NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.

SPONSOR. This contest is sponsored by [SPONSOR LEGAL NAME] (“Sponsor”). References to Sponsor in this Agreement shall refer solely to the company sponsoring the contest and, its parent company, affiliates, subsidiaries, and respective employees, officers, and directors.

ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED. PARTICIPATION IN THE GIVEAWAY CONSTITUTES YOUR AGREEMENT TO AND ACCEPTANCE OF THE OFFICIAL RULES (“RULES”) BELOW.

1. Eligibility.

This giveaway (the “Giveaway”) is open to those that sign up via the official website (the “Site”) and who are: (i) legal residents of the State of Texas, (ii) eighteen (18) years of age or older, and (iii) possess a valid Texas ID.

Employees of Sponsor and other affiliates associated with the promotion of the Giveaway, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Giveaway is subject to all federal, state, and local laws and regulations.

2. Agreement.

Participation in the Giveaway constitutes your agreement to and acceptance of these Rules and the decisions of the Sponsor, which are final and binding. Winning a Prize is contingent upon being and staying compliant with these Rules.

3. Giveaway Period.

The Giveaway begins on November 14th, 2024, and ends on December 14th, 2024 (the “Giveaway Period”). Entries that are submitted before or after the Giveaway Period will be invalid and not considered.

4. How to Enter.

The Giveaway must be entered by submitting an entry form (each an “Entry”) on the official Giveaway site www.heartbeatofahunter.com during the Giveaway Period. Each Entry must fulfill all giveaway requirements, as specified, to be eligible to win a Prize. Entries that are incomplete or submitted without following the rules or specifications may be invalid or disqualified at the sole discretion of the Sponsor.

There is a limit of one (1) Entry per eligible person. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your entry may be removed from eligibility at the sole discretion of the Sponsor.

Any Entries received that are duplicate, mutilated, tampered with, incorrect, illegible, or from ineligible entrants will be void. All Entries become the property of the Sponsor and will not be acknowledged or returned.

All net proceeds of the Giveaway will benefit the Sponsor and will be used to support the conservation and protection of Bongos.

5. Earning Additional Points and Entries[RP1].

During the Giveaway Period, you will have the opportunity to earn additional points towards rewards or entries in the giveaway sweepstakes as defined by the parameters on the official giveaway site. These actions may include sharing with friends or engaging with the social media accounts of the Sponsor.

You may have the opportunity to send a unique link to your friends and family in exchange for additional points towards rewards and/or entries in the giveaway. In order to constitute a valid referral, your Contacts must: 1) sign up during the Giveaway Period; 2) use a valid email address to sign up; and 3) not already have an entry in the giveaway; 4) not be determined as fraudulent per the review of the Sponsor. Each valid (non-fraudulent) referral will earn you the defined number of points or entries in the giveaway.

6. Prize(s).

During, on, or about the end of the giveaway period Sponsor will select from the number of eligible Entries received, a certain number of Prize winner(s), and one (1) Grand Prize Winner. The Winner is solely responsible for any and all federal taxes, city, county & state sales taxes in connection with winning the Prize.

GRAND PRIZE WINNERS

At the end of the Giveaway Period, one (1) winner shall be selected to receive the Overnight trip PLUS.

PRIZE WINNERS

During, on, or near the end of the Giveaway Period, Sponsor may select several Entries to receive the Buc Buc Adventure.

7. Winner Notification

The Winner(s) will be selected by a random drawing, Sponsor will attempt to notify the potential winner(s) via email shortly upon drawing. If you are eligible for a Prize, you will be notified by email[RP2] . You will be required to respond to and formally accept the Prize within five (5) days of the date of notice or attempted notice is sent, in order to claim your Prize. If you cannot be contacted, or you fail to respond appropriately within the required time period, or the Prize is returned as undeliverable, you forfeit any rights to the Prize.

ANY VIOLATION OF THESE OFFICIAL GIVEAWAY RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN THE WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND WILL NO LONGER BE CONSIDERED AN ELIGIBLE PARTICIPANT.

8. Odds of Winning.

The odds of winning depend on the total number of Entries received. Limit of one (1) entry per eligible person.

9. General Conditions.

In the event that the operation, security, or administration of the Giveaway is impaired in any way for any reason, including, but not limited to fraud, technical problems, security malfunctions or in the event the Giveaway is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, Sponsor may, in its sole discretion, either: (1) suspend the Giveaway to address the impairment and then resume in a manner that best conforms to the spirit of these Rules; or (2) terminate the Giveaway In the event of termination, no individual shall be eligible for a Prize of any type.

Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the Giveaway or to be acting in violation of these Rules or in a disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Giveaway including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computing device in excess of that allowed by sweepstakes rules; or the use of bots, employed humans to create false entries, macros or scripts or other technical means for entering may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law.

A Winner cannot assign the Prize to another person for any reason. Sponsor reserve the right to substitute the Prize for whatever reason, if necessary.

10. Release and Limitations of Liability.

By participating in the Giveaway, you agree to release and hold harmless Sponsor, and each of its respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Giveaway, and each of their respective officers, directors, employees, shareholders, representatives, and agents (together, “Released Parties”) from and against any claim or cause of action arising out of participation in the Giveaway or receipt of a Reward, including, but not limited to: (a) any technical errors associated with the Giveaway, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, or wireless service provider; (b) unauthorized human intervention in the Giveaway; (c) mechanical human, printing or typographical errors; or (d) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Giveaway or acceptance, receipt or misuse of any Reward you may receive.

You further agree that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Giveaway.

10. Privacy & Information Submitted.

Any information you provide to Sponsor may be used to communicate with you in relation to this Giveaway or on a Giveaway Winner’s list. By entering the Giveaway you agree to receive email newsletters periodically from the Sponsor. You can opt-out of receiving these emails at any time by clicking the unsubscribe link in the newsletter. Information submitted in connection with the Giveaway will be treated in accordance with the Sponsor’s Privacy Policy.

11. Arbitration.

These Rules shall be governed by, and construed in accordance with, the laws of [Giveaway Sponsor Location], without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the Sponsor location.

Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any Reward awarded shall be resolved by binding arbitration, without resort to any form of class action, and exclusively by the appropriate court located in the giveaway home location. The parties agree to follow the arbitration procedures set forth by the American Arbitration Association (AAA) to resolve the dispute. Arbitration proceedings shall take place in the Giveaway home location. Each party is responsible for paying its own filing, administrative and arbitrator fees. Judgment on the arbitration award may be entered in any court having jurisdiction thereof.
