REBBL® JOIN THE BOTANICAL REVOLUTION FOR GOOD SWEEPSTAKES

OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.  SWEEPSTAKES BEGINS AT 12:00:00 AM PACIFIC TIME (“PT”) ON 5/24/19 AND ENDS AT 11:59:59 PM (PT) ON 9/15/19 (THE “PROMOTION PERIOD”).  SWEEPSTAKES ONLY OPEN TO LEGAL RESIDENTS OF THE UNITED STATES RESIDING IN THE 50 UNITED STATES AND DISTRICT OF COLUMBIA AND WHO ARE AT LEAST 18 YEARS OF AGE OR THE AGE OF MAJORITY IN THEIR STATE OF RESIDENCE, WHICHEVER IS OLDER, AT THE TIME OF ENTRY.  VOID WHERE PROHIBITED. 

PROMOTION DESCRIPTION:  The REBBL® JOIN THE BOTANICAL REVOLUTION FOR GOOD Sweepstakes (“Sweepstakes”) is an online entry Sweepstakes that also offers bonus entry opportunities as further described below.  There will be one (1) Grand Prize winner and ten (10) Runner Up Prize winners in the Sweepstakes, which will be determined by random drawings at the conclusion of the Promotion Period from all eligible entries received from all entry methods combined, as further described below.

This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Michael Franti, Facebook, or Instagram.  Any questions, comments, or complaints regarding this Sweepstakes should be directed to Sponsor and not to Michael Franti, Facebook, or Instagram. 

ELIGIBILITY:  Sweepstakes open only to legal residents of the United States residing in the 50 UNITED STATES AND DISTRICT OF COLUMBIA, AND WHO ARE AT LEAST 18 YEARS OF AGE OR THE AGE OF MAJORITY IN THEIR STATE OF RESIDENCE, WHICHEVER IS OLDER, AS OF THE DATE OF ENTRY.  Employees, officers and directors of REBBL Inc., its parent company, subsidiaries, divisions, affiliates, suppliers, printers, prize providers, distributors and advertising, promotional and judging agencies, Michael Franti and his affiliated entities (and the respective IRS dependents, immediate family members [parents, children, siblings and spouse]) and individuals residing in their same household of the foregoing (whether or not related) (collectively, “Promotion Entities”) are not eligible to participate or win.

HOW TO ENTER:  NO PURCHASE NECESSARY TO PARTICIPATE IN SWEEPSTAKES.

There are two (2) ways to visit the Website in order to enter the Sweepstakes during the Promotion Period: 

go to http://www.rebbl.co/botanical (the “Website”) and follow the instructions to complete the online entry form.  Upon completion of the online entry form, click “submit” to receive one (1) entry into the Sweepstakes.  

Alternatively, you may enter the Sweepstakes via text message during the Promotion Period, from your wireless phone, by texting REBBL or FRANTI (each, a “Keyword”) to 63566 (the “Short Code”).  After sending your text message entry, you will receive one (1) text message to the number provided in response to your text entry containing a link to the Website.  Click on the link and follow the online instructions at the Website to complete your entry into the Sweepstakes.  By texting a Keyword to the Short Code, entrants affirm that they are the subscriber of the number provided, and they consent to receive a return automated text message from Sponsor to the number provided with a link to the Website where entrants can complete the online form for entry into the Sweepstakes.  Message and data rates may apply.  See additional text messaging terms below.

Limit one (1) entry per person/email address during the Promotion Period, regardless of the method of entry.

For Text messages - You may opt-out of receiving promotional text messages from Sponsor at any time by sending a reply text message with the word “STOP”; or “HELP” for help.  The text messaging method of entry is designed to work with most of the U.S. major wireless carriers in the United States, but Sponsor makes no guarantee that any particular wireless service provider will participate, and the mobile phone that is used must be capable of sending and receiving text messages.  Check with your carrier for details.  Entrants should check their phone’s features to see if they have that capability.  Wireless service providers may charge entrants for each text message, including any error message that is sent and received in connection with the Sweepstakes, based on the applicable wireless service pricing plan.  Entrants should consult their wireless service provider’s pricing plan for details.  You are responsible for all applicable fees and taxes associated with sending a text in the Sweepstakes.  Sponsor in its sole discretion may add or delete a cellular carrier at any time, without notice.  Proof of text messaging one of Keywords to the Short Code is not considered proof of delivery to or receipt by Sponsor of such text message.

