Official Rules
Old World Industries, LLC (the “Sponsor”) is sponsoring the PEAK® John Force Racing Hood Signing Sweepstakes (the “Sweepstakes”). The Sweepstakes is subject to these official rules (the “Official Rules”), and by participating, you (“Entrant”) agree to be bound by them and the interpretations and decisions of the Sponsor, which are final and binding in all respects.
NO PURCHASE OR PAYMENT OF MONEY IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT OF MONEY WILL NOT IMPROVE YOUR CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED. VOID WHERE PROHIBITED BY LAW OR RESTRICTED BY LAW. THIS SWEEPSTAKES IS GOVERNED EXCLUSIVELY BY THE LAWS OF THE UNITED STATES. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.
1. Sweepstakes Period: The Sweepstakes begins at 12:01 AM Central Time (“CT”) on March 15, 2024, and ends at 11:59 PM CT on September 3, 2024 (the “Sweepstakes Period”). The Sponsor’s computer is the official timekeeping device for entry in the Sweepstakes.
2. Eligibility: The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least 18 years of age or older at the time of entry (except in the cases of residents of jurisdictions where the legal age of majority is greater than eighteen (18) years, in which case, such legal age of majority) (the “Entrants”). VOID WHERE PROHIBITED OR RESTRICTED BY LAW. Employees, officers and representatives, and the immediate family members of such employees, officers and representatives (i.e., parent, spouse, sibling, children, grandparents, step parents, step children and step siblings, and their respective spouses, and those living in the same household, whether or not related) of the Sponsor or its affiliated companies, parent companies, subsidiaries, participating promotional partners, advertising and promotion agencies, webmasters, and any company involved in the creation, design, execution, production, or fulfillment of the Sweepstakes, including ViralSweep LLC (the “Administrator”) (collectively, the “Sweepstakes Entities”) are NOT eligible to enter or otherwise participate the Sweepstakes. The Sponsor retains the right to determine in its sole discretion if an existing agreement represents a conflict. Additionally, individuals who are employed by any local, state or federal government office or agency, elected officials, and individuals on the OFAC Specially Designated Nationals and Blocked Persons (SDN) List are not eligible to enter or win the Sweepstakes. Non-eligibility or non-compliance with any of these Official Rules will result in disqualification. For the avoidance of doubt, any references in these Official Rules to “Entrants” includes the Entrant who is deemed the “Winner” as defined below.
3. Agreement to Official Rules: By participating, Entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Sweepstakes. Winning the Grand Prize (as defined below) is contingent upon fulfilling all requirements set forth herein.
4. How to Enter: During the Sweepstakes Period, each Entrant can enter the Sweepstakes by completing the Sweepstakes registration form available at: https://www.owi.com/retail/brands/peak-auto/john-force-racing-hood-signing-contest (the “Website”). At the website, Entrants will be asked to provide their full name, email address, and zip code. After completing the registration form, click the “SUBMIT” button to complete your entry into the Sweepstakes the “Entry”). The “SUBMIT” button must be pressed in order to enter. Proof of entry information at the Website is not considered proof of delivery to or receipt by Sponsor of an entry. The completed registration form will generate one (1) Entry into the Sweepstakes. There is a limit of one (1) Entry per Entrant per month during the Sweepstakes Period. Normal internet access and usage charges imposed by your online and cell phone service provider will apply.
Any attempt by an entrant to obtain more than the stated number of entries during any individual month of the Sweepstakes Period by using multiple/different identities or Addresses/email addresses, and/or any other methods (including, but not limited to submitting entries originating at any other website or using commercial Sweepstakes subscription notification and/or entering service sites) will void all that Entrant’s entries and that Entrant will be disqualified from the Sweepstakes. The use of automated entry devices is prohibited, and no mechanically reproduced entries are allowed; all such entries are void. When submitting an Entry, Entrant is required to provide complete and truthful information for all requested information or the entry is invalid. In case of dispute as to the identity of any Entrant, the Entry will be declared made by authorized account holder of the email address associated with the registration in question. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. All Entries are the exclusive property of Sponsor and will not be acknowledged or returned.
Neither Sponsor nor any Sweepstakes Entity is responsible for any entry that is lost, late, illegible, stolen, mutilated, incomplete, invalid, unintelligible, postage-due, misdirected or undeliverable, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, human error, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Proof of submission will not be deemed to be proof of receipt by Sponsor or Sweepstakes Entity.
