OFFICIAL RULES

NO PURCHASE NECESSARY: No purchase or payment of any kind is necessary to enter or win this sweepstakes. Purchase will not improve any entrant’s chance of winning.

Eligibility: The Vermont Teddy Bear Easter Bunny Giveaway (the “Promotion”) is open to legal residents of the United States and the District of Columbia, 21 years of age and older at the time the promotion begins. The Promotion is void where prohibited or restricted by law or regulations. Employees, contractors, officers, and directors of Vermont Teddy Bear (the “Sponsor”), their related brands, subsidiaries, affiliates, and their immediate family/household members are ineligible. Promotion is subject to applicable federal, state, provincial, and local laws and regulations, and void where prohibited, including, but not limited to, Puerto Rico, U.S. Virgin Islands, and U.S. military installations located in foreign countries and outside the United States, including Canada.

Promotional Period: Promotion runs from March 28, 2022 (6:00:AM PST) to April 17 2022 (11:59 PM PST) (the “Promotional Period”).

Agreement to the Official Rules: By participating in the Promotion, entrant warrants that he or she fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

To enter: Go to https://www.vermontteddybear.com/sweepstakes.html and complete the online entry registration form including all required information. NO PURCHASE IS NECESSARY, AND A PURCHASE DOES NOT IMPROVE YOUR CHANCE OF WINNING. Completed entries must be received by 11:59 PM PST on April 17, 2022 . Entries are limited to 1 entry per individual during the entire Promotional Period. Proof of email or online submission is not considered proof of delivery or receipt. All entries become the property of Vermont Teddy Bear Company.

Prizes, Number of Prizes, and Approximate Retail Value (“ARV”): There will be  (2) winners of a Teddy Bear or Bunny toy selected, with a retail value of up to $100 each for a total ARV of $200. There will be 1 grand prize winner of a Limited Edition Easter Bunny with a total retail value of $599.

Winners are responsible for all federal, state, and local taxes, if any, associated with installation, acceptance, or use of the Prize. Prizes are provided "as is" and without any warranty of any kind. Prizes are non-transferable.

No transfer or substitution of prizes (or any portion thereof) or cash alternative permitted, except the Sponsor reserves the right to substitute a prize of equal or greater value in the event the advertised prizes unavailable. Limit one prize per individual.

Shipping and handling for all prizes to the winners’ residential address in the United States will be paid for by Sponsor. 

 Odds: Odds of winning depend on the number of eligible entries received.

Winner Selection and Notification: 3 winners will be selected in random drawings on April 4, 2022, April 11, 2022, and a Grand prize awarded on April 19, 2022 in Shelburne, VT, from among all eligible entries received. All results of the selections are final and binding, subject to these Official Rules. In the event a winning entry is discovered to be invalid for any reason whatsoever or the person who submitted the winning entry fails to comply with these Official Rules prior to delivery of the Prize, the Prize may be forfeited and awarded to an alternate winner. If by reason of a printing, computer, or other error, more prizes are claimed than the number set forth in these Official Rules, all persons making purportedly valid claims will be included in a computerized random selection to award the advertised number of Prizes available. No more than the advertised number of Prizes will be awarded. A list of the winners may also be requested by emailing customerservice@vtbear.com after April 25, 2022.

Notice to Winner: Attempts to notify potential winners will be made by email within seven (7) days of the winner’s selection. Sponsor is not responsible for lost, stolen, late, or misdirected email or delivery or communication problems of any kind. If unable to make contact with the winner within seven (7) days after Sponsor first attempts to notify the winner, or if the winner fails to claim the prize within seven (7) days after Sponsor first attempts to notify the winner, the Prize may be forfeited. Prize not guaranteed to arrive by Easter.

General Conditions: This sweepstakes is governed by the laws of the United States. All taxes on prizes are the sole responsibility of the winners. Sponsor reserves the right to suspend or cancel the Sweepstakes or modify these Official Rules as necessary for any reason or as required by applicable law.

Entries not in compliance with these Official Rules are disqualified. Sponsor shall have the absolute right to determine if an entry is in compliance with these Official Rules without notice to the person attempting to enter. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

In the event of a dispute as to any entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. A potential winner may be required to show proof of being the authorized account holder. Sponsor assumes no responsibility for undeliverable emails resulting from any form of active or passive email filtering by an entrant's Internet service provider and/or email client or for insufficient space in entrant's email account to receive email.

Sponsor is not responsible for faulty, incorrect, or incorrectly transcribed email transmissions, incorrect codes or announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the Promotion, lost or unavailable network connections, or failed, incomplete, garbled, or delayed computer transmission that may limit an entrant's ability to redeem a prize, or any error that may occur in the processing of registrations or codes.

Except where prohibited, participation in the Promotion constitutes an entrant's consent for the Sponsor and the Sponsor's designees to use entrant's name, likeness, voice, opinions, biographical information, and city and state of residence for advertising, trade, publicity, and/or promotional purposes in any media, including the World Wide Web, without review, notification, or approval and without further compensation. Entry in the Sweepstakes further constitutes consent to the transfer of the personal information collected from the entrant to the Sponsor for the purposes of administering the Promotion and for such other purposes to which entrant may consent as outlined herein. Sponsor may collect information that entrants provide and will use personal information entrants provide to participate in the Promotion to actually conduct the Promotion. Sponsor and each of the Released Parties(defined below) may further use such personal information to send entrants information about themselves and/or their products, as provided in their privacy policies and may also share and cross-reference such personal information with each other. Entrants will be provided with an opportunity to opt-out of receiving this information at any time after they first receive such information from Sponsor or the Released Party.

Disputes/Choice of Law: Except where prohibited, each entrant agrees that this Promotion shall be governed by, and construed in accordance with, the laws of the Commonwealth of Vermont, without giving effect to any choice of law or conflict of law rules. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of this Promotion, including without limitation barring entrants who do not comply with these Official Rules. By entering, entrants consent to the jurisdiction and venue of the appropriate federal, state, and local courts located in Vermont for any and all disputes, claims, and causes of action arising out of or connected with this Promotion or any prize awarded.

Limitations of Liability/Release: By entering the Promotion, each participant warrants that he or she has read and agrees to abide by these Official Rules and that he or she is not prohibited from participating in the Promotion. Entrant agrees to release and hold harmless the Sponsor and their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion, or receipt, installation, assembly, or use of any prize, including but not limited to claims for or related to personal injury, death, property damage, publicity rights, defamation, or invasion of privacy. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Released Parties be liable for attorney’s fees, or for costs related in any way to installation or assembly of any prize.

The Released Parties assume no responsibility for lost, late, or misdirected entries, or for theft, destruction, or unauthorized access to, or alteration of, entries. The Released Parties are not responsible for any incorrect or inaccurate information, whether caused by website users, any of the equipment or programming associated with or utilized in the Promotion, or any technical or human error which may occur in the processing of submissions to the Promotion. The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players, or browsers, whether on account of technical problems, traffic congestion on the Internet or at any website, or on account of any combination of the foregoing. The Released Parties are not responsible for any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Promotion. If, for any reason, the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Released Parties which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, the Released Parties reserve the right at their sole discretion to cancel, terminate, modify, or suspend the Promotion and select a winner from among all eligible entries received prior to the cancellation.
