Sweepstakes begins at 12:00:01 a.m. Eastern Time (“ET”) on December 1, 2024 and ends at 11:59:59 p.m. ET on November 30, 2025.

2. ELIGIBILITY: The Banter by Piercing Pagoda Rate and Review 2024-2025 Sweepstakes (the “Sweepstakes”) of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older as of the Promotion start date (the “Entrants”). The Sweepstakes is subject to all applicable federal, state, and local laws and regulations of the fifty (50) United States and the District of Columbia and is subject to change without notice in order to comply with them. This Promotion is void in Puerto Rico, all United States territories and possessions, and where prohibited or restricted by law. Employees, officers, directors and representatives of the Sweepstakes Entities, advertising and promotion agencies, or any entities engaged in the development, distribution, implementation or administration of the Sweepstakes (including third party fulfillment agencies) (collectively, the “Sweepstakes Entities”), their respective parent companies, employees, officers, directors, subsidiaries, affiliates, distributors, sales representatives and advertising and promotional agencies, and the officers, directors, agents, and employees of each of the foregoing, and members of their immediate families (spouses, biological and adoptive step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) or members of their households (whether related or not) of any of the above are NOT eligible to participate in this Sweepstakes. Non-eligibility or non-compliance with any of these Official Rules will result in disqualification. Sponsor and/or Administrators reserve the right to verify eligibility at any time.
   
   If you are entering the Promotion from a mobile device, you may be required to turn on location services on your mobile device. Message and data rates may apply. All charges are billed by and payable to your mobile service provider. Sponsor does not charge for receiving text messages.
   
   
3.  AGREEMENT TO OFFICIAL RULES: Participation in the Sweepstakes constitutes Entrants’ full and unconditional agreement and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a Prize (as defined below) is contingent upon fulfilling all requirements set forth herein. These Official Rules are also available on https://www.banter.com/sweepstakes-rules (the “Rules Website”).
   
   
4. ENTRY PERIODS; HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. The Sweepstakes begins at 12:00:01 a.m. Eastern Time (“ET”) on December 1, 2024 and ends at 11:59:59 p.m. ET on November 30, 2025 (“Sweepstakes Period”). The Sweepstakes Period will be divided into twelve (12) entry periods (each an “Entry Period” and collectively the “Entry Periods”) detailed below. All Entries must be received by the end time and date of each respective Entry Period to be valid and eligible for the corresponding drawing and Prize.

   The Sponsor’s database computer is the official time-keeping device for the Sweepstakes.

   During the Sweepstakes Period, Entrants can enter the Sweepstakes by completing an online registration at https://app.viralsweep.com/sweeps/full/5263f1-147134?framed=1 (the “Review Website”). The registration form will require Entrants to provide all requested information, including the Entrant’s name, address, a product review, and answering “Yes” to the Sweepstakes opt-in question. The product review must be posted in accordance with the Banter Terms of Use and must be written in English. By completing the Sweepstakes registration form, an Entrant will receive one (1) Sweepstakes entry (the “Review Entry”).
   
   NOTE: Your review should be your honest feedback. There is no requirement that the rating or review be a positive endorsement for a product of Sponsor in order to earn an Entry into the Sweepstakes.
   
   Bonus Method of Entry: When following the instructions to register and submit a Review Entry at https://app.viralsweep.com/sweeps/full/5263f1-147134?framed=1, an Entrant may obtain one (1) bonus entry by attaching a photo or video featuring the product being reviewed (a “Bonus Entry”) prior to officially submitting the Review Entry.
   
   Alternative Method of Entry: Entrants can also enter the Sweepstakes by visiting the online entry form (“Alternative Entry”), at https://app.viralsweep.com/sweeps/full/a38363-147135?framed=1 (the “Alternative Method Website”, and together with the Rules Website and Review Website the “Website”), and entering their full name, email address, phone number, mailing address, and date of birth (an “Alternative Entry” and together with a Review Entry or Entries and a Bonus Entry or Entries, the “Entries”). Each Alternative Entry received with be worth two (2) Sweepstakes entries.
   
   The Entry for either method of entry may not contain obscene, profane, lewd, defamatory or inappropriate text and may not include reference to nudity, acts of violence, acts that appear to cause injury or harm, or acts that are illegal or dangerous, as determined in Sponsor’s sole discretion. Entries must be in keeping with Sponsor’s image, or they will be disqualified. Inappropriate comments in the Entry may result in the Entry being disqualified at the sole discretion of Sponsor. Entries should not contain brand names (other than Banter by Piercing Pagoda or the product being reviewed) or other personal or proprietary materials of any entity or person, whether living or deceased.
   
