsor including, without limitation, government issued photo identification) that he/she is the authorized account holder of the Facebook Account associated with the Entry in question.

·           The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

·          The Contest is void where prohibited by law and is subject to all Federal, Provincial and Municipal laws and regulations. The Contest and these Contest Rules will be exclusively governed by and construed in accordance with the laws of New Brunswick. Any dispute arising hereunder shall be governed by the laws of New Brunswick and shall be adjudicated in the applicable court in Moncton, New Brunswick.

Excellence NB Concours 2022

RÈGLEMENT OFFICIEL – FRANÇAIS 

CE CONCOURS S’ADRESSE UNIQUEMENT AUX RÉSIDENTS DU NOUVEAU-BRUNSWICK ET IL EST RÉGI PAR LA LOI CANADIENNE. 

Les tarifs standards de données s'appliquent aux participants qui choisissent de participer au concours au moyen d'un appareil mobile. Les participants doivent communiquer avec leur fournisseur de services pour obtenir des renseignements sur les prix, les forfaits et les tarifs avant de participer avec un appareil mobile.

Le concours, Photo d'hiver d’Excellence NB  2022 (le « concours ») n'est en aucune façon commandité, appuyé ou administré par Facebook, ni ne lui est associé. Les participants reconnaissent qu’ils fournissent leurs renseignements à Excellence NB (le « commanditaire ») et non à Facebook. Les renseignements que les participants fournissent ne seront utilisés qu’aux fins de l’administration du concours et conformément à la politique de confidentialité du commanditaire (voir ci‑après). Chacun des participants au concours dégage entièrement Facebook de toute responsabilité. Les questions, les commentaires ou les plaintes concernant le concours doivent être acheminés au commanditaire et non à Facebook. Chaque personne participante ne peut utiliser qu’un (1) compte Facebook (le « compte ») pour participer au concours.

 2.    ADMISSIBILITÉ :Le concours s’adresse aux résidents du Nouveau-Brunswick qui ont 18 ans et plus au moment de l’inscription, à l’exception des employés, représentants ou mandataires (et des personnes domiciliées avec eux, qu’elles aient ou non un lien de parenté avec eux) du commanditaire, de ses filiales, sociétés affiliées, fournisseurs de prix, agences de publicité ou de promotion et toute personne ou entité qui ont participé à la conception, à la production, à la mise en œuvre, à l’administration ou à l’exécution du concours (collectivement, les « parties liées au concours »). Les groupes, clubs, organismes, entreprises et entités commerciales ou non commerciales ne peuvent pas participer au concours.

 3.    COMMENT PARTICIPER :AUCUN ACHAT REQUIS. Pour participer, (i) rendez-vous sur la page https://nbmade.ca et soumettez votre adresse courriel et votre photo.  La photo avec les plus de vote du publique gagne. Vous serez alors admissible à une (1) participation (une « participation » et collectivement des « participations »). Pour être admissible, la réponse doit : (i) être présentée et reçue pendant la période du concours et conformément au présent règlement; (ii) être conforme au présent règlement, y compris, mais sans s’y limiter, aux exigences relatives à la soumission qui figurent à l’article 5 ci-dessous; et (iii) être conforme aux modalités, règlements, politiques et lignes directrices applicables de Facebook (les « règlements de Facebook ») [tels qu’ils sont tous déterminés par le commanditaire à son entière et absolue discrétion]. Toute réponse, telle que déterminée par le commanditaire à son entière et absolue discrétion, qui n'est pas conforme au présent règlement (y compris, mais sans s'y limiter, aux exigences relatives à la soumission qui figurent à l’article 5 ci-dessous) ou aux règlements de Facebook sera rejetée et ne donnera pas droit à une participation au concours.

4.    ACCEPTATION D’ÊTRE LÉGALEMENT LIÉ(E) PAR LE PRÉSENT RÈGLEMENT : La publication comprendra un hyperlien vers le présent règlement officiel (le « règlement »). En participant au concours, vous confirmez que vous avez lu les modalités du présent règlement et que vous acceptez d’être légalement lié(e) par celles-ci.

