THE NO GODS NO MASTERS GUITAR GIVEAWAY SWEEPSTAKES OFFICIAL RULES

No purchase or payment of any kind is necessary to enter or win. 

The No Gods No Masters Guitar Giveaway Sweepstakes (“Sweepstakes”) is run by Musictoday, Inc. and BMG Rights Management (US), LLC (collectively “Sponsor”). Participation in the Sweepstakes constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules, along with this website's Terms of Use and the Privacy Policy of the Sponsor.

Sweepstakes Period. The Sweepstakes commences at 12PM ET on May 13th, 2021 and ends at 11:59PM ET on June 17, 2021.

Eligibility. No purchase necessary to enter or win. Sweepstakes is void in countries where restricted or prohibited by law. The Sweepstakes is open to anyone age 18 or older as of the date of entry who legally resides in the United States (excluding Delaware) and Canada (excluding Quebec), except where prohibited by law or in any state that would require advance registration of this Sweepstakes. Sweepstakes is void in Puerto Rico and U.S. territories and possessions. Employees of Sponsor and its affiliates, subsidiaries, and members of their immediate families (parents, siblings, children, and spouses of each) and/or persons living in the same household as such persons, whether related or not, are not eligible.

How to Enter. Entrants may enter the Sweepstakes by entering your email address on https://garbage.shop.musictoday.com/page/sweepstakes or by purchasing any No Gods No Masters item in the Garbage Official Store on or before June 17, 2021 at 11:59PM ET.  Entrants who share links to the Website with their friends via selected social media platforms using the links included in the Promotion can receive additional Entries into the applicable Promotion for each time a friend enters via the link shared. Limit one hundred (100) entries per person. This Sweepstakes is not sponsored by any social media platforms included in the Promotion links.

Personal information submitted by Entrant will be treated according to the Privacy Policy of Sponsor (available by clicking on Privacy Policy). Except where prohibited by law, entry into the Sweepstakes constitutes permission for the following: (1) to send future email messages to the email address supplied in the Entry and (2) Sponsor to send future emails to the email supplied in the Entry. Sponsor reserves the right to deny any entry based on submission of incomplete information or non-compliance with these Official Rules. Sweepstakes Entities (as defined below) are not responsible for late, lost, inaccurate, altered, irregular, fraudulent, forged, improperly accessed, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries or entries which are not in compliance with these Official Rules; or any printing, production, technical, electronic or other errors; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone; computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in entrant's email account to receive email; or other errors of any kind, whether due to electronic, mechanical or human error or other causes.

Any Entries may be made by Entrant by following the methods listed above and shall solely be limited to the one (1) email address provided by Entrant. In event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the person in whose name the address is registered. Entries by any method other than set forth herein are void. Any use of automated or programmed methods of effecting Entry is prohibited. Proof of entering information at the Sweepstakes website or registration form is not considered proof of delivery to or receipt by Sponsor of such entry. Sponsor reserves the right in its absolute discretion to disqualify Entries which it considers do not comply with these Official Rules. 

The potential Grand Prize winner may be required to show proof of being the authorized account holder of the account associated with the Entry and proof of age (i.e. valid photo ID). By entering this Sweepstakes, you agree that you are solely responsible for all data charges that you may incur. All such charges are billed by and payable to your mobile service provider. Please contact your participating mobile service provider for pricing plans, participation status and details.

Winner Selection. All valid entries received by the sponsor by 11:59PM ET on June 17, 2021 (the “Cutoff Date”) will be eligible for a random drawing to take place on June 18, 2021. Entries will be deemed “submitted” when actually received by Musictoday / Sponsor. Any entry forms submitted after the Cutoff Date will not be eligible. The prizes will be awarded to the entrants who are selected through our random drawing. Odds of winning will be determined by the number of valid entries received. The winners will be notified by the email address entrant used to register entry. Each winner has three (3) days from this email notification to respond and confirm in writing the winning entry. If the initial winner for a prize does not respond within this period, then a second drawing will be held. If necessary, subsequent drawings will be held until there is a confirmed winner. The Prize winner(s) may not substitute, assign or transfer any prize or redeem any non-monetary prize for money. The winners shall be required to complete an affidavit or declaration of eligibility/liability and, where permitted by law, a publicity release, which must be signed and returned so that it is received by Sponsor within seven (7) days of the date printed on the prize notification. Failure to comply or non-compliance with these Official Rules may result in forfeiture of all rights to prize(s). Sponsor’s decisions as to the administration and operation of the Sweepstakes and the selection of the potential winner is final and binding in all matters related to the Sweepstakes. Sponsor reserves the right to disqualify any entrant or winner and may refuse to award the Grand Prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the Sweepstakes, or obtained winner status using fraudulent means. Sweepstakes Entities are not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winners. If a prize or prize notification letter is returned as undeliverable, prize may be forfeited and an alternate winner will be awarded. Prizes  will be delivered on or around September 15, 2021.

