Rules

1.        THE PROMOTER 

1.1      The Promoter is St Andrews Links Trust of Pilmour House, St Andrews, KY16 9SF.

2.        THE COMPETITION 

2.1      The title of the competition is ‘St Andrews Links 12 Days of Christmas Giveaway’. 

2.2         The competition provides entrants with an opportunity to win 12 individual prizes.

3.        HOW TO ENTER 

3.1      The competition will run from 2nd December 2024 (the “Opening Date”) to 13th December 2024 the (“Closing Date”) inclusive. 

  3.2      All competition entries must be completed by no later than midnight on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.  

3.3      To enter the competition, visit standrews.com/giveaway and complete the form by the Closing Date.  

3.4      The Promoter will not accept responsibility for competition entries which are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind. Proof of delivery of the entry is not proof of receipt by the Promoter. 

3.5      There is no charge for entry and no purchase is necessary. 

3.6      By submitting a competition entry, you agree to be bound by these terms and conditions.

The Promoter will not accept responsibility for responding to enquiries which do not follow the above instructions.

3.9      The winners will be chosen at random from the correct entries received by the Promoter before midnight on the closing day of the competition (13th December). An electronic computer script which is designed to select a random winner from the entries will be used to select the winner for each individual prize. The randomly selected winner must have complied with these terms and conditions in order to receive the prize. 

4.        ELIGIBILITY 

4.1      The competition is open to all residents anywhere in the world aged 18 years or older, except: 

4.1.1    Employees or agencies of the Promoter or its group or holding or subsidiary companies; 

4.1.2    Employees or agencies of TravisMathew, Callaway, Top Golf, Golf+, Toro, EA Sports, Blueprint Ballparks. Allianz, NBC, Aimee Smith, Bluewater or their group or holding or subsidiary companies; 

4.1.3  Members of the immediate families or households of 4.1 and 4.2 above;  

4.1.4    Anyone else who is professionally connected with the competition or its administration. 

4.2      In entering the competition, you confirm that you are eligible to do so and eligible to claim the Prize. The Promoter may require you to provide proof that you are eligible to enter the competition, in which case failure to promptly provide such proof shall disqualify you from winning the prize. 

4.3      The Promoter will not accept competition entries that are: 

4.3.1    automatically generated by computer; 

4.3.2    completed by third parties or in bulk; 

4.3.3    illegible, have been altered, reconstructed, forged, or tampered with; or 

4.3.4    incomplete.

5.2      There are 12 individual prizes to be won. 

5.3      The Prize is subject to availability. There is no cash alternative for the prize, and the Promoter reserves the right to substitute the prize with a prize of equal or greater value. 

5.4      The Prize is non-negotiable, non-exchangeable, non-transferable, and is not redeemable for cash or other prizes. 

5.6     The Promoter will cover the cost of shipping the Prize to the winner and has up to 90 days to ship the prize.

5.7      The Promoter accepts no responsibility for any costs associated with taking up the Prize which are not specifically included in the Prize.

6.        WINNERS 

6.1      The decision of the Promoter is final and no correspondence or discussion will be entered into. 

6.2    The Promoter will contact the winners within seven (7) days of the final competition Closing Date (13th December), via a direct email to the account used to submit the entry. 

6.3     If the winner cannot be contacted, is not available, or has not responded to the Promoter within seven (7) days of the Announcement Date, the Promoter reserves the right to select a new winner from the correct entries that were received before 5pm on the Closing Date. 

6.4      The Promoter does not accept any responsibility if the winner is not able to take up the prize.

7.        LIMITATION OF LIABILITY 

7.1    Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate any entrant (including the winner) or accept any liability for any loss, damage, personal injury or death occurring as a result of entering into the competition or taking up the prize except where such liability is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

8.        DATA PROTECTION 

8.1      The Promoter will only process your personal data as set out in the St Andrews Links Trust privacy policy, available at https://www.standrews.com/privacy, and in accordance with all applicable data protection legislation, with regard to the announcement of winners.

9. DATA SHARING & MARKETING CONSENT

9.1      By entering this competition, you agree that the promoter may collect and process your personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). Your data may be shared with our competition partners for the purposes of administering the competition and, if you have provided explicit consent, for marketing communications.

9.2  If you opt-in to receive marketing from the promoter or its competition partners, you may be contacted via the channels you have consented to. You can withdraw your consent at any time by following the unsubscribe instructions provided in the communications or by contacting us directly.

   9.3  The competition partners include Callaway (including Odyssey Golf Europe & Callaway Pre-Owned Europe), Allianz, NBC Sports, TravisMathew, Bluewater, EA Sports, Aimee Smith, Toro, Ballpark Blueprints, TopGolf, and Golf+. By participating in the competition, you acknowledge that your data may be shared with these partners for competition administration and, where explicit consent has been provided, for marketing purposes. 10.        GENERAL 

10.1      If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition or claiming the prize. 

10.2      The Promoter reserves the right to hold void, suspend, cancel, or amend this competition for any reason and, to the fullest extent permitted by law, excludes its liability to any entrants or potential entrants for doing so. 

10.3    The decision of the Promoter in all matters under its control is final and binding and no correspondence or negotiation will be entered into. 

10.4      These terms and conditions shall be governed by Scots law, and the parties submit to the non- exclusive jurisdiction of the courts of Scotland.
