RULES AND REGULATIONS

NO PURCHASE NECESSARY TO ENTER OR WIN. THIS SWEEPSTAKES IS BEING OFFERED IN THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA (“D.C.”). DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND NOT LOCATED IN THE UNITED STATES OR D.C. AT THE TIME OF ENTRY. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. SUBJECT TO ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS.

• Eligibility. This FarmPost, Inc. John Deere Tractor Sweepstakes (“Sweepstakes”) is open only to legal residents of the fifty (50) United States and D.C. Entrants must have reached age eighteen (18) at the time of commencement of the Sweepstakes Period (as that term is defined below). Employees, officers, directors, representatives, and agents of FarmPost, Inc. (the “Sponsor”), its affiliated companies, subsidiaries, suppliers, and advertising and promotional agencies who in the sole discretion of the Sponsor are determined to be so closely related to the Sponsor’s operations such that participation would result in the appearance of impropriety and the immediate family of each are not eligible to enter or win. Immediate family is defined as: mother, father, brother, sister, spouse, children, son-in-law, daughter-in-law, brother-in-law, sister-in-law, mother-in-law, father-in-law, step-parents, step-children, grandmother, grandfather, grandchildren, and any relative or other person residing in an excluded employee’s or individual’s place of residence (those persons whether related or not who live in the same residence for at least three (3) months during the twelve (12) month period preceding the start date of the Sweepstakes). VOID IN PUERTO RICO AND WHERE PROHIBITED OR RESTRICTED BY LAW. Entrants must comply with all rules and regulations herein (“Rules and Regulations”).

• Agreement to Rules. By participating, the entrant (“You”) agrees to be fully and unconditionally bound by these Rules and Regulations, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of the Sponsor as final and binding as it relates to the content of this Sweepstakes.

• Sweepstakes Period. Entries will be accepted starting on May 1, 2023, and ending on September 1, 2023 (the “Sweepstakes Period”).

• How to Enter. You may enter this Sweepstakes by taking any of the following actions (“Methods of Entry”):

• Signing up for the Sweepstakes on the Sponsor’s Facebook or YouTube page/channel.

• Signing up as a user on the Farmpost App.
• 
  
• Engaging in activity on the Farmpost App ((a) post a job, (b) apply for a job, (c) post a custom farming ad, (d) sign up for a 14-day free trial, (e) track hours, and/or (f) post equipment for sale).
• 
  
• Becoming a subscribed customer on the Farmpost App.

Each of the above Methods of Entry shall constitute a separate number of entries into the Sweepstakes. Signing up on the Sponsor’s Facebook or YouTube page/channel will constitute one (1) entry into the Sweepstakes. Signing up as a user on the Farmpost App will constitute ten (10) entries into the Sweepstakes. Any engagement action on the Farmpost App will constitute one hundred (100) entries (provided taking multiple engagement actions on the Farmpost App will not result in any additional/duplicate entries). Becoming a subscribed customer on the Farmpost App will constitute five hundred (500) entries.

If You use fraudulent methods such as creating multiple social media accounts to enter the Sweepstakes or otherwise attempt to circumvent these Rules and Regulations, your entries may be removed from eligibility at the sole discretion of the Sponsor.

By entering, You agree to accept, abide by, and acknowledge compliance with these Rules and Regulations, including but not limited to all eligibility requirements and the decisions of the Sponsor, which Rules and Regulations and decisions are final and binding on all entrants. If You do not fully comply with these Rules and Regulations, You will be disqualified from the Sweepstakes.

• Winner Selection and Notification. One entrant will be randomly drawn on September 1, 2023 (the “Winner”), at the Sponsor’s headquarters located at 1211 4^th Avenue, DeWitt, Iowa 52742. The drawing time is approximate, and the Sponsor reserves the right to delay the drawing time if it deems a delay to be necessary for any reason. The Winner shall be notified within seven (7) days following the random drawing by email and/or telephone. The Sponsor shall have no liability for the Winner’s failure to receive notices due to spam, junk email, or other security settings or for the Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner cannot be contacted, is ineligible, or fails to claim the Prize (as that term is defined below) within thirty (30) days from the time award notification was sent, the Prize shall be forfeited and an alternate Winner selected by a subsequent random drawing. The Sponsor is not responsible for late, lost, stolen, delayed, illegible, incomplete, destroyed, misdirected, or unsuccessful efforts to notify the Winner. After the Winner has claimed the Prize, the Sponsor shall announce the Winner on its website and social media accounts.