5.    EXIGENCES RELATIVES À LA SOUMISSION :

LES PARTIES EXONÉRÉES (DÉFINIES CI-APRÈS) N’ASSUMENT AUCUNE RESPONSABILITÉ DE QUELQUE NATURE QUE CE SOIT CONCERNANT : (I) L’UTILISATION DE VOTRE PARTICIPATION (OU DE TOUT CONTENU Y ÉTANT ASSOCIÉ); (II) LA PARTICIPATION À DES ACTIVITÉS LIÉES AU CONCOURS; (III) L'UTILISATION, LA COLLECTE, LE STOCKAGE ET LA DIVULGATION DE TOUT RENSEIGNEMENT PERSONNEL; OU (IV) TOUT PRIX (Y COMPRIS TOUTE UTILISATION OU MAUVAISE UTILISATION D’UN PRIX), DANS LE CAS D’UNE PARTICIPATION GAGNANTE. ●      ne contient aucune référence ou ressemblance à des tiers identifiables, à moins d’avoir obtenu le consentement de toutes ces personnes et de leurs parents/tuteurs légaux s’ils n’ont pas atteint l’âge de la majorité dans leur province ou territoire de résidence;

●      n’entraînera aucune réclamation de quelque nature que ce soit, y compris, mais sans s’y limiter, les réclamations pour contrefaçon ou atteinte à la vie privée ou aux droits publicitaires, ou atteinte aux droits ou aux intérêts d’une tierce partie;

●      n’est pas de nature diffamatoire, infamante, pornographique ou obscène, et qu’elle ne comporte notamment aucun des éléments suivants : nudité; consommation d’alcool, de drogue ou de tabac; contenu à caractère sexuellement explicite ou sous-entendu de nature sexuelle; langage ou symboles vulgaires ou offensants; qualificatifs dénigrants à l’égard de tout groupe, fondés sur l’origine ethnique, la race, le sexe ou la religion (y compris, notamment, à l’égard de tout concurrent du commanditaire); contenu qui approuve tout comportement illégal, inapproprié ou à risque ou qui porte sur un tel comportement; renseignements personnels, y compris des noms, numéros de téléphone et adresses (y compris des adresses électroniques); messages commerciaux, comparaisons ou sollicitations pour des produits ou services autres que ceux du commanditaire; tout produit, marque de commerce, image de marque ou logo identifiable de tiers (autres que ceux du commanditaire) [p. ex. les vêtements portés ou les produits figurant dans la réponse ne doivent pas contenir de logos, de marques de commerce ou d'autres éléments de tiers visibles à moins d'avoir obtenu les consentements appropriés --- remarque : tous les produits, marques de commerce, images de marque ou logos de tiers identifiables pour lesquels la personne participante n'a pas obtenu de consentement doivent être rendus illisibles afin d'être méconnaissables); tout comportement ou toute activité contrevenant au présent règlement; ou tout autre contenu qui est ou qui pourrait être considéré inapproprié ou offensant, tel que le détermine le commanditaire, à son entière et absolue discrétion.

Le commanditaire ou son modérateur de contenu désigné (le « réviseur ») se réserve le droit de filtrer toutes les réponses. Toute réponse que le réviseur, à son entière et absolue discrétion, estime enfreindre les conditions énoncées dans le présent règlement ou les règlements de Facebook fera l’objet d’une disqualification. Le réviseur se réserve le droit, à son entière et absolue discrétion, en tout temps et pour toute raison, de demander à une personne participante de modifier ou de présenter de nouveau sa réponse (ou toute partie de celle-ci), afin de s’assurer que la réponse est conforme au présent règlement, ou pour toute autre raison.

Si une mesure doit être prise à tout moment pendant ou après le concours, le commanditaire se réserve le droit, à sa seule discrétion, de prendre toutes les mesures qu’il estime nécessaires en fonction des circonstances, y compris, mais sans s’y limiter, la disqualification de la réponse (et donc de la participation ou de la personne participante correspondante), afin de s’assurer que le concours est administré conformément à l’interprétation par le commanditaire de la lettre et de l’esprit du présent règlement.

En participant au concours et en présentant une participation, chaque personne participante : (i) sans limiter les règlements de Facebook, accorde au commanditaire, à perpétuité, une licence non exclusive pour publier, afficher, reproduire, modifier ou autrement utiliser sa réponse, en totalité ou en partie, à des fins publicitaires ou promotionnelles du concours ou pour toute autre raison; (ii) renonce aux droits moraux sur la réponse, en totalité ou en partie, pour le commanditaire (et quiconque étant autorisé par ce dernier à utiliser ladite réponse); (iii) consent à dégager de toute responsabilité les parties exonérées à l’égard de tous les dommages, réclamations, responsabilités, coûts et dépenses découlant de l’utilisation de sa réponse (en totalité ou en partie), y compris, mais sans s’y limiter, toute réclamation fondée sur les droits de publicité, la diffamation, l’atteinte à la vie privée, la contrefaçon des droits d’auteur ou des marques de commerce ou toute autre propriété intellectuelle connexe ou tout autre motif de poursuite. 

