Official Rules — The Upland Giveaway

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

SPONSORS. The Upland Giveaway (“Giveaway”) is sponsored by Uncommon Wild, LLC (collectively, “Sponsors”), located in Oregon.

1.  All submissions must be submitted as provided by the Contest Rules. ENTRY PERIOD: Aug 15, 2025  12:00 AM to Sept 9, 2026 1159 PM . Any winning entries may be contacted via email and/or phone; failure to respond to either email or phone within one week (7 calendar days) may result in disqualification of the entry and another winner may be selected. Unless otherwise stated in the Contest Rules, only one entry may be submitted per Participant per Contest. If a Contest accepts web entries, Participants must accurately complete all required fields or the entry will be deemed incomplete and will not qualify.

2. ENTRY: Contest entries may be submitted as advertised or otherwise prescribed by Sponsor for the Contest. IF YOU PROVIDE YOUR EMAIL ADDRESS OR OTHER CONTACT INFORMATION AS PART OF YOUR ENTRY, YOU ARE PROVIDING THIS INFORMATION TO "SPONSORS" AND YOU CONSENT TO RECEIVE SPONSOR’S EMAILED NEWSLETTER AND OTHER PERIODIC MARKETING MATERIALS AND PROMOTIONS VIA EMAIL OR OTHERWISE.  YOU MAY REQUEST SPONSOR TO STOP THESE COMMUNICATIONS AT ANY TIME. Entries must be made during the time periods advertised or otherwise prescribed for each Contest (the “Entry Period”).  Entries that do not comply with the entry instructions or Specific Contest Rules, or that contain inappropriate or offensive content as determined by Sponsor in its sole discretion, will be disqualified. You may enter only once. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent these General Rules or any Specific Contest Rules. 

3. ELIGIBILITY: This giveaway is open only to legal residents of the United States who are 21 years of age or older and who comply with all federal, state, and local laws regulating firearm ownership.

Due to legal restrictions, this giveaway is void where prohibited, including but not limited to the following states and jurisdictions:

• California

• Connecticut

• Hawaii

• Illinois

• Maryland

• Massachusetts

• New Jersey

• New York

• Rhode Island

• Washington D.C.

• Puerto Rico

• Any other state or locality where firearm giveaways are restricted or prohibited by law

Entrants are responsible for knowing and complying with their local laws. Winners will be required to complete a federal background check and must take possession of the firearm through a federally licensed firearms dealer (FFL) in accordance with all applicable laws.

If the selected winner resides in a restricted jurisdiction or fails the background check, they will be disqualified and an alternate winner will be selected. No substitution, transfer, or cash equivalent will be provided in such cases.

Employees of Sponsor or Sponsor’s affiliates, subsidiaries, and agencies, and members of their immediate family or persons living in the same household are not eligible to participate. To be eligible to participate, all product and service prizes must comply with the legal and governmental requirements in your area and you must be legally allowed to receive and possess all Contest product and service prizes under all federal and applicable state and local laws and regulations in order to be eligible. If, at any time, Sponsor has reason to believe you cannot lawfully receive a prize, or if your application to take transfer of any prize is denied by any federal agency, your entry will be disqualified and you will not be eligible to participate in the Contest. Participation in this Contest is void outside of the United States and where prohibited or otherwise restricted by law. Any firearm prize(s) will be transferred through Weatherby, INC to a participating FFL of the winner's choosing, in compliance with all applicable laws. The winner must pass the required NICS background check and any additional screenings as mandated by federal, state, or local authorities. 

4. DISQUALIFICATION.  All participants agree to be bound by these General Rules. Non-compliance with any of these General Rules may result in disqualification and all privileges as a Participant in such case will be immediately terminated. Sponsor, in its sole discretion, further reserves the right to disqualify any person for: (i) tampering with the entry process or the operation of the Contest; (ii) gaining an unfair advantage in participating in the Contest; (iii) obtaining winner status using false, fraudulent or deceptive means; or (iv) engaging in otherwise unsportsmanlike, disruptive, annoying, harassing, or threatening behavior.

5. ENTRIES ARE THE PROPERTY OF SPONSOR: All Contest entries and/or related submissions become the sole and exclusive property of Sponsor upon transmission. Contest entries will not be returned and may be used by Sponsor and any Promotion Party for any purpose whatsoever, without additional compensation to the Participant or any other individual or entity.

6. SELECTION OF PRIZE WINNER(S): The prize winner(s) will be selected in accordance with the  Contest Rules as interpreted and determined in the sole discretion of Sponsor. 

(a) If the Contest is a sweepstakes to be determined by random drawing, a random drawing will be conducted at the time specified in the Specific Contest Rules or else on or about the first business day after the close of the entry period, by which Sponsor will select the winner from among all eligible entries received. Odds of winning depend on the number of entries received. The winner will be notified via the method stated in the  Contest Rules and must respond within one week (7 calendar days) from the date of the direct message.  

(b) Participants may only win a Contest once every thirty (30) days from the date of selection. However, where a Participant has won a prize valued over $500, the Participant is ineligible to win another prize for a period of twelve (12) months from the date of selection. Participants who have won a Sponsor Contest in the last thirty (30) days or who have won prizes valued over $500 in the last twelve (12) months are ineligible.

(c) Sponsor reserves the right to cancel, terminate, modify or suspend any Contest if the Contest is not capable of being completed as planned for any reason, including, but not limited to, infection by computer virus, “bugs,” tampering, unauthorized intervention, fraud, or technical failures of any kind or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of any such Contest. The decision of Sponsor to cancel, terminate, modify or suspend any Contest shall be final in all respects.

