NO PURCHASE, ACCOMMODATION RESERVATION, OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR TO WIN THE PRIZE IN THIS SWEEPSTAKES. A PURCHASE OR ACCOMMODATION RESERVATION WILL NOT IMPROVE YOUR CHANCES OF WINNING.

Eligibility: The Discover the Kona Coast & Waves of Waikiki Sweepstakes (this “Sweepstakes”) is only open to permanent legal residents of the fifty (50) states of the U.S., the District of Columbia and Canada (excluding Quebec) who are currently physically located and residing therein, except where prohibited by law. All entrants must be eighteen (18) years of age or older and have online access as of the date of entry into the Sweepstakes. Entrants must also have either a valid social security number and/or a valid personal tax identification number. Employees of Outrigger Hotels Hawaii ["Outrigger Hotels Hawaii or any affiliate ("Outrigger")] (“Sponsor”), those involved in the production, development, implementation, or handling of the Sweepstakes (including, without limitation, Hawaiian Airlines, Inc. (“Hawaiian Airlines”), any agents acting for, or on behalf of the above persons or entities, their respective parent companies, officers, directors, vendors, subsidiaries, franchisees, affiliates, licensees, service providers, prize suppliers, social media platforms, or any other person or entity associated with the Sweepstakes (collectively “Sweepstakes Entities”) are ineligible to enter this Sweepstakes. Immediate family members (i.e., a spouse, domestic partner, child, sibling, or parent) and/or any person, whether related or not, living in the same household of an individual affiliated with a Sweepstakes Entity are also ineligible to enter this Sweepstakes. If the potential winner is a Canadian resident, he/she will be required to correctly answer a mathematical skill-testing question before being declared the winner.

Sponsor: The Sponsor of this Sweepstakes is Outrigger Hotels Hawaii - 2375 Kuhio Avenue, Honolulu, HI 96815.

Sweepstakes Description: This Sweepstakes begins at 12:00:01 AM HST on May 9, 2022 and ends at 11:59:59 PM HST on May 22, 2022 (“Sweepstakes Period”). For all purposes of this Sweepstakes, the Website’s (defined below) computer is the official clock and all times refer to Hawaii Standard Time (“HST”).

This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram or Hawaiian Airlines. Entrants are providing information to Sponsor and not to Facebook, Instagram or Hawaiian Airlines Entrants’ social media accounts are further governed by the privacy policies of these platforms. For any questions, comments or complaints about this Sweepstakes please address them to the Sponsor of this Sweepstakes and not to Facebook, Instagram or Hawaiian Airlines.

How to Enter: You may enter the Sweepstakes by using the methods described below:

1. During the Sweepstakes Period, visit the Sweepstakes website located at www.outriggersweepstakes.com (“Website”) and complete the registration process by providing the following information (“Online Entry”): Your complete first and last name, e-mail address, phone number, zip code/postal code, Facebook user name, Instagram user name, opt-in to confirm and agree to these Official Rules and to receive future promotional offers from Sponsor, confirm that you are eighteen (18) years of age older and a resident of the U.S. or Canada (excluding Quebec), and confirm that you agree to the Sponsor’s Website’s Terms of Use and Privacy Policy (collectively, “Entry Information”).

After submitting an Online Entry, entrants will be prompted to complete the following actions in order to obtain voluntary and additional entries into the Sweepstakes:

1. Facebook: Gain up to four (4) additional bonus entries by following each of (i) Outrigger Resorts, (ii) Outrigger Kona Resort and Spa, (iii) Outrigger Reef Waikiki Beach Resort, and (iv) Hawaiian Airlines on Facebook by clicking on the “Follow us on Facebook” link for each property/company which will enable entrants to “Follow” each of these Outrigger Hotels and Resorts properties and Hawaiian Airlines on Facebook (each a “Facebook Bonus Entry”). If you are an existing Facebook follower, you will receive a Facebook Bonus Entry by clicking the “Follow us on Facebook” link. You will earn one (1) Facebook Bonus Entry for each property/company followed.
2. Instagram: Gain up to four (4) additional bonus entries by following each of (i) Outrigger Resorts, (ii) Outrigger Kona Resort and Spa, (iii) Outrigger Reef Waikiki Beach Resort, and (iv) Hawaiian Airlines on Instagram by clicking on the “Follow us on Instagram” link for each property/company which will enable entrants to “Follow” each of these Outrigger Hotels and Resorts properties and Hawaiian Airlines on Instagram (each an “Instagram Bonus Entry”). If you are an existing Instagram follower, you will receive an Instagram Bonus Entry by clicking the “Follow us on Instagram” link. You will earn one (1) Instagram Bonus Entry for each property/company followed
3. DISCOVERY: Gain five (5) additional bonus entries by entering the DISCOVERY program. (“DISCOVERY Bonus Entry”). The email address you join the Discovery program with must be the same email address you used to enter on the Website. Membership is free and may be obtained here: www.outrigger.com/discovery. If you are already a DISCOVERY program member and you have entered on the Website, you will automatically receive the Discovery Bonus Entry by submitting your membership number on the form.