If a potential winner is a Canadian resident, upon notification, the selected entrant, must, unaided, correctly answer a time-limited mathematical skill-testing question. In the event that a selected entrant is unable to answer the skill- testing question correctly, the Administrator shall have the right to disqualify said entrant and to randomly draw another eligible entry, and the Administrator shall be fully and completely released and discharged from any liability or responsibility in this regard.

Prizes. The winners will be awarded the following prize:

This Sweepstakes is not sponsored by Fender Musical Instruments Corporation.

The shipping method of the Grand Prize will be determined at the sole discretion of Sponsor. Sponsor is not responsible for any circumstances that make it impractical or impossible to fulfill the Grand Prize.

Approximate Retail Value: $750 (USD). Any difference between stated approximate retail value and actual value of the Grand Prize will not be awarded. 

All expenses not specified herein are not included and are Grand Prize winner’s sole responsibility. No substitution of the Grand Prize offered, no transfer of the Grand Prize, whether in whole or in part, to a third party is permitted and prize may not be redeemed for cash value, except by Sponsor, who reserves the right in its sole discretion to substitute the Grand Prize for a prize of comparable or greater value. All fees, federal, state, local or other expenses relating to the use, acceptance and possession of the Grand Prize are the sole responsibility of the winner. Taxes are the responsibility of winner. The winner may receive an IRS form 1099 at the end of the calendar year, a copy of which form will also be filed with the Internal Revenue Service. Any valuation of the Grand Prize stated above is based on available information provided to Sponsor and the value of any Grand Prize awarded to the winner may be reported for tax purposes as required by law.

General Terms and Conditions. By participating, entrants agree that Sweepstakes EntitiesSponsor, their shareholders, members, agents and representatives, affiliates, subsidiaries, related entities, advertising, promotion and fulfillment agencies, and legal advisors (“Sweepstakes Entities) are not responsible or liable for, and shall be released and held harmless from: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) any condition caused by events beyond the control of Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (iii) any printing or typographical errors in any materials associated with the Sweepstakes; (iv) any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from participation in the Sweepstakes, acceptance, possession, or misuse of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy; (v) any other non-compliance with these Official Rules. The Sweepstakes Entities are not responsible for typographical or other errors in the offer or administration of the Sweepstakes, including but not limited to: errors in the advertising, Rules, selection and announcement of winner and distribution of the Grand Prize and are not responsible for any inability of the winner to accept or use the Grand Prize (or any portion thereof) for any reason. Sponsor has the right, in its sole discretion, to disqualify any individual it suspects to be doing any of the following: (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes; (b) violating the Rules or the Privacy Policy; (c) violating any other terms, conditions of use and/or general rules or guidelines of any Sweepstakes property or service or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or for any other good cause as determined solely by the Sponsor. Sweepstakes Entities reserve the right, in its sole discretion, to amend and interpret these Official Rules at any time and to modify the Grand Prize award procedures at its sole discretion, and to terminate, suspend or cancel Sweepstakes at any time for any reason, including, without limitation, if a computer virus, bug, or other technical problem or security breach corrupts the administration, security, or proper conduct of the Sweepstakes. The decisions of Sponsor are final and binding in all respects. Any provision of these Official Rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these Official Rules will remain in effect. Participation in this Sweepstakes constitutes permission (except where prohibited by law) to use the winners’ names, hometowns (including state or province) and/or likenesses for promotional purposes without further compensation. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Virginia, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Virginia or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Virginia. Any claim arising out of the foregoing shall be instituted solely in a court situated in Albemarle County, Virginia, and entrant and Sponsor irrevocably agree to submit to the personal and exclusive jurisdiction of such court. All federal, state and local laws and regulations apply. A copy of these Official Rules and a winners list may be obtained by sending a request to No Gods No Masters Guitar Giveaway Sweepstakes: Musictoday Marketing, 5391 Three Notch’d Road, Crozet, Virginia, 22932 not later than June 26, 2021.

Photo Submissions. If you submit a photo or photos to us, you hereby grant us a non-exclusive, fully paid and royalty-free license to use all submitted photos in their submitted form, subject to re-sizing or re-formatting, for publication in official store emails, social media posts, or display advertising. By submitting, you represent and warrant that we may publish such photo without liability or compensation to you. Your submission of photos constitutes your acceptance of the terms and conditions in these photo submission guidelines.

Limitation of Liability/Disclaimer of Warranties. IN NO EVENT WILL THE SWEEPSTAKES ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO THE SWEEPSTAKES AND USE OF THE GRAND PRIZE.SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. THE SWEEPSTAKES AND THE GRAND PRIZE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
