SITKA SEAFOOD MARKET X CHRISTIANN KOEPKE GIVEAWAY RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.  Purchasing any Sitka Seafood Market product or service will not increase your chance of winning the Promotion.

ELIGIBILITY:  To enter the "Sitka Seafood Market X Christiann Koepke Giveaway" (the “Promotion”), you must be, at the time of entering the Promotion, (a) a citizen of the United States or a lawful permanent resident of the United States; and (b) 18 years of age or older.  Employees, officers and directors of Sitka Seafood Market LLC (the “Sponsor”) and its respective parents, subsidiaries, licensees, agencies and affiliates and members of the immediate families (spouses, parents, siblings, children and their spouses and in-laws) and persons living in the same household (whether related or not) of such individuals are not eligible.  

HOW TO ENTER: 

The Promotion takes place November 10, 2023 on Instagram. All entries must be received between November 10, 2023 and November 19, 2023 (the "Entry Period").

To enter the Promotion, entrants must submit follow the rules as laid out on Instagram post and submit this form to receive an additional entry. Each entry must include the entrant’s email address.

Limit one (1) Entry per person.  Sponsor reserves the right to disqualify any person who submits multiple entries. Automated or bulk entries or entries submitted by third parties will be disqualified.

WINNER SELECTION & NOTIFICATION:  

From all entries received during the Entry Period, Sponsor will randomly select 3 winners winner to receive the Prizes (as described below).  The winner will be selected on or around November 20, 2023.  The odds of winning depends on the number of entries received.

The Sponsor's decisions are based on its sole discretion and interpretation of these official rules, and are final and binding in all respects.  The selected winner will be notified by email, as provided by the entrant on the entry form.

If a randomly selected winner fails to respond to Sponsor’s prize notification or the winner is unable to use or is otherwise ineligible to receive the Prize, that winner will be disqualified and, at Sponsor’s discretion, an alternate winner may be selected.

PRIZES:

One (1) eligible entrant will win a fully paid 3-month Sitka Seafood Market Premium Seafood Subscription.  The ARV of the subscription package is $477. 

One (1) eligible entrant will win a $150 Digital Gift Card good for use at www.sitkaseafoodmarket.com.

One (1) eligible entrant will win a $100 Digital Gift Card good for use at www.sitkaseafoodmarket.com.

The Prizes cannot be substituted, assigned, transferred, or redeemed for cash by the winner; however, Sponsor reserves the right to make equivalent prize substitutions at its sole discretion.  

OPT-IN; PERMISSION TO CONTACT YOU: By entering the Promotion, you consent to and grant permission to Sponsor and/or its marketing affiliates to contact you with promotions and special offers about Sponsor products and services by email, text, phone or mail.  You may opt out of receiving such promotions at any time by following the opt-out instructions in the promotional materials or notice.

All federal, state or other tax liabilities (including income taxes) arising from this Promotion will be the sole responsibility of the winner.  Winning entries and Prize are not transferable; no prize substitutions are allowed except by the Sponsor who reserves the right to substitute prizes with prizes of equal or greater value.  The Prize or any portion of the Prize cannot be redeemed for cash. The Sponsor, its affiliates and agencies are responsible for Prize delivery only.  SPONSOR DOES NOT MAKE ANY REPRESENTATION OR WARRANTY WITH RESPECT TO THE PRIZE, AND HEREBY DISCLAIMS ANY AND ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE PRIZE.

WAIVER:  Sponsor and Promotion Entities are not responsible for any technical, mechanical, printing, typographical, human or other error of any kind relating to or in connection with the Promotion, including, without limitation, errors which may occur in the administration of the Promotion, the processing of entries, the announcement of the prize or delivery of the Prize.  Sponsor reserves the right in its sole discretion, to disqualify any entrant or entry that is in violation of the Official Rules or to cancel, suspend or modify the Promotion, and disqualify any implicated entrant(s), (and their entries) if any fraud, actions by entrants, technical or other error or problem of any kind, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Promotion, as determined by Sponsor in its sole discretion.  In the event of cancellation, Sponsor reserves the right, at its sole discretion, to award the Prize in a random drawing from among all eligible, non-suspect entries received up to the time of the event or action warranting such cancellation or to take any other action it deems equitable to fairly award any prize.

NO LIABILITY:  By entering, entrants and the winners agree to comply with these rules as stated and agree to release, discharge, indemnify and hold harmless the Sponsor, and its respective officers, directors, employees, representatives and agents from and against any claims made by the winner, entrants, or any other third parties, related in any way to the operation of this Promotion as well as any other claims, damages or liability resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Promotion-related activity or participation in this Promotion.

GOVERNING LAW: ARBITRATION: The Promotion is governed by the laws of the state of Illinois.  Except where prohibited by law, as a condition of participating in this Promotion, entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action; and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at a AAA regional office in Chicago, Illinois; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages including attorney’s fees or any other damages, other than for entrant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and entrant further waives all rights to have damages multiplied or increased.