All required Entry Information must be completed in full, be accurate, current, and valid. The Entry Information received must match the information of the entrant that completed the act of physically entering the Sweepstakes. Limit one (1) Online Entry, up to (4) Facebook Bonus Entries, (4) Instagram Bonus Entries, and five (5) DISCOVERY Bonus Entries (hereinafter collectively referred to as “Entry” or “Entries”) per person/e-mail address. Sweepstakes Entries in excess of the stated limits will be disqualified. Any attempted form of entry other than as described herein is void. Proof of submitting an Entry will not be deemed by Sponsor as proof of receipt or entry into the Sweepstakes. All Entries become the property of Sponsor and will not be acknowledged or returned. Entries must be received by 11:59:59 PM HST on May 22, 2022. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. Except where prohibited by law or Sponsor’s Privacy Policy (defined below), participation in the Sweepstakes and/or acceptance of a prize constitutes permission for Sponsor to use entrant’s first name, last name, city, state, likeness, image, biographical information, statement, and/or voice for purposes of advertising, promotion, and publicity purposes in any and all media now or hereafter known throughout the world in perpetuity without additional compensation, notification, permission, or approval. The Website may not be accessible from all mobile phones, handheld devices and/or tablets. If an entrant experiences any issues entering, he/she should access the Website from a desktop or laptop computer. If entrants use a web-enabled mobile device to participate, data rates may apply (entrants should contact their service provider for data rates/plans). Entrants should use care and not drive while entering the Sweepstakes.

Prize/Odds of Winning: There will be three (3) prizes awarded:

Grand Prize: A vacation package for the winner and one (1) guest to Kona, Hawaii and Honolulu, Hawaii (“Vacation Package”). Vacation Package will include: (a) 160,000 HawaiianMiles, which at the time of the commencement of this sweepstakes is sufficient to book two (2) roundtrip coach class air transportation for winner and guest from a Hawaiian Airlines U.S. gateway city on the U.S. Mainland to (i) Kona, Hawaii or (ii) Honolulu, Hawaii (if the prize winner is not a HawaiianMiles member, s/he must create a free and easily subscribed account at www.hawaiianairlines.com by clicking on "Join HawaiianMiles" in order to complete the application that is required and be awarded the HawaiianMiles prize); (b) a four (4) nights hotel accommodations (Suite, double occupancy; room and tax only) at the Outrigger Kona Resort and Spa; (c) a three (3) nights hotel accommodations (Resort View, double occupancy, room and tax only) at the Outrigger Reef Waikiki Beach Resort; (d) $200.00 (USD) gift certificate from Kona Brewery; (e) Dinner and show at the Feast and Fire Luau for two (2); (f) Unique swim experience with Manta Rays for two (2); (g) Curated DISCOVERY experience for two (2); (h) Round of golf and spa treatment for two (2), and (i) $200 in DISCOVERY Dollars to be used with this Vacation Package or for a future stay (One DISCOVERY Dollar = $1.00USD).  Winner and guest will be responsible for the cost of the interisland trip between Kona and Honolulu.

