Sweepstakes Official Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING. YOUR CHANCES OF WINNING WITHOUT MAKING A PURCHASE ARE THE SAME AS THE CHANCES OF SOMEONE WHO PURCHASES SOMETHING. IT IS ILLEGAL TO GIVE ANY ADVANTAGE TO BUYERS IN A SWEEPSTAKES GIVEAWAY. VOID WHERE PROHIBITED.

1. Eligibility: This Sweepstakes (the “Sweepstakes”) is open only to those natural persons who sign up at the online sweepstakes page or through Facebook lead generation ads, who are at least 18 years of age or older at the time of entry and who are legal residents of the United States. Employees of Cygnus Home Service, LLC (“Sponsor”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws and regulations.

2. Agreement to Rules: By participating, you agree to be fully and unconditionally bound by these Rules and Sponsor’s Privacy Policy (together, the “Rules”), and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor, as final and binding as it relates to the content. 

3. Sweepstakes Period: Entries will be accepted online starting on or about July 9 2024 at 12:00 AM Central Time (“CT”) and ending July 31, 2024 at 11:59 PM CT (the “Sweepstakes Period”). All online entries must be received by July 31, 2024 at 11:59 PM CT; online entries received after the end of the Sweepstakes Period will be deemed ineligible to win.

4. How to Enter: During the Sweepstakes Period, any eligible person may enter to win the Sweepstakes through two (2) methods of entry (hereinafter, each an “Entry”):

1. Sponsor’s Online Form: By submitting an entry using the online form provided on this site https://app.viralsweep.com/sweeps/full/c8b3a6-172244?framed=1 or linked to from this site, including submission of all information requested.

2. Facebook Form: By completing an entry form on Facebook (which leads to https://app.viralsweep.com/sweeps/full/c8b3a6-172244?framed=1), including submission of all information requested.

There is a limit of one (1) Entry per person, for the entire Sweepstakes Period; entrants may not submit entries through multiple methods of entry. Any Entry must fulfill all sweepstakes requirements, as specified in these Rules and the online form or the Facebook form, as applicable, to be eligible to win a prize. Entries that are not complete or do not adhere to these Rules or other specifications may be disqualified at the sole discretion of Sponsor. You may enter only once, and you must fill in the information requested by your chosen method of entry. You may not enter more times than indicated by using multiple e-mail addresses, identities or devices in an attempt to circumvent the Rules. Multiple entrants are not permitted to share the same email address, or Facebook account, as applicable. Incomplete Entries, Entries generated by script, macro or other automated means, Entries that do not fully comply with these Rules, or Entries which subvert the entry process, in the sole discretion of Sponsor, will not be eligible to win. Proof of submission of post does not constitute proof of delivery or Entry during the Sweepstakes Period. Entries received from any person, regardless of email address used, in excess of the above stated limitation, will be void. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Sponsor. All Entries must be received during the Sweepstakes Period to be eligible. The computer clock of Sponsor is the official timekeeping device. Message and data rates may apply if web-enabled mobile device is used to enter. All Entries become the property of Sponsor and will not be returned, and Sponsor will not verify receipt of Entries. 5. Prizes: There will be five (5) grand prize winners randomly chosen from the pool of entrants. The approximate retail value of each grand prize package is $500. Each of the five (5) grand prize packages includes: ten (10) redemptions (discount codes) valued at $50 each. The total approximate retail value of all prizes offered in this Sweepstakes is $2,500. You are not guaranteed to win a prize and your chance of winning is dependent on the total number of eligible entries received. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by Sponsor. No cash or other prize substitution permitted except at Sponsor’s discretion. All prizes are nontransferable. Any and all prize related expenses, including, without limitation, any and all federal, state, and local taxes shall be the sole responsibility of each winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by any winner is permitted. Acceptance of prize constitutes permission for Sponsor to use such winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

ALL PRIZES ARE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE), AND THE RELEASED PARTIES (AS DEFINED BELOW) DO NOT MAKE ANY REPRESENTATIONS, WARRANTIES OR GUARANTEES, EXPRESS OR IMPLIED, RELATING TO THIS SWEEPSTAKES OR THE PRIZES.

6. Odds: The odds of winning depend on the number of eligible entries received, as represented by the total number of eligible entries submitted via the online form and the Facebook entry form, which comply with these Rules at the time the Sweepstakes Period ends.

7. Winner Selection and Notification: Winners of the Sweepstakes will be selected in a random drawing under the supervision of Sponsor on or around July 31, 2024. Winners will be notified via e-mail to the e-mail address included with each winner’s entry with additional instructions to claim such winner’s prize and within five (5) days following the end of the Sweepstakes Period. Sponsor shall have no liability for any winner’s failure to receive notices due to any winners’ spam, junk e-mail or other security settings or for any winners’ provision of incorrect or otherwise non-functioning contact information. If any selected winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time the award notification was sent, opts-out of marketing communications or fails to timely return a completed and executed declaration and release as required, such winner’s prize may be forfeited and an alternate winner selected. The receipt by any winner of any prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS A WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES OF SUCH PERSON AS WINNER WILL BE IMMEDIATELY TERMINATED.

8. Rights Granted by You: By entering this Sweepstakes, you understand that Sponsor, anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns will have the right, but not the obligation, where permitted by law, without any further notice, review or consent, to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation. Sponsor is not obligated to use any of the above-mentioned information or materials, but Sponsor may use and edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.

9. Terms: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor may select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor to cancel, terminate, modify or suspend the Sweepstakes. Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or who violates these Rules.  Sponsor does not assume responsibility for any non-authorized intervention with the conduct of the Sweepstakes.

Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to: multiple entries from the same entrant from different IP addresses; multiple entries from the same computer in excess of that allowed by these Rules; or the use of bots, macros or scripts or other technical means for entering. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

By entering the Sweepstakes, you agree to receive email marketing and promotional materials periodically from Sponsor, and agree to be bound by our Terms and Conditions, including arbitration, and our Privacy Policy. You can opt-out of receiving these communications at any time by clicking the unsubscribe link in the emails.

10. Limitation of Liability: By entering you agree to release and hold harmless Sponsor, Facebook, Meta and their respective subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “Released Parties”) from any and all liability or legal claims, charges, proceedings, suits, actions (including, but not limited to, tort actions, product liability actions, wrongful death actions, warranty actions, breach of contract actions, privacy and defamation actions, misappropriation of likeness actions, identity theft, loss of consortium claims), expenses, attorneys’ fees, illness, injury, death, loss, or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; (v) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; (vi) injury or damage to persons or property from participation in the Sweepstakes or receipt or use of any prize; or (vii) any restriction or impedance on your ability to participate in the Sweepstakes.

11. Disputes: THIS SWEEPSTAKES IS GOVERNED BY THE FEDERAL LAWS OF THE UNITED STATES AND THE LAWS OF THE STATE OF MINNESOTA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Minnesota having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