5. Winner Selection: There will be 200 winners overall, with one of those 200 winners being declared the Grand Prize Winner. Each month during the Sweepstakes Period, Administrator will draw names at random. Each winner selected during each month of the Sweepstakes Period will win the opportunity to have their name placed on the hood of the John Force car that will be used at the 2024 In-N-Out Burger NHRA Finals. Each winner will have their name published at https://bit.ly/jfrhoodsweeps and by submitting an entry, Entrant expressly permits their name to be published. This prize is of no monetary value.
6. Grand Prize Winner: The potential Grand Prize Winner will be selected in a random drawing conducted by the Administrator. The Grand Prize drawing will be conducted on or about September 12, 2024. Odds of winning the Grand Prize will depend on the total number of eligible entries received throughout the Sweepstakes Period. The potential Winner will be contacted by the Sponsor or Administrator via email address provided by Entrant on the Entry (the “Winner Notification”) and will be required to confirm his/her email address. Details will follow via email. Sponsors decisions are and shall be final and binding in all matters relating to this sweepstakes.
If the Winner Notification is returned as undeliverable, or if Sponsor is does not receive a response from a potential Winner within 72 hours of sending the Winner Notification, or a potential winner is found, at Sponsor’s sole discretion, to not be in compliance with these rules, the Grand Prize will be forfeited and, at Sponsor’s sole discretion, an alternate winner selected. Sponsor shall have no liability for any Winner Notification that is lost, intercepted, or not received by a potential winner for any reason.
7. Grand Prize: There will be one (1) Grand Prize available. The Grand Prize Winner (“Winner”), upon Administrator’s confirmation of eligibility and compliance with these Official Rules, will receive a 3-day/2-night trip for two individuals to Pomona, California (the “Location”) to attend the In-N-Out Burger NHRA Finals (the “Grand Prize”). The Grand Prize package includes:
The Approximate Retail Value (“ARV”) of the total Grand Prize package is $4,750 USD, which will vary depending upon points of departure and destination and seasonal fluctuation of hotel rates and airfares. The value of the Prize set forth above represents Sponsor’s good faith determinations of the ARV thereof and such determinations are final and binding and cannot be appealed.
Additional Terms and Conditions: If the actual value of any part of the Grand Prize Package is lower than the stated ARV when a Prize is procured and fulfilled, then the difference will not be awarded. All other costs and expenses not specifically mentioned as part of the Grand Prize, including but not limited to, airport taxes and fees, baggage fees, ground transportation not specifically delineated, food and beverages costs not specifically delineated, additional hotel amenities or fees and gratuities, etc. are the sole responsibility of the Winner. The Sponsor is not responsible for any cancellations, delays, diversions, or substitutions or any act or omissions whatsoever by the air transportation carriers, hotels, or other transportation companies or any other persons providing any of these services and accommodations necessitated by same.
The Sponsor shall not be liable for any loss or damage to baggage and/or personal property. Travel, hotel, and other accommodations are subject to availability. The Grand Prize Winner and their traveling companion must travel on the same itinerary. The trip must be fully executed between November 16-18, 2024, or the Grand Prize and all the parts of the Grand Prize Package will be forfeited. All travel dates are subject to change in the Sponsor’s sole discretion. Certain blackout dates and material restrictions may apply. NOTE: Substitution, assignment, or transfer of the Grand Prize Package is not permitted, except by Sponsor, who reserves the right to substitute the Grand Prize or any Prize component with another of equal or greater value.
Sponsor and the Sweepstakes Entities shall have no responsibility or obligation to a Winner who is unable or unavailable to, or who does not for any reason, accept or utilize the Grand Prize or any portion thereof. Winner agrees to comply with all terms and conditions applicable to the Prize. All prizes pictured in advertising and other Sweepstakes materials are for illustrative purposes only. The trademarks associated with the Prize are the property of its respective owner.
All U.S. federal, state, and local tax liability, and any other costs and expenses associated with acceptance or use of the Grand Prize not specifically provided for in these Official Rules are solely the responsibility of the Winner (regardless of whether the prize, in whole or in part, is used).
8. Winner Verification, Affidavit, and W-9/Taxes: The Winner will be required to prove eligibility, including, without limitation, proof of age, residence, and identity, which may include submitting a copy of a driver’s license, passport, or similar government-issued identification within seventy-two (72) hours after receiving a Winner Notification.