Second Prize: A hotel package for the winner and one (1) guest to Kona, Hawaii and Honolulu, Hawaii (“Hotel Package”). Hotel Package will include: (a) a two (2) nights hotel accommodations (Suite, double occupancy; room and tax only) at the Outrigger Kona Resort and Spa; (b) a two (2) nights hotel accommodations (Resort View, double occupancy, room and tax only) at the Outrigger Reef Waikiki Beach Resort; (c) $200.00 (USD) gift certificate from Kona Brewery; (d) Curated DISCOVERY experience for two (2), and (e) $100 in DISCOVERY Dollars to be used with this Hotel Package or for a future stay (One DISCOVERY DOLLAR = $1.00USD)

Third Prize: (a) a special Hawaii Island gift pack from the Outrigger Kona Resort and Spa and Outrigger Reef Waikiki Beach Resort; and (b) $200.00 (USD) gift certificate from Kona Brewery.

HawaiianMiles will be deposited directly into winner’s HawaiianMiles account. Potential winner must establish a free Hawaiian Airlines HawaiianMiles account if he or she does not already have such an account. HawaiianMiles accounts are free to open, and the account and use of the HawaiianMiles are subject to the program’s terms and conditions: HawaiianAirlines.com/legal/hawaiianmiles-terms-and-conditions. Miles will be deposited within approximately 8-10 weeks after winner confirmation and winner opening a HawaiianMiles account. Miles may expire pursuant to Hawaiian’s program terms and conditions.

Approximate retail value (“ARV”) of the grand prize: $13,000.00 (USD), 2^nd prize: 4,000.00 (USD), and 3^rd prize: $500.00 (USD). Odds of winning the prize depend on the total number of eligible Entries received during the entire Sweepstakes Period.

Prizes subject to hotel availability, holiday and black-out dates, and all other prize and travel restrictions. Once determined, no change, extension or substitution of dates is permitted, except by Sponsor in its sole discretion. Once travel has been confirmed, any cancellation or change fees or restructuring flight, hotel, or other prizes are the sole responsibility of the winner. Gift certificate/voucher subject to stated terms and conditions. Activities are subject to availability. Winner and his/her guest will be required to have/present at least one (1) major credit card or debit card in good standing or make a cash deposit upon check-in at the hotels. Winner and his/her guest must travel together on the same itinerary. Sponsor reserves the right to award the Vacation Package and Hotel Package “as is” and to structure travel route in its sole discretion. The winner and guest are solely responsible for providing/obtaining all necessary identification and travel documents including airline tickets, passports and visas. In order to comply with the REAL ID Act, adult travelers carrying driver’s licenses from a select number of U.S. states may be required to present a valid U.S. passport to travel on a domestic commercial flight in addition to international travel. Failure to provide such documents may result in trip cancellation upon airport check-in. All travelers must also pass any required medical testing and comply with any requirements, at any time, that may be required or recommended by any government agency, airline, or Sponsor, including without limitation, passing one or more COVID-19 antigen and screening tests, and testing negative for COVID-19 or having the COVID vaccine(s). Travelers may also be required to execute any assumption of risk and/or other documents relating to COVID-19 or he/she may not be permitted to travel. Items not specifically mentioned as being included as part of the prize are the sole responsibility of the winner and his/her guest including, but not limited to, taxes, tips, travel insurance, room service, laundry service, unspecified meals, entertainment, ground transportation, baggage fees, hotel incidentals, local and long distance telephone calls or other communications, mobile phone roaming fees, internet or wireless services, gratuities, personal items, government fees, applicable custom fees, and all other costs and expenses not otherwise mentioned herein. If the winner chooses to take the Vacation Package or Hotel Package and/or attend an activity without the allotted guest, the remaining elements of the prize shall constitute full satisfaction of Sponsor’s prize obligation to winner and no additional compensation will be awarded. If winner and/or guest fail to appear in a timely manner for a scheduled activity, as determined by Sponsor or Prize Provider, in their sole discretion, said scheduled activity may be forfeited and no additional compensation will be awarded. The Vacation Package and Hotel Package restrictions/conditions stated herein are not all-inclusive and may be subject to additional restrictions/conditions, which may be stated in the Affidavit/Release (described below) and or winner’s travel documents. No cash equivalent for prize (or prize element) will be available. Prize is not transferable, however, Sponsor may (in its sole discretion) choose to substitute the prize (or any prize element) for one of equal or greater value due to prize unavailability or for any other reason. Prize and prize documentation will be sent to an address only within the fifty (50) states of the U.S., the District of Columbia or Canada (excluding Quebec). All federal, state, local or other tax liabilities (including but not limited to U.S. income taxes) arising from participation in the Sweepstakes or award of the prize will be the sole responsibility of the winner. Winner will be issued an IRS Form 1099 from the Sponsor or Sponsor’s designee for the total ARV of the prize won (as stated herein) in the calendar year the prize was won. Any depiction of prize (or prize element) in Sweepstakes materials or otherwise, are for illustrative purposes only. Sweepstakes Entities are not responsible for delays in delivery of prize (or prize element). Final eligibility for the award of the prize is subject to eligibility verification in writing as set forth below.

