MVMT x BARSTOOL VIP SWEEPSTAKES

Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. 

OPEN TO ELIGIBLE LEGAL RESIDENTS OF THE 48 CONTIGUOUS CONTINENTAL UNITED STATES AND DISTRICT OF COLUMBIA WHO, AS OF THE TIME OF ENTRY, ARE AT LEAST 21 YEARS OLD.

VOID IN HAWAII, ALASKA, PUERTO RICO AND ALL JURISDICTIONS OTHER THAN THOSE STATED ABOVE AND WHERE PROHIBITED OR RESTRICTED BY LAW.

SPONSOR. MVMT Watches, Inc., 5454 Beethoven Street, Suite 200, Los Angeles, California 90066 (“Sponsor”).

ELIGIBILITY. 

The MVMT x BARSTOOL VIP Sweepstakes (the “Sweepstakes”) is open only to legal residents of the forty-eight (48) contiguous continental United States and the District of Columbia who are twenty-one (21) years of age or older at the time of entry. Void where prohibited or restricted by law.  Officers, directors, representatives, agents, and employees of Sponsor and its corporate parents, subsidiaries, affiliates, advertising and promotion agencies, and of any other entity involved in the development or administration of this Sweepstakes (Sponsor, collectively with the foregoing entities and individuals, the “Sweepstakes Parties”)  and members of their immediate families (i.e. spouses, parents, children, siblings, and “steps”) and/or those living in the same household of each, whether or not related, are not eligible to enter or win the Sweepstakes. All applicable federal, state, and local laws and regulations apply.

By participating in the Sweepstakes, entrants agree to be bound by these official rules (“Official Rules”) and by the decisions of Sponsor in all matters relating to the Sweepstakes.

ENTRY PERIOD

The entry period for the Sweepstakes starts on January 4, 2018 at 12:00:00 a.m. PT and ends on January 23, 2018 at 11:59:59 p.m. PT (“Entry Period”). Sponsor’s computer is the official time keeping device for the Sweepstakes.

HOW TO ENTER.

NO PURCHASE NECESSARY AND NO ENTRY FEE, PAYMENT OR PROOF OF PURCHASE IS NECESSARY TO PARTICIPATE.

You may use any of three (3) methods to enter the Sweepstakes (or a combination of these methods). The first method of entry requires you to complete an online entry form during the Entry Period.  After completing an online entry form, you may earn additional entries by taking certain actions online as described below in the section titled “Online Entry Methods”. The second method of entry automatically enters you into the Sweepstakes when you make a qualifying purchase of a MVMT watch at www.mvmt.com during the Entry Period.  The third method of entry requires submission of a mail-in entry as explained below under the section titled “Mail-In Method of Entry.”  You may obtain a maximum of thirty (30) entries, regardless of the method of entry, or combination of entry methods, you use to participate in this Sweepstakes. 

Compliance with the entry requirements will be determined by Sponsor in its sole discretion.  Submissions that violate, as determined by the Sponsor, in its sole discretion, these entry requirements will be disqualified from the Sweepstakes.

Online entries must be submitted by 11:59:59 p.m. PT on January 23, 2018.  Mail-in entries must be postmarked January 23, 2018 and received by Sponsor by January 26, 2018. 

Any attempt by any person to obtain more than the maximum allowed number of entries by using multiple/different e-mail addresses, social media handles, or any other methods, will void that person’s entries and may result in disqualification from the Sweepstakes. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents (including, but not limited to, sweepstakes entry services) is prohibited and will void all entries by that entrant.

a.         Online Entry Methods

To enter the Sweepstakes, navigate to www.mvmt.com/barstoolvip (“Online Entry Website”) and complete and submit an online entry form that includes your first and last name, email address, and any other requested information.