   There is a limit of either (a) one (1) Review Entry and one (1) Bonus Entry or (b) one (1) Alternative Entry per eligible person, per Entry Period, for a total of up to two (2) Entries. For purposes of clarity, an Entrant that submits a Review Entry may not also submit an Alternative Entry during the same Entry Period, and an Entrant that submits an Alternative Entry may not submit a Review Entry or Bonus Entry during the same Entry Period. If more than two (2) Entries by the same entrant are received in the same Entry Period, only the first two (2) Entries will be accepted and additional Entries will be disqualified. Multiple entrants are not permitted to share the same email address. Any attempt by you to obtain more than two (2) Entries per Entry Period by using multiple/different email addresses, identities, registrations or logins, or any other methods may void your Entries and you may be disqualified from the Sweepstakes. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents (including, but not limited to, sweepstakes or contest entry services and other third party organizations to assist with the entry process in any way), as determined by the Sponsor and/or Administrator, will void all Entries by you. In the event of a dispute as to any online Entry or prospective Prize Winners, the authorized account holder of the email address used to enter will be deemed to be the entrant and such individual must comply with these Official Rules. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential Prize Winners may be required to show proof of being the authorized account holders.
   
   When you enter at the Website, you may be asked to consent to receive promotional emails and reminders for upcoming promotions and information about Sponsor. Consenting to receive such emails is optional and does not have to be agreed to in order to be eligible to enter the Promotion and does not improve your chances of winning.
   
   Sponsor reserves the right to conduct a background check on the prospective Prize Winner and reserves the right, in its sole discretion, to disqualify such individual based upon such background check if Sponsor determines, in its sole discretion, that awarding the Prize (as defined herein) to such prospective Prize Winner might reflect negatively on Sponsor or any of the Sweepstakes Entities. Failure by prospective Prize Winner to agree to a background check may also result in disqualification.
   
   In order to access the Website and in an effort to optimize the Website’s user experience, ad blocking software on your computer may need to be disabled. Incorrect or incomplete Entries are void and will not be eligible. Proof of entry information or online submission at the Website is not considered proof of delivery to or receipt by Sponsor or Administrator of an Entry. Entries made by any other individual or any entity, and/or originating at any other website or email address, including, but not limited to, commercial Sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified from this Sweepstakes.
   
   By submitting a Bonus Entry in this Sweepstakes, entrant grants Sponsor and all other such persons as Sponsor may designate, the absolute, irrevocable, worldwide, perpetual right and permission to use, reproduce, publish, store, post, display, distribute, modify, prepare derivative works of and/or otherwise use the material and content in the Bonus Entry, in any manner, form, format or media now or hereinafter created, including on the Internet, and for any purpose, including but not limited to advertising of Sponsor, the Sweepstakes, and Sponsor’s products, all without further notice, consent or payment, including but not limited to on Sponsor’s e-commerce website and social media accounts.
   
   Bonus Entry Guidelines: Bonus Entry content must be original to the Entrant. Bonus Entry must not:

   1. include any image and/or likeness of any minor persons;
   2. reference any commercial/corporate advertising, including but not limited to corporate logos, brand names (other than Sponsor’s), slogans, political, or religious. Statements, or be otherwise objectionable, as determined in Sponsor’s sole discretion;
   3. include any commercial solicitation or promotional materials, websites, contact information or personally-identifiable information (e.g., first or last name, address, phone number, place of work, email address, etc.);
   4. contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
   5. defame, misrepresent or contain disparaging remarks about Sponsor, the Released Parties, or their respective products and services, or other people, products or companies;
   6. contain content that is false, inaccurate or misleading;
   7. include references to any activity that Sponsor deems to be, in their sole discretion, lewd or indecent.
   8. Any Entry deemed inappropriate or unsuitable, in Sponsor’s sole discretion, will be disqualified and may be deleted.
      