Drawing and Notification of Winner: The potential winner will be randomly selected on or about May 30, 2022 in a drawing to be held from among all eligible Sweepstakes Entries received during the Sweepstakes. Potential winner will be notified by telephone and/or e-mail (at the telephone number and/or e-mail provided in his/her Entry) within two (2) business days after the drawing date. The potential winner will be required to return a completed, signed, and unmodified Sponsor-supplied official affidavit of eligibility, release of liability (“Liability Release”), and (except where prohibited) publicity release (“Publicity Release” and collectively, "Affidavit/Release"), provide a legible copy of his/her government-issued photo identification, and complete any other documentation required by Sponsor in its sole discretion, within two (2) days after receipt of such notification. By returning the completed Affidavit/Release, winner attests to the provisions stated therein including the accuracy of the information contained therein and compliance with these Official Rules. If the potential winner cannot be reached after a reasonable effort has been exerted, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize documents are returned as undeliverable, such potential winner will be disqualified and an alternate potential winner may be selected (in Sponsor’s sole discretion) from all remaining Sweepstakes Entries received.

General Conditions: This Sweepstakes is governed by these Official Rules and all applicable federal, state and local laws and regulations. The winner’s guest will be required to complete, sign and return a Liability Release, a Publicity Release, provide a legible copy of his/her government-issued photo identification, and complete any other documentation that Sponsor requires (“Guest Release”) within two (2) days after receipt by the potential winner. If the guest is a resident of a jurisdiction that deems him/her to be a minor, his/her parent or legal guardian will be required to sign the Guest Release on his/her behalf. If the guest is from a state that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must be the winner. Entrant unconditionally assigns and transfers to Sponsor all rights, title, interest, and claim, which he or she now has, or may in the future have to his/her Entry. Entrants grant Sponsor the non-exclusive, royalty-free, irrevocable rights to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, modify, and otherwise exploit the Entries and to incorporate them in other works in any and all markets and media, whether now known or hereafter developed, throughout the universe in perpetuity. Entrants warrant that they have the exclusive right to grant such rights to Sponsor, and that the Sponsor's reproduction, publishing, displaying, and/or other use of the Entry will not infringe on any rights of third parties, including, but not limited to, copyright, trademark, privacy, personal, proprietary, or publicity rights, anywhere in the world. Entrants agree that Sponsor shall have no obligation to copy, publish, display, or otherwise exploit the Entry. By entering this Sweepstakes, entrants agree to waive any right to claim any ambiguity or error in the Official Rules of the Sweepstakes, or the Sweepstakes itself, and agree to be bound by these Official Rules and by all decisions of the Sponsor, whose decisions are binding and final in all respects. By accepting the prize, winner attests to the authenticity of his/her winning Sweepstakes Entry. Unless provided otherwise by Sponsor’s privacy policy, located at http://www.outrigger.com/privacy-policy (“Privacy Policy”) and where permitted by law, participation and acceptance of the prize constitutes permission for Sponsor and Sweepstakes Entities to use winner’s first name, last initial, address (city and state/province), photo, likeness, video recording, biographical information, statement and voice for advertising/publicity purposes worldwide and in all forms of media (including posting on the Website), in perpetuity, without further notice to or compensation in connection with said Sweepstakes, and Sponsor has the right to modify, edit, adapt, electronically alter, use, assign and/or dispose of such Sweepstakes Entries however it sees fit and without any notice or compensation to entrant or any third parties. Any person attempting to defraud or tamper with the Sweepstakes will be subject to prosecution and is thereby ineligible. If, for any reason, the Sweepstakes is not capable of running as originally planned, Sponsor reserves the right to cancel, suspend, or modify the Sweepstakes or any portion(s) thereof and conduct the Sweepstakes drawing from among all salvageable eligible Sweepstakes Entries received as of the termination date, if any, in the sole discretion of Sponsor. Notice of such action by the Sponsor will be posted on the Website as well as any applicable social media platforms. In case of a dispute over the identity of the entrant who submitted the winning Sweepstakes Entry, the authorized account holder of the e-mail address associated with that Sweepstakes Entry will be deemed the entrant. Said owner must comply with these Official Rules, be the person who physically completed the act of entering, and, in Sponsor's sole discretion, may be required to provide proof of ownership of the e-mail account.