After entering the Sweepstakes by completing and submitting the online entry form, you may earn additional entries each time you complete one of the following actions. Except for the action listed in subsection 4.a.8 below, in order to earn an additional entry, each action must be completed through the Online Entry Website during the Entry Period. Each such action is referred to herein as an additional “method of entry”:

Sharing the Sweepstakes via e-mail, provided that you may not earn more than three (3) additional entries;

Retweeting a tweet posted by @barstoolsports on Twitter using the following hashtag: #BARSTOOLVIP

b.         Automatic Entry with Qualifying Online Purchase

To automatically receive ten (10) entries in the Sweepstakes, you can make a qualifying purchase of a MVMT watch through the MVMT website at www.mvmt.com using the code BARSTOOLVIP during the Entry Period.

c.         Mail-In Method of Entry

To participate in the Sweepstakes without entering online or making a purchase, legibly hand print your full name, complete address (including zip code), home telephone number, e-mail address, and an explanation in thirty (30) words or less, of why you want to win the Grand Prize, on a 3 ½” x 5” card and mail it, with proper postage affixed, to MVMT Watches, Inc., 5454 Beethoven Street, Suite 200, Los Angeles, California 90066 to the attention of “MVMT Sweepstakes Administrator”).

Limit of one (1) entry card per outer stamped envelope. You will receive ten (10) entries for each completed entry card received, subject to a maximum of thirty (30) entries per entrant.  The Sweepstakes Parties assume no responsibility for lost, late, incomplete, stolen, misdirected, illegible or postage-due entries or mail, all of which will be void. No mechanically reproduced entries permitted. All entries become the property of Sponsor and none will be acknowledged or returned.

ODDS OF WINNING.

Odds of winning depend on the number of eligible entries received.

WINNER SELECTION AND NOTIFICATION.

On or about January 27, 2018, one (1) potential winner will be randomly selected from among all eligible entries received. Sponsor will notify the potential winner on or about January 27, 2018 via the e-mail address registered on the Sweepstakes online entry form, listed in the mail-in entry or submitted as part of a qualifying purchase from www.mvmt.com, as applicable.

The potential winner is subject to verification of eligibility, including verification of age and residency. 

If a potential winner (i) is determined to be ineligible or otherwise disqualified by Sponsor or (ii) fails to respond to Sponsor’s first winner notification message within twenty-four (24) hours of notification or after two (2) attempts (whichever occurs first), the potential winner forfeits the prize in its entirety and, if time permits, a substitute potential winner will be selected based upon a random drawing from among all other eligible entries received for the Sweepstakes during the Entry Period.

As a condition of receiving a prize, the potential winner must sign and return any documents requested by Sponsor, including but not limited to, an affidavit of eligibility and release of liability within twenty-four (24) hours of accepting the prize.  Any person traveling as guest of the winner must also execute a liability and publicity release and any other documents Sponsor may require.  The winner will be issued an IRS Form 1099 in the amount of the actual retail value of the Grand Prize and must provide Sponsor with his/her valid Social Security Number or Taxpayer ID for tax reporting purposes.  Noncompliance with this requirement will result in disqualification of the potential winner and the forfeiture of all interest in a prize. 

The winner is solely responsible for all federal, state, local, or other applicable taxes associated with the acceptance and use of a prize. 

PRIZES.

A random drawing will be conducted in connection with the Sweepstakes, to award the following prize to one (1) winner:

Grand Prize: The winner will win a trip for the winner and one adult guest to Minneapolis, Minnesota, including roundtrip coach-class airfare for two (2) from the gateway airport in the continental United States closest to the winner’s home (Approximate Retail Value (“ARV”) $1,500), a two (2) night stay in a standard hotel room (one room, double occupancy) in Minneapolis (ARV $800), a food and drink stipend for the trip in the amount of $200 (ARV $200), transportation expenses for airport transfers up to $100 (ARV $100), an invitation for two (2) to a private Barstool VIP event on February 2, 2018 (ARV $0); and dinner with members of the MVMT team (ARV $100).  The total aggregate ARV of the Grand Prize is $2,700.  Actual value of the Grand Prize depends on departure city, travel dates, and market conditions at time of fulfillment. Any difference in value between the stated ARV and the actual value of the Grand Prize package will not be awarded.