BONUS ENTRIES.  An entrant may earn bonus entries into the Sweepstakes for each of the following actions that are completed by the entrant via the Sweepstakes platform (“Platform”) found on the Website, as further described below:

Refer Your Friends.  You will receive up to ten (10) bonus entries into the Sweepstakes by referring your friends to the Sweepstakes by using your unique link.  You will receive ten (10) bonus entries for each friend that completes the entry process into the Sweepstakes using your unique link.  Limit ten (10) friends for a total of ten (100) bonus Refer Your Friends entries in the Sweepstakes.

Facebook.  You will receive one (1) bonus entry into the Sweepstakes by visiting the REBBL Facebook page via the Platform.  Limit one (1) Facebook bonus entry in the Sweepstakes.

REBBL Instagram.  You will receive one (1) bonus entry into the Sweepstakes by visiting REBBL on Instagram via the Platform.  Limit one (1) Instagram bonus entry in the Sweepstakes.

REBBL Survey.  You will receive five (5) bonus entries into the Sweepstakes by completing a REBBL brand survey via the Platform.  Limit one (1) survey bonus entry in the Sweepstakes.

Michael Franti Instagram.  You will receive one (1) bonus entry into the Sweepstakes by visiting Michael Franti on Instagram via the Platform.  Limit one (1) Michael Franti Instagram bonus entry in the Sweepstakes.

Michal Franti’s “Do It For The Love Foundation” website.  You will receive one (1) bonus entry into the Sweepstakes by visiting Michael Franti’s “Do It For The Love Foundation” website via the Platform.  Limit one (1) bonus entry for visiting Michael Franti’s “Do It For The Love Foundation” website in the Sweepstakes.

The computer of Sponsor is the official time keeping device for this Sweepstakes.  Proof of submission of an entry does not constitute proof of delivery of entry.  Any attempt to submit more than the maximum number of entries using multiple/different email addresses, social media accounts, identities or any other methods may void that entrant’s entry.  Entries generated by a robotic, programmed, script, macro or other automated means will be disqualified.  No other forms of entry are valid other than those set forth above.   Sponsor reserves the right to disqualify any entry that it determines, in its sole discretion, is not in compliance with these Official Rules.  By participating, entrants agree to these Official Rules, which are final and binding in all respects.

PRIZES / APPROXIMATE RETAIL VALUES (“ARV”) / ODDS:  One (1) Grand Prize will be awarded in the Sweepstakes (“Grand Prize”).  The Grand Prize is as follows: A 7-day/7-night trip for winner and one (1) guest to the Soulshine Bali Hotel and Yoga Retreat Oasis in Bali (ARV $5,500).  Trip includes round-trip coach class international air transportation on a carrier selected by Sponsor for winner and his/her guest between the major international commercial airport closest to the winner’s residence and the Bali International Airport; 7-nights lodging for two (2) at the Soulshine Bali Hotel and Yoga Retreat Oasis in Gianyar, Bali, Indonesia (based on double occupancy – winner and his/her guest in same room); one (1) additional night lodging at the Soulshine Bali Hotel and Yoga Retreat Oasis upon arrival; round trip ground transportation to-from airport/hotel; access to classes and yoga sessions; $50 per diem, per day for winner and his/her guest for meals while at the Soulshine Hotel and Yoga Retreat Oasis (to be issued in the form of a credit to their hotel account); and one (1) $250 Bank-issued, pre-loaded gift card (winner only) for miscellaneous travel expenses.  Use of the Grand Prize is subject to any and all additional terms and conditions, releases, waivers, rules, and regulations imposed by the airline carrier, hotel, and/or ground transportation providers.  Use of all elements of the Grand Prize will be at each individual’s risk. Sponsor has no control over the personnel, equipment, or operations of any airline carrier, transportation provider, hotel, or any other person or entity furnishing services, products, or accommodations as part of the Grand Prize.  Sponsor shall not be liable for any injury, damage, loss, expenses, accident, delay, cancellation, diversions or substitutions, or any act or omission, inconvenience or other irregularity that may occur. The Grand Prize is awarded by Sponsor “as is” without any warranties or guarantees, either express or implied.  Air transportation and lodging are based on availability and at the sole discretion of Sponsor; and some blackout dates and restrictions may apply.  Winner and his/her guest must travel on same itinerary, and must possess and provide proof of required international travel documents prior to awarding of prize.  Actual retail value of prize may vary depending on winner’s residence and may fluctuate due to market conditions, changes in value of components, (e.g. air transportation and hotel rates) and other reasons.   Winner must provide the Sponsor with at least sixty (60) days advanced notice prior to desired date of travel.  Grand Prize does not include taxes, tips, gratuities, meals and beverages (other than those noted herein), alcoholic beverages, service charges, laundry service, merchandise, souvenirs, local and long distance telephone calls, airport charges, luggage fees, transportation (other than as expressly provided above), entertainment, parking, insurance, gratuities, incidentals, taxes, or any other service or item not specifically described above.  A major credit card may be required at check-in at the airport and/or hotel to cover any incidental charges. Sponsor will not be responsible for any additional charges resulting from any changes to the winner’s or guest’s itinerary or accommodations.  No sale, transfer or substitution of trip elements will be permitted, except by Sponsor in its sole discretion.  In the event any component of the prize is cancelled, delayed, or postponed, or unavailable for any reason outside the control of the Sponsor, Sponsor will have no further obligation, other than to award the remainder of the prize.  Prize is not redeemable for cash.  Trip must be taken by 12/31/20 or prize will be forfeited in its entirety.  Note: Michael Franti is scheduled to be present at the Soulshine Bali Hotel and Yoga Retreat Oasis 11/23/19 – 11/30/19.  Other future dates for Michael Franti’s appearance at the Soulshine Bali Hotel and Yoga Retreat Oasis are yet to be determined.  If winner and his/her guest would like to attempt to book their trip during Michael Franti’s visit (as noted above), winner must request to schedule their trip no later than 10/15/19 due to limited room availability.  Michael Franti’s appearance and/or presence at the Soulshine Bali Hotel and Yoga Retreat Oasis is subject to availability and subject to change without prior notice.  Ten (10) Runner Up Prizes will be awarded in the Sweepstakes (each a “ Runner Up Prize” and collectively, the “ Runner Up Prizes”). Each Runner Up Prize winner will receive a REBBL Swag Pack consisting of REBBL wearables; Michael Franti’s Stay Human Vol. II CD; Stay Human movie; swag items and a 12-pack of REBBL products (ARV $316 ea. winner). 