Disclaimers: Sweepstakes Entities are not responsible or liable for, and will deem ineligible, multiple Sweepstakes Entries in excess of the stated limit. Sweepstakes Entries that are entered by other than human means or mass Sweepstakes Entries (such as by an automated computer program or any non-human mechanism, entity, or device), or Sweepstakes Entries that are illegible, late, tampered with, forged, incomplete, misdirected, deleted, damaged, lost, misplaced, stolen, destroyed, dropped, inaccessible, corrupted, jumbled, or otherwise not in compliance with these Official Rules will be disqualified. By entering the Sweepstakes, entrants agree and acknowledge to be bound by all applicable federal, state, and local laws. Entrants waive any rights to claim ambiguity with these Official Rules. 

Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal or bodily injury or death) in connection with: participation in this Sweepstakes; human error; incorrect or inaccurate transcription of Entry Information; acceptance/possession, use/misuse, and/or defects of the prize (or prize element) awarded herein; typographical errors in Sweepstakes promotional materials; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or internet service provider utilized in this Sweepstakes; interruption or inability to access the Sweepstakes, the Website (or Sponsor’s inability to access content at the Website), or any website or online service via the internet due to hardware or software compatibility problems; wireless network dead zones or obstructions; any damage to entrant’s (or any third person’s) computer/mobile device and/or its contents related to or resulting from any part of this Sweepstakes or from entering or downloading materials/software in connection with the Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, defects and/or any other errors or malfunctions; including but not limited to fraudulent (including unauthorized) gift certificate/voucher uses made with lost, stolen, misplaced, or misappropriated gift certificates/vouchers, incomplete (including inaccurate) gift certificate/voucher database information and canceled gift certificate/voucher uses; cancellations, delays and/or policies that may affect travel for a winner(s)/guest(s), or any change by the air carrier(s), lodging facilities, or other company or any other persons providing any components of the prize for the winner(s) and his/her guest(s) due to reasons beyond Sponsor’s and/or Sweepstakes Entities’ control even if caused by the negligence of one of the Sweepstakes Entities. Entrants hereby acknowledge that said Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to prize, including express warranties provided exclusively by a Prize Provider that are sent along with the prize. Sweepstakes Entities shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused by or have contributed to (1) any wrongful, negligent or unauthorized act or omission on the part of a Sweepstakes Entity or Prize Provider (if applicable) or any of its agents, servants, employees, or independent contractors, (2) any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of Sponsor or Sweepstakes Entities, or (3) any other cause, condition or event whatsoever beyond the control of Sponsor, Sweepstakes Entities, or their respective parents, subsidiaries and affiliated companies. By entering, entrants and winner further agree to release, discharge, indemnify and hold harmless the Sweepstakes Entities from and against any and all claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting or arising, in whole or in part, directly or indirectly, from participation in the Sweepstakes or any Sweepstakes-related activity including travel to and from departure airport and destination location. The failure of Sponsor or Sweepstakes Entities to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsor or Sweepstakes Entities (excepting compliance with applicable codes and regulations), or other force majeure event will not be considered a breach of these Official Rules.

DISPUTES: THIS SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF HAWAII, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN THE CITY & COUNTY OF HONOLULU AND THE STATE OF HAWAII. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY DISPUTE PREVENTION AND RESOLUTION INC., IN ACCORDANCE WITH ITS ARBITRATION RULES, PROCEDURES & PROTOCOLS. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE CITY AND COUNTY OF HONOLULU AND EACH ENTRANT, BY THEIR PARTICIPATION IN THE SWEEPSTAKES, AGREE TO SUBMIT ALL SUCH DISPUTES TO SUCH FORUM. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES (EXCEPT WHERE PROVIDED BY LAW) OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF, AND WITHOUT RESORT TO ANY FORM OF CLASS ACTION.
