IMPORTANT: PLEASE READ THESE SMITH & WESSON® RED, WHITE, AND BIG BLUE WRAPPED GIVEAWAY OFFICIAL RULES (“OFFICIAL RULES”) BEFORE ENTERING THIS SWEEPSTAKES. BY PARTICIPATING IN THIS SWEEPSTAKES, YOU REPRESENT THAT YOU ARE ELIGIBLE TO PARTICIPATE IN THE SWEEPSTAKES AND YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES.

1. NO PURCHASE NECESSARY. NO PURCHASE, PAYMENT OR OTHER CONSIDERATION IS NECESSARY TO ENTER OR WIN A PRIZE IN THIS SWEEPSTAKES. A PURCHASE WILL NOT IMPROVE THE CHANCES OF WINNING. THIS IS A SWEEPSTAKES OF CHANCE. SKILL PLAYS NO PART IN THE DETERMINATION OF WINNERS.

2. SPONSOR. Smith & Wesson Inc., 1852 Proffitt Springs Road, Maryville, TN 37801 (“Sponsor”).

3. Description of Sweepstakes and Grand Prize. In the Smith & Wesson® Red, White, And Big Blue Wrapped Giveaway (the “Sweepstakes”), eligible persons wishing to participate must submit an entry (or entries) in accordance with these Official Rules, during the Sweepstakes Term (defined below).

Sponsor will award five (5) grand prize package immediately following the close of the Sweepstakes Term to five (5) unqiue lucky winners.

  • The grand prize package total value is dependent on the product chosen by the eligible winner. The value of the grand prize package is $999 if the Performance Center® Smith & Wesson M&P®9 M2.0® Metal Carry Comp is chosen or $799 if the Performance Center® Smith & Wesson M&P®9 M2.0® Compact Carry Comp is chosen or $649 if the Performance Center® Smith & Wesson M&P®9 Shield® Plus Carry Comp is chosen.

  • The eligible winner of the grand prize package #1 shall have the option to choose either one (1) Smith & Wesson Model 1854 .45 Colt Synthetic OR one (1) Smith & Wesson Model 45 Colt .45 Colt Walnut.
  • The grand prize package #1 total value is dependent on the product chosen by the eligible winner. The value of the grand prize package is $1,279 if the Smith & Wesson Model 1854 .45 Colt is chosen or $1,399 if the Smith & Wesson Model .45 Colt Walnut is chosen.

4. Sweepstakes Term. The Sweepstakes begins Thursday, July 23, 2024, at 9:00:00 a.m. US Eastern Time (“EST”) and ends Wednesday July 31, 2024, at 11:59:00 p.m. EST (the “Sweepstakes Term”). All entries must be submitted either via the primary method (landing page: https://www.smith-wesson.com/giveaway), or the alternate method (email), in accordance with these Official Rules to be eligible to win.

5. How to Enter.

B. Alternate Method:

Via Email: To enter the Sweepstakes via email, send an email to sweepstakes@smith-wesson.com with “Smith & Wesson® Red, White, And Big Blue Wrapped Giveaway” in the subject line. An email entry must include entrant’s first and last name, address, email address and date of birth. Entrants using the alternate method of entry are limited to one hundred and seventy-one (171) total email entries.

Limit of one hundred and seventy-one (171) entries by either the primary method or the alternate method of entry (as detailed above) total per person during the Sweepstakes Term. Entries that do not comply with these Official Rules will not be accepted.

Automated or robotic entries submitted by individuals or organizations will be disqualified. Except as provided herein, any attempt by an entrant to enter using multiple/different email addresses, identities, registrations, logins, or any other methods to circumvent the entry limits of this Sweepstakes will void that entrant's entries and that entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All entries must be submitted before the end of the Sweepstakes Term to be eligible to win. Sponsor will not verify receipt of entries, and proof of submission will not be deemed proof of receipt by Sponsor. Entry materials are automatically null and void if not obtained through the authorized channels or if any part is late, lost, stolen, incomplete, illegible or unintelligible, invalid, damaged, misdirected, or contains errors, and Sponsor is not responsible or liable in any way for such entries or errors. Sponsor is not obligated to notify a participant of a disqualified entry. Unless required by applicable law, Sponsor is not required to review or respond to any correspondence received from an entrant regarding the Sweepstakes.