• Prize. The prize in this Sweepstakes is a restored 1968 John Deere 4020 tractor (the “Prize”). There will be one (1) Prize awarded in this Sweepstakes to the Winner. Entrants not selected as the Winner will not be awarded the Prize. No cash or other Prize substitution shall be permitted except at the Sponsor’s sole discretion. The retail value of the Prize is Twenty-Five Thousand Dollars ($25,000.00). The Prize is nontransferable.

• Prize Redemption. The Winner shall be notified within seven (7) days following the random drawing. A valid response to such notification must include the Winner’s email address, mailing address, address of residence, phone number, and age. Following receipt of a valid response, the Winner will be sent a standard Declaration and Release form by mail. If required by the Sponsor, the Winner shall complete and sign (i) a Declaration and Release form, confirming compliance with these Rules and Regulations and releasing all employees, officers, directors, representatives, and agents of the Sponsor, its affiliated companies, subsidiaries, suppliers, and advertising and promotional agencies from all liability; (ii) an Affidavit of Eligibility; (iii) an IRS W-9 form; (iv) where lawful, a Publicity Release (granting the use of the Winner’s name, city/sate, likeness, or photograph by the Sponsor for advertising and publicity purposes, without further compensation); and (v) such other instruments, certificates, and documents required by the Sponsor. If the Winner is located within three hundred (300) miles of the Sponsor’s headquarters (stated above in Section 5), the Sponsor will cover and pay for any and all shipping and related costs to deliver the Prize to the Winner. If the Winner is located more than three hundred (300) miles from the Sponsor’s headquarters, the Winner will be solely responsible for any and all shipping and related costs for delivery of the Prize. If the Winner is responsible for shipping of the Prize the Winner must pick up/ship the Prize within thirty (30) days from the time award notification was sent, or the Prize shall be forfeited and an alternate Winner selected by a subsequent random drawing.

• Odds of Winning. The odds of winning the Sweepstakes depend on the number of eligible entries received.

• Taxes. The value of the Prize may be taxable as income. All taxes, fees, duties, and surcharges on the Prize and/or the redemption thereof are the sole responsibility of the Winner. The Winner must agree to provide required personal information to the Sponsor in order to generate tax documents, if required. The Winner agrees to indemnify and hold harmless all employees, officers, directors, representatives, and agents of the Sponsor, its affiliated companies, subsidiaries, suppliers, and advertising and promotional agencies from and against any liability for all taxes, fees, duties, and surcharges on the Prize. The retail value for the Prize is as of the date these Rules and Regulations were finalized and may fluctuate. Any difference between the stated retail value of the Prize and the actual retail value at the time the Prize is awarded will not be awarded.

• Not a Lottery. This Sweepstakes is not to be construed as a lottery or raffle as no consideration is required to enter this Sweepstakes. Entering into this Sweepstakes by becoming a customer on the Farmpost App pursuant to Section 4(g) of these Rules and Regulations is not a required Method of Entry into this Sweepstakes, and is to be construed only as one Method of Entry for this Sweepstakes.

• This Sweepstakes is governed by the laws of the State of Iowa without respect to conflict of laws principles.

• THE PRIZE SHALL BE PROVIDED TO THE WINNER IN “AS IS, WHERE IS” CONDITION. THE SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BY ACCEPTING THE PRIZE, THE WINNER AGREES THAT ALL EMPLOYEES, OFFICERS, DIRECTORS, REPRESENTATIVES, AND AGENTS OF THE SPONSOR, ITS AFFILIATED COMPANIES, SUBSIDIARIES, SUPPLIERS, AND ADVERTISING AND PROMOTIONAL AGENCIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY THE WINNER FOR ANY LIABILITY, ANY INJURY, LOSS, OR DAMAGES OF ANY KIND, TO THE WINNER OR OTHER PERSONS, INCLUDING WITHOUT LIMITATION INJURIES, LOSS, OR DAMAGES ARISING OUT OF OR RELATING TO DEATH, INJURIES, DAMAGES, OR LOSSES TO PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY, OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES OR PARTICIPATION IN ANY SWEEPSTAKES OR PRIZE-RELATED ACTIVITY. Any and all disputes, claims, and actions arising out of or connected with this Sweepstakes, or the Prize, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event shall not include attorneys’ fees, or punitive, special, or consequential damages.

• The invalidity or unenforceability of any provision of these Rules and Regulations shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules and Regulations shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