In addition to proving eligibility as outlined above, the potential winner must sign and return to the Administrator, within seven (7) days of the date the Winner notification is sent, an Affidavit of Eligibility and a Liability & Publicity Release (except where prohibited) in order to claim the Prize. Note: The Affidavit sent to a potential Winner will require that the Winner provide their Social Security Number to the Administrator, which will be used solely for tax reporting purposes. The Winner’s travelling companion may be requested to complete a Travel Companion Waiver.
The potential winner may be required to compete an IRS W-9 form (if required). The Winner will be responsible for all local, state, and federal taxes associated with acceptance or use of the Grand Prize. The Winner must note that the value of the accepted Grand Prize is taxable as income and an IRS Form 1099 will be filed in the name of the Winner for the value of the Grand Prize. The Winner is solely responsible for all matters relating to the Grand Prize after it is awarded.
If any potential winner does not complete all forms necessary within the time given and/or in the event of non-compliance by any potential winner of any of these Official Rules, such potential winner shall be disqualified and shall forfeit the prize, and all privileges otherwise due as a potential winner shall be terminated and, at Sponsor’s sole discretion, an alternate potential winner will be chosen in a random drawing from among all of the remaining eligible entries.
Provided that a potential winner is in compliance with these Official Rules and after having successfully proven eligibility, they will be officially confirmed as the Winner. Sponsor expressly reserves the right to delay the announcement of the Winner for any reason is deems necessary.
Sponsor and the Sweepstakes Entities reserves the right to make a public announcement, announcing each of the 200 winners, including the Grand Prize Winner on either Sponsor’s website or in any manner (including, without limitation social media (e.g., Facebook, Twitter, Instagram, etc.)) Sponsor deems appropriate.
9. Liability Release and Indemnity: THE PRIZE IS OFFERED AND PROVIDED “AS IS” WITH NO WARRANTY OR GUARANTEE BY SPONSOR OR ANY SWEEPSTAKES ENTITY, EITHER EXPRESS OR IMPLIED. IN NO EVENT WILL SPONSOR OR ANY SWEEPSTAKES ENTITY BE LIABLE TO ANY ENTRANT FOR ANY DIRECT, SPECIAL, INCIDENTAL, EXAMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, BUSINESS, OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES, OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM, THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF A PRIZE, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND WHETHER OR NOT SPONSOR AND/OR OTHER SWEEPSTAKES ENTITIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
By entering the Sweepstakes, Entrant agrees to indemnify, defend, and hold harmless, Sponsor and any other Sweepstakes Entities from any and all liability, for any claims, actions, damages, injuries or losses of any kind, and to release all rights to bring any claim, action, or proceeding arising out of, in connection with, or relating to: (i) participation in the Sweepstakes, (ii) without limitation: death or property damage arising directly or indirectly from the acceptance, possession, misuse or use of the Prize, including any vehicle use related thereto, (iii) DEFAMATION, VIOLATION OF PUBLICITY RIGHTS, AND/OR INVASTION OF PRIVACY in connection with the Sweepstakes or acceptance and use or the Prize, and (iv) copyright infringement, trademark infringement, or any other intellectual property-related cause of action arising from or related to the Sweepstakes, the Prize, or Sponsor’s advertising and marketing related to the Sweepstakes, Entrants or the Winners, in all cases, including but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, misdirected or undeliverable entries or prize notifications; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property (including to any computer or mobile device systems resulting from participation in or accessing or downloading information in connection with the Sweepstakes), which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use of any prize. Entrant assumes all liability for any injury or damage caused, or claimed to be caused, by participation in the Sweepstakes, or the acceptance, receipt, or use of the Prize or any Prize component. Entrant further agrees that in any cause of action, Sponsor and/or the Sweepstakes Entities’ liability will be limited to the value of the Grand Prize, and in no event shall the Sponsor or the Sweepstakes Entities be liable for attorney’s fees. For New Jersey Residents: nothing herein bars recovery of damages or attorneys’ fees where mandated by statute.
EACH ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE USA ARE HEREBY EXPRESSLY WAIVED BY HIM/HER. SECTION 1542 READS AS FOLLOWS:
“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”
10. Grant of Rights. Except where prohibited by law, by accepting the Prize, every winner, including the Grand Prize Winner, grants to the Sponsor and all Sweepstakes Entities and those acting pursuant to the authority of any or all of Sponsor and all Sweepstakes Entities, the irrevocable right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time their full name, portrait, image, picture, voice, likeness, and/or biographical information, entry, statements attributed to Entrant (if true) and any video footage related to the Prize, for all Sponsors’ or the Sweepstakes Entities’ advertising, trade, promotional, or other commercial purposes without further payment or additional consideration, and without review, approval or notification and additionally consents to the Sweepstakes Entities putting their name on a winner’s list.