6. Odds of Winning. Odds of winning a prize depend on the number of valid entries received. Many will enter, one will win. Only one (1) grand prize packages will be awarded to one (1) winner.

7. Eligibility. Persons residing or stationed in U.S. territories and possessions, U.S. military installations or diplomatic stations in foreign countries, and all other foreign locations are also excluded from and are not eligible for participation in this Sweepstakes. Entrants who legally reside in eligible U.S. states must be twenty-one (21) years old or older at the time of entry and must be able to provide proof of legal residency. Sweepstakes entrants in eligible U.S. states must be able to legally own and possess a firearm in their state of legal residence. This Sweepstakes is not open to any persons who are prohibited by any law from owning or possessing firearms, or to residents of states or jurisdictions where owning/possessing the firearm prize (or any part thereof) is prohibited or restricted by applicable law. Additional eligibility requirements are set forth in these Official Rules. Employees of Sponsor and its agents, affiliates, and subsidiaries and members of their families and immediate households, as well as any persons who were awarded a prize or received any promotional consideration from the Sponsor within six (6) months prior to the beginning of the Sweepstakes Term, are not eligible to participate in this Sweepstakes. All applicable federal, state, and local laws and regulations apply. The Sponsor's determination of eligibility, in its sole discretion, shall be final.

8. Winner. Each prize package winner will be selected by random drawing immediately following the close of the Sweepstakes Term. The prize package winner will be notified by email. Each prize package winner must respond to Sponsor via email response, to the notification from Sponsor, with the prize package winner’s name, address, phone number, and email address within ten (10) days of the email from Sponsor to claim the prize package. Prize package winner must be legally able to own and possess the firearms prize and/or pass a firearms transfer background check (i.e., must not be a “prohibited person” under applicable laws). The firearm portion of the prize package will be awarded through a participating federally licensed firearms dealer retailer located in the state of the prize winner legal residence and will not be shipped directly to the prize package winner. Dealer firearm transfer fees and any background check fees are the responsibility of the prize package winner. To be eligible to claim and receive the prize package, the prize package winner(s) must follow the instructions contained in his or her notification and will be required to demonstrate eligibility in accordance with these Official Rules. Potential prize package winner shall be required to complete, sign, and return within ten (10) days following such notification (or an attempted notification), (a) an Affidavit of Eligibility, (b) a Publicity Agreement and Release, and (c) any other necessary documentation as may be required pursuant to these Official Rules or under applicable laws. Prize package winner shall not, as determined by Sponsor acting in its sole discretion, have engaged in conduct or speech that would tend to shock, insult, or offend the community or that would tend to diminish the reputation of Sponsor’s brands; bring Sponsor into public disrepute, contempt, scandal or ridicule; or otherwise reflect unfavorable on Sponsor or the Sweepstakes. If for any reason Sponsor is unable to contact the prize package winner, or the prize package winner fails to timely respond or is otherwise ineligible, the prize package will be awarded via a random drawing to another eligible entrant. Sponsor, and its agents, affiliates, and subsidiaries, may use the prize package winner’s name, likeness, and any other information or content without compensation in advertising or otherwise.

9. Prize Restrictions. The prize package consists of the items specifically listed in these Official Rules only. Sponsor shall choose all components of each prize package in its sole discretion. The prize package (including all components and accessories) is subject to availability and may be subject to additional federal, state, or local restrictions (including but not limited to restrictions on magazine capacity and other firearm characteristics). No substitution or cash equivalent of the prize package (or portion of any prize package) will be granted except at Sponsor’s sole discretion due to unavailability of, or compliance restrictions concerning, a prize package (or portion of a prize package) for any reason. Any substitution by Sponsor of the prize package or portion of the prize package shall be made with an item of comparable or greater value. For the firearm portion of prize package, Sponsor is responsible only for delivery of the firearm prize to a participating federally licensed firearms dealer located in the state of the prize package winner’s official residence. Sponsor is not responsible for prize utility, quality, or other attributes. The prize package (or any portion of the prize package) is not transferable or assignable to any other party.