UNE PARTICIPATION (ET CHAQUE ÉLÉMENT DE CELLE-CI – Y COMPRIS, MAIS SANS S’Y LIMITER, LA RÉPONSE) NE DOIT PAS ÊTRE CONSIDÉRÉE COMME CONFIDENTIELLE. DANS LE BUT D’EFFACER TOUT DOUTE ÉVENTUEL, LE COMMANDITAIRE (ET TOUTE PERSONNE AUTORISÉE PAR LE COMMANDITAIRE) DOIT ÊTRE LIBRE D’UTILISER LA PARTICIPATION (OU TOUT ÉLÉMENT DE CELLE-CI – Y COMPRIS, MAIS SANS S’Y LIMITER, LA RÉPONSE) SANS AUCUNE RESTRICTION – Y COMPRIS, MAIS SANS S’Y LIMITER, L’UTILISATION DE TOUTES LES IDÉES QUE LA PERSONNE PARTICIPANTE A PRÉSENTÉES DE QUELQUE MANIÈRE QUE CE SOIT QUE LE COMMANDITAIRE CHOISIT, SANS AVIS OU OBLIGATION QUELCONQUE ENVERS LA PERSONNE PARTICIPANTE.

6.    LIMITE DE PARTICIPATION : Il y a une limite d’une (1) participation par personne. Pour plus de certitude et par souci de clarté, une personne ne peut utiliser qu’un (1) compte de média social pour participer au concours. En aucun cas une personne participante ne pourra gagner plus d'une (1) participation par canal social. Si le commanditaire découvre (grâce à une preuve ou à un autre renseignement qui lui a été fourni ou qu’il découvre autrement) qu’une personne a tenté : (i) d’obtenir plus d’une (1) participation; ou (ii) d’utiliser plusieurs plusieurs noms, identités, adresses de courriel ou comptes, ou un moyen automatisé, une macro, un script, une aide robotique, un autre système ou programme, ou tout autre moyen ne respectant pas l’interprétation par le commanditaire de la lettre ou de l’esprit du présent règlement pour s’inscrire ou autrement participer à ce concours ou nuire à son bon fonctionnement, cette personne pourrait alors se voir disqualifiée du concours à l’entière et absolue discrétion du commanditaire. Une participation pourrait être rejetée (à l’entière et absolue discrétion du commanditaire) si elle ne contient pas tous les renseignements requis et si elle n’est pas soumise et reçue pendant la période applicable du concours conformément au présent règlement. Le commanditaire, les parties liées au concours, Facebook Inc. et chacun de leurs dirigeants, administrateurs, mandataires, représentants, successeurs et ayants droit respectifs (collectivement, les « parties exonérées ») ne sont pas responsables des participations reçues en retard, perdues, mal acheminées, retardées, incomplètes ou incompatibles (lesquelles seront toutes déclarées nulles).  

7.    VÉRIFICATION : Toutes les participations peuvent faire l’objet d’une vérification à tout moment et pour quelque motif que ce soit. Le commanditaire se réserve le droit, à son entière et absolue discrétion, d’exiger une preuve d’identité ou d’admissibilité (sous une forme qu’il juge acceptable – y compris, notamment, une pièce d’identité avec photo émise par le gouvernement) : (i) pour vérifier l’admissibilité d’une personne au présent concours ; (ii) pour vérifier l’admissibilité ou la légitimité d’une participation ou de toute autre information inscrite (ou prétendument inscrite) aux fins du présent concours; ou (iii) pour tout autre motif que le commanditaire juge nécessaire, à son entière et absolue discrétion, aux fins de l’administration du concours conformément à son interprétation de la lettre et de l’esprit du présent règlement. Le défaut de fournir une telle preuve à l’entière satisfaction du commanditaire dans les délais impartis par le commanditaire pourrait entraîner une disqualification à l’entière et absolue discrétion du commanditaire. Les dispositifs du commanditaire pour chronométrer le temps constitueront le seul moyen permettant d’attester l’heure de la soumission d’une participation au présent concours. La preuve de la transmission (sous forme de capture ou de copie d’écran, etc.) ou de tentative de transmission d’une communication ne constitue pas une preuve de livraison ou de réception par les ordinateurs ou le commanditaire du concours.

8.    PRIX ET VALEUR AU DÉTAIL APPROXIMATIVE : Il y aura un prix à gagner à la fin de la période du concours. Le sac cadeaux incluant un hoodie, t-shirt et casquette ont une valeur approximative de 175 $.