      
5. ENTRANT’S WARRANTIES AND REPRESENTATIONS: By submitting an Entry, each entrant warrants and represents that the Entry and/or content submitted with the Entry: (a) is original to and owned by the entrant, (b) does not infringe the copyright, trademark, trade dress, or other proprietary right or intellectual property right, privacy, publicity, or any other rights of any third party or person, living or deceased (including, but not limited to, by sharing any identifying information of a third party or portrayal in a false light), (c) does not violate any law or regulation. Entrants acknowledge and agree to the terms in these Official Rules, including all eligibility requirements. To be valid, each Entry must follow the directions in Section 4 herein. Entrants acknowledge and agree that upon submission, all Entries become the property of Sponsor and will not be returned.
   
   
6. PRIZE & PRIZE CONDITIONS: There will be twelve (12) Prizes available from the Promotion. Each  Prize Winner will receive one (1) prepaid gift card with the value associated to the applicable drawing, as shown in the table in Section 4, to redeem on any product from the www.Banter.com website (individually a “Prize” and collectively the “Prizes”). Approximate retail value (“ARV”) of all prizes in this Sweepstakes: $4,000.00 USD. Usage of the Prize is subject to the terms and conditions associated with the gift card. All Prizes are awarded on an “as is” basis. Prizes cannot be redeemed for cash, or used as payment for exchanges, purchases of additional gift cards, or as an adjustment to prior purchase(s) or applied as payment on any account. Prizes will not be replaced if lost or stolen.
   The specifics of all aforementioned elements of the Prizes in the Sweepstakes shall be solely determined by Sponsor. All other costs, taxes (including federal, state, and local taxes), fees, and expenses associated with Prize acceptance or usage not specifically mentioned herein are the responsibility of the Prize Winners. Prizes may be reported as income to a Prize Winner and Prize Winners may be issued an IRS 1099 tax form for the actual value of the Prize(s). Prizes cannot be transferred, assigned, or substituted except at Sponsor’s sole discretion. Sponsor reserves the right to substitute the Prizes, or portions thereof, with a prize of equal or greater value. The potential Prize Winners acknowledge that Sponsor has not made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any Prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. By accepting a Prize, the Winners agree to release and hold harmless the Released Parties from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the Prizes. The Winners are solely responsible for all matters relating to the Prize after it is awarded.
   
   
7. How Winner will be Determined; ODDS OF WINNING: The potential Prize Winners will be selected in twelve (12) random drawings from among all eligible entries received throughout the Sweepstakes Period. There will be one (1) drawing per Entry Period (and one Prize Winner per drawing). The Prize drawings will be conducted by the Administrator, whose decisions are final and binding. The Prize drawings will be conducted on or about the dates listed in the schedule in Section 4. The potential Prize Winners will each be contacted by the Sponsor via email within three (3) business days following the drawing. Each potential Prize Winner will be required to sign an affidavit of eligibility and release of liability and publicity (where permitted), and return same, properly executed, to sweepstakes@bazaarvoice.com within seven (7) days of issuance of prize notification. If Sponsor is unable to contact the prospective Prize Winner within three (3) days from first notification attempt, if the prospective Prize Winner fails to complete and return all requested forms by the specified date, if the prospective Prize Winners do not pass Sponsor’s background check (in its sole discretion and as applicable), or if the prospective Prize Winner fails to comply with any of the requirements, his/her prize will be forfeited and an alternate prospective Prize Winner may be selected. Only three (3) alternate drawings will be held, after which the Prizes will remain un-awarded. Upon Sponsor’s receipt of a prospective Prize Winner’s properly executed affidavit and verification of eligibility, Sponsor will confirm the entrant as the official “Prize Winner” send the respective Prize to the Prize Winner’s email within four (4) to six (6) weeks. Odds of winning a Prize will depend on the total number of eligible entries received during the Entry Period in question.
   
   
8. Conditions of Entry: Entry materials that have been tampered with or altered are void. If in the Sponsor’s opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if a computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and void any Entries submitted fraudulently, to modify, suspend, or terminate the Sweepstakes, or to conduct a random drawing to award the Prizes using all eligible, non-suspect Entries received as of the termination date or as otherwise deemed fair and appropriate by Sponsor, at any time with or without notice to eligible entrants. Sponsor reserves the right, at its sole discretion, to disqualify any individual, and void his/her Entries, who is deemed to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Should the Sweepstakes be terminated prior to the stated expiration date, Sponsor shall take all reasonable measures to post a notice on the Website. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. CAUTION: ANY ATTEMPT BY YOU TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM YOU TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
   