10. Sweepstakes Materials. By entering into this Sweepstakes, you grant to Sponsor an irrevocable, perpetual, worldwide, non-exclusive, royalty-free, sub-licensable right and license to distribute, reproduce, modify, perform, and display, and otherwise use any and all content, information, posting, communication, message or other materials (including your name, image or likeness) provided by you (“Sweepstakes Materials”) for Sponsor’s use in the normal conduct of its business, including but not limited to marketing, promotional, and sales activities. Subject to these Official Rules, you understand that all Sweepstakes Materials will be treated as non-confidential and non-proprietary information.

11. Privacy. Participating in this Sweepstakes requires providing certain Personal Identifying Information to Sponsor. Sponsor collects Personal Identifying Information from all entrants participating in this Sweepstakes (whether or not an entrant is selected as a prize package winner). This information consists of:

• Identifiers: first name, last name, date of birth, state of residence, and email address
• Internet Activity: IP address of the device used to submit entry information, Language entry source, and date of entry.

You will not be required to disclose personal financial information to enter the Sweepstakes. The winner of the Sweepstakes will be required to submit additional Personal Identifying Information in the form of first name, last name, date of birth, residential address (street, city, state, and zip code), email address, a valid, government-issued photo identification, contact telephone number, and Taxpayer Identification Number (TIN) for prizes with a value over $600.00. The collection and use of collected Personal Identifying Information shall be governed by Smith & Wesson’s Privacy Policy (identified below) for the purpose of facilitating this Sweepstakes.

Consumer Directed Sharing: Participating in this Sweepstakes requires the sharing of your information with the Participating Companies as described below for the purpose of facilitating this Sweepstakes. The Sponsor and the Participating Companies will treat your Personal Information in accordance with their respective privacy policies, links to which are provided below.

By entering this Sweepstakes, you agree that Sponsor and Participating Companies may also use your Personal Identifying Information to send you future marketing communications regarding the promotion of its products, offers, and events.

12. Opt Out: You may unsubscribe from the receipt of such marketing communications at any time by clicking the “unsubscribe” link on each email or in accordance with the process set forth below for the Sponsor and Participating Companies.

13. Additional Sharing of Winner’s Information: If an entrant it chosen as a winner, their first name and last initial, city and state, will be shared on a publicly available winner’s list from Sponsor, or as required by applicable law.

14. Right to Know: You have the right to request that the Sponsor and Participating Companies disclose what personal information they collect, use, disclose, and sell (if applicable). You may make this request by contacting the Sponsor and Participating Companies using the contact information (telephone or email) provided below. You may also designate an agent to make a request on your behalf by submitting a written request and designation of agent to the Sponsor and Participating Companies. In either case, in order to verify your identity you will need to provide the Sponsor with a copy of a valid government-issued identification which contains information that accurately corresponds to the information you provided in the submission of your entry into this Sweepstakes. The Sponsor and Participating Companies will verify the information on the copy of the identification provided against the Sweepstakes entry information provided.

15. Right to Delete: You have the right to request that the Sponsor and Participating Companies delete personal information they collect, use, disclose, and sell (if applicable). You may make this request by contacting the Sponsor and Participating Companies using the contact information (telephone or email) provided below. To verify your identity, you will need to provide the Sponsor and Participating Companies with a copy of a valid government-issued identification which contains information that accurately corresponds to the information you provided in the submission of your entry into this Sweepstakes. The Sponsor and Participating Companies will verify the information on the copy of the identification provided against the Sweepstakes entry information provided.

16. No Discrimination: You have a right not to receive discriminatory treatment for the exercise of the privacy rights conferred to you under applicable data protection laws.

By participating in this Sweepstakes, entrants acknowledge that they are disclosing their Personal Information to Sponsor. If entrants choose to opt-in, they are disclosing their personal information to Participating Companies as well.

17. Taxes / Fees. All taxes or incidental expenses are the sole responsibility of the prize package winner. Rights to the prize package (or any portion thereof) are not transferable. Except as provided herein, the prize package (or any portion thereof) may not be substituted or redeemed for cash or other consideration. Each prize package winner will be required to complete and submit an IRS Form W-9 to Sponsor before any prize can be delivered.