L’ensemble des caractéristiques et des aspects du prix, sauf indication contraire mentionnée plus haut, sont à l’entière et absolue discrétion du commanditaire et sous réserve de disponibilité.

Sans restreindre la portée générale de ce qui précède, le prix doit être accepté tel quel et ne peut pas être transféré, cédé ni converti en espèces. Aucune substitution n’est permise, sauf si le commanditaire opte pour cette possibilité. Le commanditaire se réserve le droit, à son entière et absolue discrétion, de remplacer le prix, en totalité ou en partie, par un ou des articles de valeur au détail égale ou supérieure, y compris, notamment, par un prix en espèces, à l’entière et absolue discrétion du commanditaire. Un prix ne sera attribué qu’à la personne dont le nom entier vérifiable et l’adresse courriel valide figurent sur le compte lié à la participation en question. En acceptant le prix, la personne gagnante officielle accepte de renoncer à tout recours contre les parties exonérées si le prix applicable ou un de ses éléments ne répond pas à ses attentes, que ce soit en totalité ou en partie. La personne gagnante du prix est seule responsable de tous les coûts qui ne sont pas expressément décrits aux présentes.

Aucune des parties exonérées ne fait de déclaration ni ne donne de garantie, expresse ou implicite, quant à la qualité ou à la convenance d’un prix attribué relativement au concours. Dans toute la mesure permise par la loi applicable, la personne gagnante confirmée comprend et reconnaît qu’elle ne peut rechercher de remboursement ni intenter tout recours légal ou équitable à l’encontre du commanditaire ou de l’une ou l’autre des parties exonérées si le prix applicable ou toute composante de celui-ci n’est pas adapté à sa fonction ou est insatisfaisant d’une quelconque façon. Pour plus de certitude et par souci de clarté, en acceptant le prix applicable, la personne gagnante confirmée accepte de renoncer à tout recours contre les parties exonérées si le prix applicable ou une composante de celui-ci ne s’avère pas satisfaisant, en tout ou en partie.

9.    SÉLECTION DES PERSONNES GAGNANTES ET CHANCES DE GAGNER : Le 31 janvier, à Moncton (Nouveau-Brunswick), à environ 12 h 00 HNA (« date du tirage »), le participant admissible sera identifié, soit la photo avec le plus de votes du public. Si, pour quelque raison que ce soit, aucune participation admissible n'est reçue pendant la période du concours, le prix pour la période du concours ne sera pas attribué.

10. AVIS À LA PERSONNE GAGNANTE ADMISSIBLE ET PROCÉDURE DE CONFIRMATION : Le commanditaire ou son représentant désigné tenteront de communiquer avec la personne gagnante admissibles par Facebook ou Instagram dans les vingt-quatre (24) heures suivant la date du tirage. Si la personne gagnante admissible ne répond pas ou ne suit pas les instructions du commentaire dans les quarante-huit (48) heures suivant la date du tirage, ou s’il y a retour d’un avis comme étant non livrable, elle sera disqualifiée à l’entière et absolue discrétion du commanditaire (dans lequel cas, elle perdra tous ses droits au prix applicable). Le commanditaire se réservera alors le droit, à son entière et absolue discrétion et si le temps le permet, de sélectionner au hasard une autre personne participante admissible parmi toutes les autres participations admissibles soumises et reçues conformément au présent règlement pendant la période du concours applicable précédant immédiatement la date du tirage applicable (auquel cas les dispositions qui précèdent dans le présent paragraphe s’appliqueront à la nouvelle personne participante sélectionnée).