(d) The Participant prize-winner is solely responsible for determining and paying all federal, state and local taxes (including any sales taxes). A winner may be required to fill out a 1099 tax release form.  All income taxes resulting from the acceptance of the prize are the responsibility of the winner. Any other costs or expenses relating to the prizes are the sole responsibility of the winner.

(e) By entering this Contest, Participant accepts and agrees to the Contest Rules and the decisions of the Sponsor, which shall be final in all matters. Acceptance of a prize also constitutes permission and consent to the Sponsor to use the winner's name, likeness, and biographical information, as well as any other materials submitted in the Contest entry, for marketing purposes without further compensation or right of approval, unless prohibited by law. All federal and state laws apply.

7. LIMITATION OF LIABILITY: By entering any Contest, and as consideration for entering such Contest, Participant on behalf of Participant and all others claiming by, through, or on behalf of Participant releases covenants not to sue, and holds harmless Sponsor, as well as Sponsor’s employees, owners, officers, parents, subsidiaries, affiliates, contractors, insurers, and agents (collectively the Promotion Parties;) from or for any claim, liability, loss, action of any type or nature (whether sounding in tort, contract, warranty, product liability, breach of privacy, misappropriation of likeness, or identity theft) damage (including punitive, incidental, and consequential damages), or expense (including attorneys fees) arising out of or in connection with the Contest, Participant’s or any other person’s entry or participation in the Contest, the submission or acceptance of any Contest entry or Submission Works, the selection or determination of any winner, or the acceptance, use, or misuse of any prize, EVEN IF ALLEGED TO BE CAUSED BY THE SOLE OR PARTIAL NEGLIGENCE OR STRICT LIABILITY OF SPONSOR. Without limiting or otherwise diminishing the effect of the preceding language, Promotion Parties will not be responsible for: late, incomplete, or incorrect entries; a Participant failure to receive prize notices due to Participant’s spam, junk e-mail, or other security settings or for Participant’s provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Contest; by any human error which may occur in the processing of the entries in this Contest; or any typographical, technological, or other error in the publishing of the offer, administration of the Contest, or announcement of the prizes. If, in the Sponsor’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Contest, or if technical difficulties (including viruses and bugs) compromise the integrity of the Contest, Sponsor reserves the right, in its sole discretion, to cancel or modify this Contest in a manner deemed appropriate by the Sponsor. In the event of termination, the winner will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning Participant, determination of the identity of the winner will be determined by the Sponsor in its sole and binding discretion. 

8. INDEMNIFICATION.  Additionally, as consideration for entering the Contest, all Participants agree to INDEMNIFY, HOLD HARMLESS, AND DEFEND the Promotion Parties in any action or proceeding from and against all claims, damages, charges, injuries, losses, proceedings, suits, action of any type or nature (whether sounding in tort, contract, warranty, product liability, breach of privacy, misappropriation of likeness, or identity theft), expenses and attorney fees that they or anyone on their behalf (including but not limited to their heirs, representatives or next of kin) have or might have for any death, injury, damage or claimed injury or damage arising out of, involving or relating in any manner to their participation in the Contest or for their failure to comply with the terms of the above release provision. This agreement to indemnify, hold harmless and defend applies even if the act or omission complained of was allegedly caused in whole or in part by the strict liability or negligence in any form of the Promotion Parties.

9. PRIZES: The actual prizes and value of each prize will vary for each Contest. Descriptions of prizes will be announced for each Contest separately. Prizes consist of only those items specifically listed as part of the prize in the Specific Contest Rules. 

(a) Limit one prize per family or household. 

(b) No substitution or transfer of prize permitted by winner. Sponsor reserves the right to substitute a prize of equal or greater value. If a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner from among all remaining eligible entries. 

(c) Sponsor makes no warranty, guarantee or representation or any kind concerning any prize and SPONSOR DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE.

10. PUBLICITY.  Unless prohibited by applicable law, Participant authorizes and irrevocably grants, without compensation, to Sponsor and the other Promotion Parties (as defined above) permission to, from time to time, reference and discuss Participant and their participation in the Contest in publications and/or on their website(s) in photographs, video recordings, digital images, audio recordings, as well as in newsletters, news releases, other printed materials, and in materials made available on the Internet or in other media now known or hereafter developed for any purpose Sponsor and/or the Promotion Parties deem proper. Such reference and discussion may involve Participant’s name and voice, and other personal/biographical material or their participation on-air.

11. CHOICE OF LAW AND FORUM: Participant agrees that all matters arising out of or relating to the Contest, these Contest Rules, and any applicable Contest Rules, including interpretation of any of the foregoing, are governed by, and will be construed in accordance with, the laws of Oregon, without giving effect to any of its conflict of laws provisions. Participant further agrees that any legal suit, action, or proceeding arising out of or relating to this Contest and these General Rules shall be brought exclusively in the applicable federal or state courts located in Deschutes County, Oregon. Participant hereby irrevocably submits and consents to the exercise of personal jurisdiction over Participant by such courts for any matter, claim, lawsuit, action or proceeding arising out of or relating to the Contest, these General Rules, and any applicable Specific Contest Rules.

12. WAIVER OF JURY TRIAL.  PARTICIPANT IRREVOCABLY AND UNCONDITIONALLY WAIVES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY RIGHT PARTICIPANT MAY HAVE TO A TRIAL BY JURY IN ANY LEGAL ACTION, PROCEEDING, CAUSE OF ACTION, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THE CONTEST, THESE GENERAL RULES, AND ANY APPLICABLE SPECIFIC CONTEST RULES.