18. Announcement of the Winner. For the name of the prize package winner, please send a self-addressed, stamped envelope to Sponsor at the following address:

Vermont residents may omit return postage. Requests for the name of the prize package winner must be received within sixty (60) days of the last day of the Sweepstakes Term.

19. No Sponsorship by Facebook. This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Facebook, Inc. or its parent, affiliates, or subsidiaries.

20. Void Where Prohibited. The Sweepstakes is void where restricted by applicable law, subject to tax, or otherwise prohibited. The Sweepstakes is strictly for entertainment purposes and may not be used in connection with any form of gambling.

21. Changes to Official Rules. Sponsor reserves the right to change the Official Rules or cancel the Sweepstakes at any time without further obligation or liability.

22. Disclaimer of Liability. Sponsor is not responsible for any incorrect or inaccurate information associated with or utilized in the Sweepstakes, including but not limited to any printing or typographical errors in any Sweepstakes materials, or for any technical or human error, which may occur in the processing of entries in the Sweepstakes. Sponsor has no liability or responsibility for entrant’s participation in or attempt to participate in the Sweepstakes or ability or inability to enter the Sweepstakes. Sponsor is not responsible for any personal injury or property damage or losses of any kind whatsoever which may be sustained by entrant’s or any other person’s computer equipment, smart phone, or mobile device resulting from participation or attempted participation in the Sweepstakes. Sponsor assumes no responsibility for any incomplete, misdirected, late, or lost entries, or any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, garbled or corrupted data transmitted, inaccessibility of any entry website, theft or destruction or unauthorized access to, or alteration of, entries or entry data, telephone, cable, satellite, network, electronic or Internet connectivity or any other online or telephone network communication problems, errors or limitations of any Internet or telephone service providers, servers, hosts or other providers, failure of any online transmissions to be sent or received, or traffic congestion on the Internet or any entry website. If, for any reason, the Sweepstakes is not capable of running as planned, whether as a result of tampering, unauthorized intervention, fraud, or any other causes beyond the control of the Sponsor which affects the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or otherwise suspend the Sweepstakes. In the event that proper administration of the Sweepstakes is prevented by such similar causes as contemplated above, Sponsor will pick the prize winner(s) from all eligible, non-suspect entries received prior to such action.

Entrants agree that Sponsor, its parent, subsidiaries and affiliated companies, Facebook, Inc., and their respective officers, managers, members, directors, employees, representatives and agents will have no liability whatsoever for, and shall be held harmless by entrants against, any and all liability, including but not limited to any liability arising from or related to death, injury, loss or damage of any kind, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, participation or attempted participation in this Sweepstakes, or while traveling to, preparing for or participating in any prize-related activity.

23. Disqualification. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of any of the Sweepstakes; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Sponsor, its subsidiaries, affiliates and agents, will be the sole judge of all matters relating to this Sweepstakes.

24. General. By entering this Sweepstakes, each entrant warrants that: (a) the entrant has read, understood, and followed these Official Rules; (b) the entrant agrees to be bound by the decisions of the Sponsor; and (c) the entrant is eligible pursuant to these Official Rules. Each potential prize winner may be subject to verification and investigation before being awarded any prizes. This Sweepstakes shall be governed by Massachusetts law. By participating in this Sweepstakes, entrants agree that, except to the extent prohibited by applicable law: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, and Massachusetts state courts shall have exclusive jurisdiction over any dispute or litigation arising from or relating to this Sweepstakes and that the exclusive venue shall be in Springfield, Massachusetts; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event shall there be a claim or award of attorneys’ fees or costs; and (3) under no circumstances will entrants be permitted to obtain, and entrant hereby waives all rights to claim, punitive, incidental, and/or consequential damages or any other damages of any sort whatsoever, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

In case of a dispute over the identity of an entrant who submitted the winning entry, the authorized account holder of the email account associated with that entry will be deemed the entrant. The “authorized account holder” is deemed the natural person who is assigned the email account by the email services provider. Such owner must: (a) comply with these Official Rules; (b) be the person who completed the act of entering; and, (c) in Sponsor’s sole discretion, may be required to provide proof of ownership of the email account.