Total ARV of all prizes offered in the Sweepstakes is $8,660.  Winner must accept prize as stated or prize may be forfeited in its entirety and may be awarded to an alternate winner.  Limit one prize per person, email address, social media account and/or household.  Odds of winning a prize depend upon the total number of eligible entries received from all methods of entry combined during the Promotion Period.  All prize details are at Sponsor’s sole discretion.  Unclaimed prizes will not be awarded.  All applicable federal, state, and local taxes on prizes are the sole responsibility of the prize winners.  If a prize offered becomes unavailable for any reason, Sponsor reserves the right to provide an alternate prize of equal or greater value. 

DRAWING:  Prize winners will be selected in a random drawing from among all eligible entries received from all methods of entry combined during the Promotion Period on or about 9/16/19 by Sponsor or its designee whose decisions are final and binding. 

GENERAL TERMS:  No substitution of prize is offered, no transfer of prize to a third party is permitted and there are no cash equivalents (unless at the sole discretion of Sponsor).  Void wherever prohibited by law.  Prize winners will be solely responsible for all applicable federal, state and local taxes on prize unless otherwise required by law.  Winners are advised to seek independent counsel regarding the tax implications of accepting a prize.  All expenses on the receipt and use of the prize not specifically mentioned herein are solely the responsibility of the winners.  Any portion of a prize not accepted by winners will be forfeited.  Winner’s first name, last initial, city and state will be disclosed on Winners List which will be distributed upon request and as required by law.  No groups, clubs or organizations may reproduce or distribute any portion of these Official Rules to its members.  All entrants, as a condition of entry, agree to be bound by these Official Rules and the decisions of the Sponsor.  Entry information submitted in connection with this Sweepstakes will be treated in accordance with these Official Rules and Sponsor’s Privacy Policy (as may be amended from time to time), currently available at https://rebbl.co/privacy-policy/ provided that, in the event of any conflict between Official Rules and such Privacy Policy, the terms and conditions of these Official Rules shall prevail.  To read Sponsor’s Privacy Policy, go online to the URL noted and then access the Privacy Policy.  Entrants are providing their information to Sponsor and not to any Social Media Platform.

