By entering into this Sweepstakes, I accept the terms and conditions and set forth in these Official Rules. I confirm I am at least 18 years old and have reached the age of majority in my jurisdiction of residence at the time of opt-in (18 years in most U.S. states, 19 in Alabama, Nebraska, and British Columbia, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut, and Yukon, and 21 in Mississippi). By entering the sweepstakes, I agree to sign up to receive newsletters and special offers from Balsam Brands Canada Ltd., Balsam Brands Inc., Matt’s Flights, Couch.com, Tempaper, Kasadrinos, Gathrd(collectively, the “Associated Companies”). The Associated Companies have provided prizes to the Sweepstakes but only Balsam Brands Canada Ltd. is sponsoring the sweepstakes and responsible for operating the Sweepstakes. No Purchase Necessary. A Purchase Will Not Increase Your Chances of Winning. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

Eligibility: Sweepstakes (the "Sweepstakes") is open only to those who sign up at the online sweepstakes page and who are at least 18+ years old at the time of entry. This Sweepstakes is open to residents of the United States and Canada (including Quebec) who have reached the age of majority in their respective province or state of residence at the time of entry (18 years in most U.S. states, 19 in Alabama, Nebraska, and British Columbia, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut, and Yukon, and 21 in Mississippi). Employees of Balsam Brands Canada Ltd. their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes.

Sponsor: The Sweepstakes is sponsored by Balsam Brands Canada Ltd. (the "Sponsor") at 7700 Hurontario St., Unit 503, #2218, Brampton, ON L6Y 4M3.

Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of the Sponsor, as final and binding as it relates to the content. The Sweepstakes is subject to all applicable federal, state and local laws.

Entry Period: Entries will be accepted online starting on or about 11/16/24 at 12:00 AM and ending 12/15/24 at 11:59 PM. All online entries must be received by 12/15/24 at 11:59 PM. All times are (GMT-05:00) Eastern Time (US & Canada).

How to Enter: The Sweepstakes must be entered by submitting an entry using the online form provided on  https://swee.ps/KZKnYLZvs (the “Sweepstakes Site”). The entry must fulfill all sweepstakes requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsor. You may enter only once (not including “Bonus Entries,” as described below) and you must fill in the information requested. You may not enter more times than indicated by using multiple e-mail addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of the Sponsor.

By entering the Sweepstakes you agree to receive email newsletters periodically from Balsam Brands Canada Ltd., Balsam Brands Inc., Matt’s Flights, Couch.com, Tempaper, Kasadrinos, Gathrd and agreeing that your registration and any other information collected in connection with the Sweepstakes may be used by the following partners:

You can opt-out of receiving any of this communication at any time by clicking the unsubscribe link in the newsletter of any of these companies. Opt-out requests will only apply to marketing communications and will not affect transactional communications related to this Sweepstakes.

Bonus Entries: Each person who submits an entry to the Sweepstakes will have the opportunity to obtain additional entries by performing listed social actions. For each action performed, the user will receive the allotted amount of bonus entries listed. Entrant can receive unlimited additional entries by completing  bonus entry actions.  

Drawing: After the Entry Period, on or about 12/17/2024 (approximate date of winner selection), Sponsor will select 1 potential winner in a random drawing of all entries received. The odds of being selected depend on the number of entries received. 

Winner Selection and Notification: Winners of the Sweepstakes will be selected in a random drawing under the supervision of the Sponsor. Winners will be notified via e-mail to the e-mail address used to enter the Sweepstakes within five (5) days following the winner selection. The Sponsor shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 10 calendar days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected. Only three (3) alternate potential winners may be contacted. The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by you: By entering this content you understand that the Sponsor, anyone acting on behalf of the Sponsor, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

Prize(s): One (1) grand prize will be awarded and one (1) winner will be chosen. The approximate retail value of the Grand Prize is $3,826 USD or $5,385 CAD. The Grand Prize will include:

You are not guaranteed to win a prize and your chance of winning is dependent on the total number of eligible entries received. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. The prize is nontransferable. Any and all prize related expenses, including without limitation any and all federal, state, and local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for the Associated Companies to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

General Conditions: The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes if a virus, bug, unauthorized human intervention, fraud, technical issue, or any other cause beyond its control impairs the administration, security, fairness, or proper conduct of the Sweepstakes. In such a case, Host Company may, at its discretion, select recipients from all eligible entries received prior to or after the action taken to resolve the issue.

The Sponsor also reserves the right to disqualify any individual who tampers with or attempts to tamper with the entry process or operation of the Sweepstakes, including but not limited to actions such as submitting multiple entries from different IP addresses, exceeding entry limits from the same computer, or using bots, macros, scripts, or other automated means of entry. The Sponsor may also void any votes or entries it deems compromised and will maintain the integrity of the Sweepstakes by monitoring for any fraudulent or disruptive behavior. Any attempt by an entrant to deliberately damage any website or undermine the Sweepstakes’ legitimate operation may constitute a violation of criminal and civil laws. The Sponsor reserves the right to seek damages from any person making such attempts to the fullest extent permitted by law.

In the event that the Sweepstakes is impaired in any way, the Sponsor may, in its sole discretion: (a) suspend the Sweepstakes to address the issue and resume it in a way that best conforms to these Official Rules; or (b) award prizes at random from among eligible entries received up to the time of the impairment. The Sponsor’s failure to enforce any term of these Official Rules does not constitute a waiver of that provision. Proof of sending any communication to the Sponsor shall not be deemed proof of receipt by the Sponsor.

In the event of a dispute regarding an online entry, the authorized account holder of the email address used at entry will be considered the participant. The “authorized account holder” is defined as the natural person assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

Limitation of Liability: By entering you agree to release and hold harmless the Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

Use of Entrant Information: By entering the Sweepstakes, you acknowledge and agree that the Associated Companies will use Entrant’s information, including, without limitation, your email address, phone number, mailing address, or any other contact information provided for general solicitation, marketing, or other business or promotional activities in connection with the services and products provided by Sponsor or the participating companies. You may at any time revoke the use of such information by providing written notice to Sponsor and each other participating company using the following addresses or by responding to a marketing email using the unsubscribe link provided in the email. Please note that your opt-out preference will apply to marketing communication and may not apply to transactional communication including those associated with your entry. 

Disputes: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF United States AND California, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased. For Canadian residents, this Sweepstakes is governed by Canadian law. Any disputes or claims arising from participation in this Sweepstakes shall be resolved individually without resort to any form of class action and will be adjudicated in the courts of the entrant’s province of residence.

Third Party Platforms: If this Sweepstakes is hosted, administered, or operated on a third party platform, including without limitation a social media platform (e.g. Facebook or Twitter) (“Third Party Platform”), then by participating in this Sweepstakes, entrants hereby release and agree to comply with all rules and policies set forth by such Third Party Platform and to hold harmless such Third Party Platform from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prizes or participation in any prize related activities. Unless otherwise stated to the contrary in these Official Rules, this Sweepstakes is not sponsored, endorsed or administered by, or associated with, any Third Party Platform. 

Results: To request a winners list, send a self addressed, stamped envelope to Balsam Brands Canada Ltd. at 7700 Hurontario St., Unit 503, #2218, Brampton, ON L6Y 4M3.. Requests must be received within four (4) weeks of the end of the Entry Period.
