The Souper Food Contest

OFFICIAL RULES

Open to residents of Ontario ONLY

By entering this Contest, entrants agree to abide by these Official Rules. The decisions of the Sponsor with respect to all aspects of the Contest are final. 

1. NO PURCHASE NECESSARY. The Souper Food Contest (the “Contest”) is sponsored by Dairy Farmers of Ontario (the “Sponsor”).  The Contest begins at 12:00:00 AM Eastern Time (“ET”) on January 13, 2020 and ends at 11:59:59 PM ET on January 31, 2020 (the “Contest Period”).  

2. ELIGIBILITY:  The Contest is only open to legal residents of Ontario who are: (a) nineteen (19) years of age or older and (b) reside within Ontario, all at the time of entry (each an "Entrant"). Employees, representatives or agents (and their immediate family members and those with whom such persons reside, whether related or not) of the Sponsor and Administrator, and their respective governors, subsidiaries, affiliates, directors, officers, shareholders, agents, promotional parties (altogether the “Released Parties”) are not eligible to enter in the Contest. For purposes of this Contest, “immediate family members” shall include the mother, father, brothers, sisters, daughters, sons, partner or spouse of an individual (regardless of where any such “immediate family member” resides with such individual).

The Sponsor reserves the right, in their sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification showing that you have reached the age of majority) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification.

3. HOW TO ENTER THE CONTEST: During the Contest Period, visit https://swee.ps/KUrTyoqKj (the “Contest Website”) and complete the entry form (the “Entry Form”) with your full name, postal code , a valid email address, confirm compliance with these Official Rules and indicate whether you wish to receive future email notifications (which you can unsubscribe from at anytime) from the Sponsor regarding upcoming events and/or promotions (not mandatory for entry). Next, click the “Enter” button and you will receive one (1) entry (the “Entry”) into the Contest.

Additional Entries: Upon entering the Contest, you will receive the following options to earn additional entries (“Bonus Entries”) into the Contest.

During the Contest Period:

1. share the unique link (the “Link”) you received upon entering the Contest with up to ten (10) friends. You will receive two (2) Bonus Entries per friend (for a maximum of twenty (20) Bonus Entries) who clicks on the Link and enters the Contest. Referred friends must enter the Contest via the Link provided in order for you to receive the Bonus Entries.

There is a maximum of one (1) Entry and twenty eight (28) Bonus Entries per person during the Contest Period. Unsubscribing from any of the Sponsor’s notifications that are received during the Contest Period will not affect your Bonus Entries. All Entries must be received on or before 11:59:59 PM ET on January 31, 2020 (the “Contest Closing Date”).

The Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or Twitter. You understand that you are providing your information to the Sponsor (as defined below) and not to Facebook, Instagram or Twitter. The information you provide will only be used to administer the Contest in accordance with the Sponsor’s privacy policy. Facebook, Instagram and Twitter are completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Facebook, Instagram or Twitter. Only one (1) email account per person may be used. Anyone found to use multiple email accounts and/or social media accounts to enter will be ineligible. Proof of transmission (screenshots or captures, etc.) does not constitute proof of delivery. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Following on social media may require a mobile device and therefore message and data rates may apply. If entering the Contest via a mobile phone using your wireless carrier’s network, standard data charges from your wireless carrier may apply.

4. PRIZES: There are five (5) prizes (each a “Prize”) available to be won, each consisting of a Souper Food Prize Pack (each a “Prize Pack”) containing the following: one (1) professional grade 10 speed blender (includes one (1) 48-ounce/1.4-litre Container; one (1) Mini-Tamper and one (1) Cookbook) and one (1) $300.00 (CDN) prepaid gift card which may be used to purchase your favorite selection of Ontario dairy products. The approximate retail value (“ARV”) of each Prize is $749.95 (CDN). Only five (5) Prizes will be awarded. Prizes must be accepted as awarded without substitution and cannot be transferred, assigned or redeemed for cash. In the event a Prize (or any component thereof) cannot be awarded for any reason, the Sponsor reserves the right, in its sole discretion, to substitute another prize (or any component thereof) of equal or greater value, without liability. Any unused portion of a Prize will be forfeited and shall have no cash value. All characteristics and features of a Prize, except as otherwise explicitly stated above, will be determined by the Sponsor in its sole and absolute discretion.