WINNER NOTIFICATION:  Potential winners will be notified via email with instructions on how to verify eligibility and claim the prize.  It is the winner’s responsibility to timely set account settings to accept contact by Sponsor and to timely check their account for such messages.  Potential winners may be required to demonstrate ownership of the relevant email account, social media account and/or entry, in Sponsor’s sole discretion.  Potential winners will be required to respond within three (3) business days from the date of the first notification attempt.  If any potential winner does not respond to the notification in the time period specified, is found to be ineligible or otherwise not in compliance with these Official Rules or any prize or prize notification is returned as undeliverable, the prize may be forfeited and an alternate winner may be selected in the Sponsor’s sole discretion.  Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason.  In addition, Grand Prize winner will be required to complete, sign, and submit an IRS Form W-9 or equivalent form with the winner’s social security number or other U.S. taxpayer identification number within seven (7) days of Sponsor notifying winner.  An IRS Form 1099 will be issued in the name of the winner for the actual value of the prize received.  Additionally, winner and his/her guest may be required to sign waivers, releases and additional documents required by the hotel.  Guest of Grand Prize winner must be 18 years of age or older and must sign and return a Liability/Publicity Release prior to awarding of prize.  Failure to return any required documents within ten (10) days may result in prize forfeiture, and an alternate winner may be selected.  Please allow up to eight (8) weeks for delivery of prize following completion of notification process.  Prizes will only be delivered to addresses within the United States and District of Columbia.

INDEMNIFICATION AND RELEASE:  All entrants, as a condition of entry into the Sweepstakes, agree to indemnify, hold harmless, and release Sponsor, Promotion Entities, Facebook, and Instagram (“Releasees”)  from and against any and all liability, claims, actions, judgments, demands, costs and expenses of any kind whatsoever including, but not limited to, personal injury, death, or damage to or loss of property,  which may be sustained directly or indirectly through participation (or inability to participate) in the Sweepstakes, with the receipt, ownership, use, inability to use, or misuse of any prize awarded, or while preparing for, participating in or traveling to or from any prize-related activity or for any typographical or other error in these Official Rules or the announcement of offering of any prize.  The winners shall bear all risk of loss or damage to their Prize after it has been delivered.  Sponsor makes no representations or warranties of any kind regarding any prizes, including warranties concerning the appearance, safety or performance of any prize, and warranties as to fitness and merchantability.  Except where prohibited by law, each winner grants, and agrees to confirm this grant in writing if requested, to Sponsor the right to print, publish, broadcast and use worldwide in any media now known or hereinafter known the winner’s name, address, voice, statement, picture or other likeness, without additional review, notification or compensation, for any purposes, including public relations, advertising and promotional purposes, as may be determined by Sponsor.

LIMITATIONS OF LIABILITY:  The Releasees assume no responsibility for: (a) lost, illegible, late, misdirected, delayed  or incomplete,  entries, posts, comments or emails; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, garbled, corrupted, scrambled, delayed, or misdirected transmissions, or computer hardware or software or telephone malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information; and (b)  any incorrect or inaccurate information, whether caused by Website users, or by any equipment or programming associated with or utilized in this Sweepstakes; any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the Website.  Entries made by any other individual other than the person named in the entry, or by any entity, including but not limited to commercial sweepstakes subscription notification and/or entering services, and/or through other third-party websites or software programs are prohibited and will be declared invalid and disqualified for this Sweepstakes. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with Entry process or operation of the Sweepstakes, any Sweepstakes or Website, to be acting in violation of the terms of the Website or to be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person.  Sponsor and Promotion Entities are not responsible for injury or damage to entrants’ or any other person’s computer related to or resulting from participating in this Sweepstakes or downloading or copying materials from or use of Website.  In the event an insufficient number of eligible entries are received and/or if, for any reason, the Sweepstakes, in the sole opinion of Sponsor, is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes which, in sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes, and determine winners from all non-suspect, eligible entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor.  In case of dispute, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant, and must comply with these Official Rules.  The authorized account holder is deemed to be the natural person who is assigned the particular email address by an Internet access provider or online service provider.  Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants and it is solely the responsibility of the entrant to notify Sponsor in writing if the entrant changes his or her social media account, email address, mailing address and/or telephone number during the Promotion Period.   

CAUTION:  ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

DISPUTE RESOLUTION:  Except where prohibited, by participating, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant(s) and Sponsor, shall be governed by and construed exclusively in accordance with the laws of the State of California without giving effect to any principles of conflicts of law of any jurisdiction and that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating, but in no event attorneys' fees; and (c) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