The total aggregate ARV for all prizes for the Sweepstakes drawing is $2,700.

By accepting the Grand Prize, the winner agrees to Sponsor’s terms and conditions available at https://www.mvmtwatches.com/pages/terms-conditions.

The right to receive a prize cannot be transferred, assigned or redeemed for cash.  No prize substitution is permitted, except at the sole discretion of the Sponsor. If a prize or component of any prize cannot be awarded for any reason, Sponsor reserves the right in its sole discretion to substitute a prize or component with one of comparable or greater retail value.

In order to claim the prize, the potential winner must respond to Sponsor’s notification within twenty-four (24) hours by e-mailing Sponsor at ethan@mvmt.com, with any requested information, including but not limited to, wire transfer instructions and/or physical address where the stipend will be delivered.  All other components of each prize will be e-mailed to the e-mail address associated with winner’s entry. If any component of the prize is returned as undeliverable, the winner forfeits the prize in its entirety and Sponsor reserves the right to announce a substitute winner based upon a random drawing of the other eligible entries received for the Sweepstakes during the Entry Period.

All costs and expenses associated with prize acceptance and use not specifically provided herein are the sole responsibility of each winner.

The various elements of the Grand Prize will be as arranged by Sponsor in its sole discretion. Travel reservations will be made, such that the departure date is February 2, 2018 and the return date is February 4, 2018. Other restrictions may apply.  It is the responsibility of the winner and his or her travel companion to arrive at the airport on time for their departure and to obtain and possess all required travel documents. Sponsor has no responsibility for lost, stolen, misplaced or mutilated tickets and/or travel documents, baggage, flight delays, or any other occurrences beyond its control. No refund or compensation will be made in the event of the cancellation or delay of any flight.  Sponsor has no responsibility for a winner’s inability or failure to accept or utilize any part of the prize as described herein. The winner and his or her travel companion must travel on the same itinerary and must comply with all check-in requirements, including the presentation of a major credit card. Unused components of the Grand Prize have no redeemable cash value. All airline tickets issued in connection with the Grand Prize are not eligible for frequent flyer miles or upgrades and cannot be used in conjunction with any other promotion or offer. Travel must be round-trip. Travel is subject to the terms and conditions set forth in these Official Rules and those set forth by the travel prize suppliers, including but not limited to, the airline’s passenger ticket contract, and any other rules or restrictions as may be determined in the sole discretion of Sponsor.  FLIGHT TICKETS & HOTEL RESERVATIONS MUST BE ARRANGED WITH SPONSOR.  ALL TRAVEL RESERVATIONS ARE SUBJECT TO AVAILABILITY AND SPONSOR’S APPROVAL. NO NAME, DEPARTURE TIME, OR DATE CHANGES ARE PERMITTED ONCE ANY TRAVEL RESERVATIONS HAVE BEEN MADE. ANY CHANGES WILL SUBJECT THE PRIZE TO FORFEITURE. If the winner is unable to use the prize during the specified time period, the winner forfeits the prize in its entirety and a substitute winner may be selected at random from among all remaining eligible entries. In case of prize forfeiture, no further compensation is due to winner from Sponsor. Each winner is responsible for obtaining travel insurance (and all other forms of insurance) at his or her option and hereby acknowledges that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Each winner (and his or her travel companion) must travel on the itinerary and on the dates and/or times specified by Sponsor or the prize will be forfeited in its entirety.  

PUBLICITY.

Except where prohibited by law, the winner’s acceptance of a prize constitutes permission for Sponsor, Barstool Sports, Inc., and Sponsor’s designees, to use the winner’s name and likeness worldwide and in all forms of media, in perpetuity, for any promotional, advertising or publicity purpose without further compensation or approval.