5. DRAW: A random draw for the Prizes (the “Prize Draw”) will be held on February 03, 2020 at 10:00:00 AM (the “Prize Draw Date”) in Oakville, ON from among all eligible entries received by the Contest Closing Date. Odds of being selected depend on the total number of eligible entries received by the Contest Closing Date. The selected entrants will be contacted by email and/or telephone within two (2) business days of the Draw Date. If the selected entrant (a) cannot be reached by email and/or telephone within five (5) business days of being contacted; or (b) fails to correctly answer the skill testing question (see rule 6); or (c) fails to return the properly executed Release Form within the specified time (see rule 6), then he/she will be disqualified and another entrant will be randomly selected until such time as a Prize winner is confirmed or there are no more eligible entries, whichever comes first. The Sponsor will not be responsible for failed attempts to contact a selected entrant.

6. DECLARATION OF WINNERS AND AWARDING OF PRIZES: Prior to being declared a confirmed winner of a Prize, a selected entrant must correctly answer, unaided, an arithmetical, time-limited, skill testing question, to be administered at a mutually convenient time. Selected entrants will also be required to sign and submit the Sponsors' declaration and release, which (among other things): (a) confirms compliance with these Rules; (b) acknowledges acceptance of the Prize as awarded; and (c) releases the Released Parties from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize. If an eligible winner: (a) fails to submit the properly executed Contest documents, (b) cannot accept the Prize for any reason and/or (c) otherwise fails to comply with these Rules, then he/she will be disqualified (and will forfeit all rights to the Prize) , and consents to the use of his/her name, address (city and province) and/or photographs, without additional compensation, in connection with any publicity carried out by or on behalf of the Sponsor with respect to the Promotion.

7. GENERAL:  By entering the Contest, entrants agree to abide by these Official Rules and the decisions of the independent contest organization with respect to all aspects of the Contest, which are final. Each entrant hereby releases and agrees to discharge and hold harmless the Sponsor and the independent contest organization, their respective parent, subsidiary and affiliated companies, and each of their respective officers, directors, employees, agents, representatives, successors and assigns (the “Releasees”) from any claim or liability arising from or related to the participation in this Contest, including participation of such entrant in the Grand Prize, if applicable, to the full extent permitted by law.

8. All Entries become the permanent property of the Sponsor upon receipt and none will be returned. No correspondence will be entered into except with the selected entrants.  The Contest is subject to all applicable federal, provincial and municipal laws.

9. The Sponsor accepts no responsibility for loss, damage or claims caused by or resulting from the Contest or a Prize. By entering and/or accepting a Prize, each entrant consents to the use of his/her name, address (city) and/or photograph without further notice or remuneration, in connection with any publicity carried out by or on behalf of the Sponsor with respect to the Contest.

10. By participating in this Contest, each Entrant (i) agrees to be bound by these Rules; (ii) agrees to release and hold harmless the Released Parties from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action; and (iii) releases the Released Parties from any and all liability in connection with this Contest and his/her participation therein and his/her use of his/her Prize By entering the Promotion and, if applicable, completing the Release Form, the entrant agrees to release and hold harmless the Sponsor, its affiliated and related companies, business partners, advertising and promotional agencies, prize suppliers, and each of their respective directors, officers, employees, agents, representatives, successors and assigns and all others associated with the development and execution of the Contest (collectively, the “Releasees”), from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims and demands, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract, and fundamental breach and liability for physical injury, death, or property damage which an entrant or his/her administrators, heirs, successors or assigns might have or could have, by reason of or arising out of the selected entrant's participation in the Contest and/or in connection with the acceptance or use of the Prize. Released Parties make no warranty (express or implied), guaranty or representation of any kind concerning any Prize (or any portion thereof).

The Released Parties will not be liable for (i) any failure of any website during the Contest Period; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any entry to be received for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website or mobile network; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating or downloading any material in the Contest; and/or (v) any combination of the above.

The Sponsor reserves the right, in their sole and absolute discretion to withdraw, suspend or amend this Contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website associated with the Contest or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsors reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsors reserves the right, in its sole and absolute discretion to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason.

This Contest is subject to all applicable federal, provincial and municipal laws.

11. The Sponsor reserves the right, in its sole and absolute discretion and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or entry with these Rules, or as a result of technical problems, or in light of any other circumstances which, in the opinion of the Sponsors, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules.

12. In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to website, print and/or online advertising, the terms and conditions of these Rules shall prevail, govern and control.

13. CONSENT TO USE PERSONAL INFORMATION: The Sponsor respects your right to privacy. The information you provided will only be used for the purpose of administering this Contest and prize fulfillment.