11. Disruption/Termination of Sweepstakes: Sponsor and Sweepstakes Entities are not responsible if the Sweepstakes cannot take place, or if the Grand Prize cannot be awarded due to delays, interruptions or failures due to acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government, or other events outside of the reasonable control of the Sweepstakes Entities. If, for any reason the Sweepstakes is not capable of running as planned, including, without limitation, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sweepstakes Entities, which, in Sponsor’s sole determination, corrupts or affects the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes or any part of the Sweepstakes. If the Sweepstakes or any part of the Sweepstakes is terminated or modified prior to the closing of the Sweepstakes Period, notice will be posted on the Website. Sponsor reserves the right to modify and amend these Official Rules from time to time during the Sweepstakes Period for clarification purposes.
CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
12. No Waiver: Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that term or any other provision of these Official Rules.
13. Privacy: All information submitted by Entrants and collected by Sponsor in connection with Entrant’s entry will be subject to and will be treated in a manner consistent with Sponsor’s Privacy Policy available at: owi.com/owi-legal/privacy-policy. By participating in the Sweepstakes, Entrant hereby agrees that Sponsor may collect and use his or her personal information submitted with the entry and acknowledges that he or she has read and accepted the Sponsor’s Privacy Policy. Among other things, the information Entrants provide may be used for sending Entrants company updates and announcements about Sponsor and its products and/or services.
14. Binding Arbitration: Entrant agrees that: (1) ANY DISPUTE, CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE SWEEPSTAKES OR ANY PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) any dispute, controversy or claim arising out of or relating to the Sweepstakes or any prize awarded shall be resolved by binding arbitration administered by the Judicial Arbitration and Mediation Services (“JAMS”) in accordance with its Comprehensive Arbitration Rules and Procedures (“JAMS Rules”) then in effect; (3) any arbitration shall be heard by one arbitrator to be selected in accordance with JAMS Rules, in Cook County, Illinois; (4) unless both Entrant and Sponsor agree in writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of class or representative proceeding; (5) judgment upon any award rendered may be entered in any court having jurisdiction thereof; and (6) any award or judgment shall be subject to all limitations and releases set forth in these Official Rules and be limited to actual out of pocket damages, and shall not, in any event, include any punitive, exemplary, consequential or incidental damages, attorney’s fees or costs of bringing a claim, or any injunctive or other equitable relief. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
15. Governing Law: All federal, state, and local laws and regulations apply. Void where prohibited by law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes, and the relationship between the Entrant and Sponsor, shall be governed by, and construed in accordance with Illinois law without giving effect to any choice of law or conflict of laws rules (whether of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Illinois.
16. Severability: The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, the other provisions will remain in effect and will be construed as if the invalid or unenforceable provision were not contained herein.
17. Accessibility of Official Rules: A copy of the Official Rules is available via the Website.
18. Opt In/Opt Out: By entering the Sweepstakes you agree to periodically receive email newsletters from Old World Industries. You can opt-out of receiving these communications at any time by clicking the “unsubscribe” link in the newsletter.

You understand that you are providing your information to the Sponsor of this sweepstakes and not to Facebook, Twitter, YouTube, Pinterest, LinkedIn, or Google.
21. Miscellaneous: These Official Rules contain the full and complete understanding with respect to the Sweepstakes and supersede all prior and contemporaneous agreements, representations, and understandings, whether oral or written. The headings herein are for convenience only, do not constitute a part of these Official Rules, and shall not be deemed to limit or affect any of the provisions hereof. No amendment to, or waiver of, any provision of these Official Rules shall be effective unless in writing and signed by both Sponsor and Administrator. The rights and obligations hereunder may not be assigned by Entrants, whether by operation of law or otherwise, without the prior written consent of Sponsor, and any attempted assignment in violation of the foregoing shall be null and void. These Official Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of Sponsor, Administrator, and Entrant. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of these Official Rules or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in the Sweepstakes–related materials, privacy policy, or terms of use on a website and/or the terms and conditions of these Official Rules, the Official Rules shall prevail, govern, and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion. Entrant hereby agrees to waive any rights to claim ambiguity of these Official Rules.
22.