RELEASE AND LIMITATIONS OF LIABILITY OF SWEEPSTAKES PARTIES.

Lost or Corrupted Entries: The Sweepstakes Parties assume no liability and are not responsible for, and you/entrant hereby forever waive any rights to any claim in connection with, lost, late, incomplete, corrupted, stolen, misdirected, undelivered or illegible or postage-due entries or mail, if applicable; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. The Sweepstakes Parties are not responsible for any incorrect or inaccurate information, whether caused by entry information submitted by entrants or tampering, hacking, or by any of the equipment or programming associated with or utilized in this Sweepstakes, and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Sweepstakes.

Sweepstakes Errors: The Sweepstakes Parties assume no liability and are not responsible for, and you/entrant hereby forever waive any rights to any claim in connection with, errors and/or ambiguity: (a) in the Sweepstakes; (b) in tracking entries to the Sweepstakes; (c) in any related advertising or promotions of this Sweepstakes; and/or (d) in these Official Rules. In the event of any ambiguity or error(s) in these Official Rules, Sponsor reserves the right to modify these Official Rules for clarification purposes or to correct any such ambiguity or error(s).  If due to an error or for any other reason, more legitimate prize claims are received than the number of prizes stated in these Official Rules, Sponsor reserves the right to award only the stated number of prizes in a random drawing from among all verified and legitimate prize claims received.  In no event will more than the stated number of prizes be awarded.

Disclaimer of Warranties. SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR YOUR PARTICIPATION IN THE SWEEPSTAKES. 

Release. BY PARTICIPATING IN THE SWEEPSTAKES,  EACH ENTRANT  AGREES TO RELEASE AND HOLD, HARMLESS THE SWEEPSTAKES PARTIES FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND ARISING IN CONNECTION WITH THE SWEEPSTAKES OR THE ACCEPTANCE, POSSESSION, OR USE OF ANY PRIZE, OR ANY TRAVEL OR OTHER ACTIVITY RELATING TO THE SWEEPSTAKES, INCLUDING WITHOUT LIMITATION, CLAIMS FOR PERSONAL INJURY, DEATH, AND PROPERTY DAMAGE, AND CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, OR INVASION OF PRIVACY.

Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SWEEPSTAKES PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR/ENTRANT’S ACCESS TO AND USE OF THE SWEEPSTAKES OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE SWEEPSTAKES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

SPONSOR’S RESERVATION OF RIGHTS.

If the Sweepstakes is not capable of running as planned for any reason, including without limitation, due to a force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process or otherwise acts in violation of these Official Rules, and to cancel, modify, or terminate the Sweepstakes. In the event of cancellation, Sponsor reserves the right to randomly draw a winner from all eligible, non-suspect entries received prior to cancellation.

GOVERNING LAW.

THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF CALIFORNIA, WITHOUT REGARD TO ITS CONFLICTS OF LAW PRINCIPLES, AND THE FORUM AND VENUE FOR ANY DISPUTE RELATING TO THE SWEEPSTAKES SHALL BE IN A FEDERAL OR STATE COURT OF COMPETENT JURISDICTION IN LOS ANGELES, CALIFORNIA.

PRIVACY.

Any personally identifiable information collected during an entrant’s participation in the Sweepstakes may be used by Sponsor and its designees (i) for the administration and fulfillment of the Sweepstakes, (ii) as described in these Official Rules, and (iii) for any purpose in accordance with Sponsor’s privacy policy available at https://www.mvmtwatches.com/pages/privacy-policy.  To unsubscribe from Sponsor’s commercial e-mail list, use the unsubscribe link in any commercial e-mail message you receive.

NAME OF WINNER.

For the name of the winner, send an email to ethan@mvmt.com. Requests must be received no later than sixty (60) days after the end of the Entry Period.

NO WAIVER/SEVERABILITY.

Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.