   
9. RELEASE AND LIMITATIONS OF LIABILITY: Sponsor, Administrator, and other participating entities (collectively with Sponsor, the “Sweepstakes Entities”), their respective affiliates, subsidiaries, parent, advertising and promotion agencies, prize suppliers, local sponsors, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) (collectively, “Released Parties”) are not responsible for: any incorrect or inaccurate Entry information; human error; technical malfunctions; failures, omissions, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to your or any other person’s computer relating to or resulting from participation in this Sweepstakes; inability to access the Website; theft, tampering, destruction, or unauthorized access to, or alteration of Entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any web site; printing or human or other errors; and any Entries which are late, lost, incomplete, misdirected, stolen, mutilated, illegible, postage due, or any combination thereof. Online submission is not considered proof of delivery or receipt. Upon submission, all Entries become the property of Sponsor and will not be returned. By entering, you agree to release, discharge, indemnify and hold harmless the Released Parties from and against all claims and damages or liability arising in connection with your participation and/or Entry in the Sweepstakes and/or your receipt or use of any Prize awarded in this Sweepstakes or due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any Prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes, including any claims for violations of privacy rights, publicity rights, or other intellectual property rights. Any and all warranties and guarantees are subject to the respective manufacturer’s terms. If by reason of a printing or other error, more prizes are claimed than the number set forth in these rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded. You further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. You acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims. Released Parties are not liable in the event that any portion of the Sweepstakes is cancelled due to weather, fire, strike, acts of war or terrorism, pandemic, or any other condition beyond their control (a "Force Majeure Event").
   
   
10. PRIVACY: In connection with the Sweepstakes, Sponsor and/or Sweepstakes Entities may be collecting personal data about entrants on the Website in accordance with Sponsor’s privacy policy. Please review Sponsor’s privacy policy located at https://www.banter.com/privacy-policy. By participating in the Sweepstakes, you hereby agree to Sponsor’s and/or Sweepstakes Entities’ collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s privacy policy.
    
    
11. PUBLICITY GRANT: Except where prohibited by law, participation in the Sweepstakes constitutes your consent to Sponsor’s use of your name, photograph, likeness, statements, biographical information, voice, Entry (including photos or other intellectual property or content you submit), and state of residence for promotional purposes in any and all media (including on the Website or Sponsor-affiliated social media pages), now or hereafter devised, worldwide in perpetuity, without further payment or consideration, notification or permission. By submitting an Entry, entrants agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Sponsor on the grounds that any use of the Entry infringes any of the entrant’s rights as creator of the Entry, including, without limitation, copyrights, trademark rights, and moral rights. Sponsor and its designees shall have the right to edit, publish and use the Entries in any way and in any media for trade, advertising, promotional, and/or other purposes as Sponsor and/or its designees may determine.
    
    
12. DISPUTES: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of Entrants or the Sweepstakes Entities in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Ohio without giving effect to any choice of law or conflict of law rules or provisions which would cause the application or the laws of any jurisdiction other than the State of Ohio. As a condition of participating in this Sweepstakes, each Entrant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Sweepstakes, shall be resolved exclusively in the federal or state courts sitting in the State of Ohio. You expressly consent to the jurisdiction of and venue in such courts and waive all defenses of lack of jurisdiction and inconvenient forum with respect to such courts, and expressly agree that all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action. You agree to service of process by mail or other method acceptable under the laws of the State of Ohio. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS PROMOTION. YOU HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEYS’ FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, IDENTIFIABLE PERSONS, OR THIRD-PARTY PARTICIPANTS, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. ENTRANT FURTHER WAIVES ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR INCREASED.
    
    
13. SEVERABILITY: The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, the other provisions will remain in effect and will be construed as if the invalid or unenforceable provision were not contained herein.

MISCELLANEOUS: These Official Rules contain the full and complete understanding with respect to the Sweepstakes and supersede all prior and contemporaneous agreements, representations, and understandings, whether oral or written. The headings herein are for convenience only, do not constitute a part of these Official Rules, and shall not be deemed to limit or affect any of the provisions hereof. No amendment to, or waiver of, any provision of these Official Rules shall be effective unless in writing and signed by both Sponsor and Administrator. The waiver by Sponsor or Administrator of any provision of these Official Rules shall not constitute a waiver of any other provision herein. The rights and obligations hereunder may not be assigned by Entrant, whether by operation of law or otherwise, without the prior written consent of Sponsor, and any attempted assignment in violation of the foregoing shall be null and void. These Official Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of Sponsor, Administrator, and Entrant.