NUL N’EST GAGNANT TANT QUE LE COMMANDITAIRE NE L’A PAS CONFIRMÉ OFFICIELLEMENT CONFORMÉMENT AU PRÉSENT RÈGLEMENT. AVANT D’ÊTRE DÉCLARÉE GAGNANTE CONFIRMÉE DU PRIX, chaque personne participante admissible devra : répondre par courriel dans les deux (2) jours ouvrables suivant l’avis, pour confirmer le formulaire de déclaration et d’exonération de responsabilité du commanditaire, qui (entre autres choses) : (i) confirme la conformité au présent règlement; (ii) reconnaît l’acceptation du prix (tel qu’attribué); (iii) dégage les parties exonérées de toute responsabilité à l’égard du présent concours, de sa participation à ce concours ou de l’attribution et de l’utilisation ou du mauvais usage du prix ou d’une partie du prix; et (iv) accepté la publication, la reproduction ou toute autre utilisation de son nom, de son adresse, de sa voix, de ses déclarations au sujet du concours, de sa photo ou de son portrait, sans autre avis ni rémunération, dans toute publicité ou annonce réalisée par le commanditaire ou en son nom de quelque manière que ce soit, y compris en imprimé, en diffusion ou sur Internet (y compris, mais sans s’y limiter, toute plateforme de média social). Si une personne gagnante admissible a) ne retourne pas les documents du concours par courriel dans le délai précisé; c) ne peut pas (ou ne veut pas) accepter le prix (tel quel) pour une raison quelconque; ou d) est jugée état d’infraction au présent règlement (le tout tel que déterminé par le commanditaire à son entière et absolue discrétion); alors elle sera disqualifiée (et perdra tous ses droits au prix sans engager une quelconque responsabilité vis-à-vis du commanditaire), et le commanditaire se réserve le droit, à son entière et absolue discrétion et si le temps le permet, de sélectionner au hasard une autre personne participante admissible parmi les autres participations admissibles soumises et reçues conformément au présent règlement pendant la période du concours applicable précédant immédiatement la date du tirage applicable (auquel cas les dispositions qui précèdent dans le présent paragraphe s’appliqueront à la nouvelle personne participante sélectionnée).

11. CONDITIONS GÉNÉRALES :

·            Toutes les participations deviennent la propriété du commanditaire et les adresses courriels ajoutées à la liste de distribution des infolettres d'Excellence NB. Le concours est soumis à l’ensemble des lois fédérales, provinciales et municipales applicables. Les décisions du commanditaire pour toute question liée au concours, notamment les décisions concernant l’admissibilité et l’exclusion des participations ou des participants, sont définitives, sans appel et lient tous les participants. TOUTE PERSONNE QUE LE COMMANDITAIRE JUGE EN ÉTAT D’INFRACTION À LA LETTRE OU À L’ESPRIT DU PRÉSENT CONCOURS POUR QUELQUE RAISON QUE CE SOIT FERA L’OBJET D’UNE DISQUALIFICATION À L’ENTIÈRE ET ABSOLUE DISCRÉTION DU COMMANDITAIRE EN TOUT TEMPS.

·            Les parties exonérées n’assument aucune responsabilité quant à : (i) toute défaillance de la page Facebook, d’un site Web ou de toute plateforme durant ou après le concours; (ii) toute défectuosité technique ou tout autre problème de quelque nature que ce soit, y compris, sans limitation, ceux liés aux réseaux ou lignes téléphoniques, aux systèmes informatiques en ligne, aux serveurs, aux fournisseurs d’accès, au matériel informatique ou aux logiciels; (iii) l’impossibilité de recevoir, de saisir ou d’enregistrer une participation ou d’autres renseignements pour une raison quelconque, y compris, notamment, en raison de problèmes techniques ou d’un encombrement du réseau Internet ou de tout autre site Web; (iv) tout bris ou dommage à l’ordinateur ou à un autre appareil d’une personne participante ou de toute autre personne relativement à la participation au concours, ou qui en découle; (v) quiconque étant incorrectement ou erronément identifié comme une personne gagnante ou une personne gagnante admissible; ou (vi) une combinaison de ces circonstances.

·            En cas de différend concernant l’identité de la personne qui a soumis une participation, la participation sera réputée avoir été soumise par le titulaire autorisé du compte Facebook utilisé au moment de l’inscription. « Titulaire autorisé du compte » s’entend de la personne à qui Facebook a attribué un compte. Une personne participante peut être tenue de fournir la preuve (sous une forme jugée acceptable par le commanditaire, y compris, notamment, une pièce d’identité avec photo émise par le gouvernement) qu’elle est la titulaire autorisée du compte Facebook associé à la participation en question.

·            Toute disposition invalide ou inexécutoire du présent règlement n’aura aucun effet sur la validité ou le caractère exécutoire de toute autre disposition. Dans l’éventualité où une disposition est jugée non valide ou autrement inexécutoire ou illégale, le présent règlement demeurera par ailleurs en vigueur et devra être interprété conformément aux modalités comme si la disposition invalide ou illégale n’était pas contenue aux présentes.

·            Le concours est nul là où la loi l’interdit et est assujetti à toutes les lois et à tous les règlements fédéraux, provinciaux et municipaux. Le concours et le présent règlement sont régis exclusivement par les lois du Nouveau‑Brunswick et sont interprétés en conformité avec celles-ci. Tout litige découlant des présentes sera régi en vertu des lois du Nouveau-Brunswick et sera tranché par le tribunal compétent de Moncton, au Nouveau‑Brunswick.
