PromoGon and Eligibility:

1. The “Win 1 of 4 Taylormade Golf Club Sets & Custom Volando Bags” promoEon (promotion) is conducted by Volando Tequila LLC of 400 S Pointe Drive, Apt 707 Miami Beach, FL 33139 (Promoter).
   
   
2. Information on how to enter and the prize(s) form part of these Terms & Conditions. Participation in the Promotion is deemed acceptance of these Terms and Conditions.
   
   
3. IMPORTANT: THE PROMOTION IS OPEN TO PERSONS AGED 21 YEARS AND ABOVE WHO ARE RESIDENTS OF THE UNITED STAES ONLY. EXCLUDES RESIDENTS OF TEXAS
   
   
4. Employees (and their immediate families) of the Promoter, and agencies associated with the Pro moEon are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, d e-facto spouse, child or step-child (whether natural or adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister, or first cousin.

How to Enter:

1. To enter the Promotion, an entrant must enter the requested details in the golf sweepstakes page https://volandotequila.com/pages/golf-sweepstakes including the entrant’s first name, last name, email, state and date of birth.
   
   
2. The Promotion is open from 12:01am Eastern Time Thursday 1st August 2024 and closes at 11:59pm Eastern Time on Monday 30th September 2024 (Promotional Period). Entries received after this time will not be included in the Promotion. All persons.
   
   
3. The Promotion is only open to persons aged 21 and over, and who are resident of the United States, excluding residents of Texas.
   
   
4. Each individual may enter the Promotion as many times as they wish. All costs associated with entry into the Promotion are the responsibility of the entrant.
   
   
5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached these Terms & Conditions, tampered with the entry process, or engaged in any unlawful or other improper or bad faith conduct designed to jeopardise the fair and proper conduct of the PromoEon. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from any such individual are reserved.
   
   
6. Once the Promotion has closed, four entries for each of the 4 prizes (4) (each a Prize) will be selected at random from all registered entrants during the PromotionalPeriod. The draw will take place at Level 1, Suite 1 Victoria Square Apartments 15 Victoria Avenue BROADBEACH 4218, Australia at 3:00pm AEST on Tuesday 1st October 2024. The first drawn entry for each Prize will be the respective winner (Winner). The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn, or if a Winner does not claim their Prize.
   
   
7. Following the draw, one of the Promoter’s representatives will contact the respective Winner on the email address provided with the entry and will also send an email to the email address provided with the entry. If the entry is ineligible based on these Terms & Conditions, the Promoter reserves the right to withdraw the Prize and award it to another entrant in accordance with these Terms & Conditions.
   
   
8. If the Promoter is unable to contact the Winner within 7 days of the date of the draw using the contact details provided with the entry the Prize will be forfeited and will be awarded to the next additional reserve entry drawn under Section .7 above.
   
   
9. The Promoter may publish and publicise the Winner’s name, image, social media handle and/or profile picture, the Winner’s nearest geographical location (for example, the Winner’s nearest city, town or county), and the Promoter may refer to the Entrant’s (and any applicable third party’s - for example a guest who participates in redemption of a Prize) association with the PromoEon and/or the Prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes solely in connection with the Promotion. The Entrant grants the Promoter the right to use the Entrant’s name, likeness, image, and voice and will procure that all the Entrant’s guests who participate in redemption of a Prize also grant such rights to the Promoter in connection with the foregoing.

Prize:

1. The promotion consists of 4 prize packs of equal value and include one (1) complete set of Taylormade golf clubs and one (1) custom Jones Sports stand bag with custom Volando pocket embroidery:
2. The total value of each Prize is approximately $2,800 USD
   
   
3. If the Prize (or any part of it) is unavailable the Promoter may substitute the Prize (or such part of it) with a prize to the equal value and/or specification, subject to any written directions for a regulatory authority of competent jurisdiction.
   
   
4. The Prize, or any unused portion of it, is not transferable or exchangeable and cannot be taken as cash.
   
   
5. Any other costs and expenses which are not specifically included in the Prize description are excluded and will be the sole responsibility of the winner. By way of example, without limitation, the following are not included within the Prize: Additional customisation, overseas shipping, return of prize.
   
   
6. A draw for any unclaimed Prizes may take place on Monday 8th October 2024 at the same time and place as the original draw, subject to any directions from a regulatory authority of competent jurisdiction. Winners of an unclaimed Prize, if any, will be notfied in accordance with Section 11 above and the Winner’s name will be published on the Promoter website.

General:

1. If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention, or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate, or cancel the Promotion.
   
   
2.     Nothing in these Terms & Conditions limits, excludes, or modifies, or purports to limit, exclude, or modify the statutory consumer guarantees as provided under the Federal and State Consumer Laws as well as any other implied warranties under similar consumer protection laws in the United States. Nor does anything in these Terms & Conditions purport to limit, exclude, or modify, or purport to limit, exclude, or modify any law or regulation of any other territory applicable to the Promotion that cannot be limited, excluded, or modified. All other warranties and guarantees are excluded to the maximum extent possible at law. Except for any liability that cannot be excluded by law, the Promoter (including its directors, officers, employees, and agents) excludes all liability (including for negligence), for any personal injury, and for any loss or damage (including loss of opportunity) whether direct, indirect, special, or consequential, arising in any way out of the Promotion.

4. This Promotion is governed by the Sweepstakes Bonding and Registration laws of the required states,Florida, New York, Rhode Island. Each entrant submits to the non-exclusive jurisdiction of the courts exercising jurisdiction in that State. Nothing in these Terms & Conditions purports to exclude the laws of, or jurisdiction of the courts of, any state in which the Promotion is conducted to the extent such laws or jurisdiction cannot be so excluded.

Data Protection:

1. Entrants’ personal data, and the personal data provided to the Promoter by the entrant or by such individual directly, will be collected and processed by the Promoter and may be disclosed to partners involved in the Promotion, as well as the Prize providers, and if applicable, the Promoter’s service providers, payment providers and suppliers in order to administer and fulfil the PromoEon. Such personal data may also be disclosed to relevant regulatory authorities at their reasonable request for regulatory purposes, for example, in order to prevent, investigate and detect crime, fraud or anE-social behaviour and comply with law enforcement agencies and applicable advertising codes.
   
   
2. The Promoter may hold entrant’s personal data for a period of 2 years in order to comply with its regulatory obligations.
   
   
3. Entrants may be asked if they want to opt-in to marketing from the Promoter or its promotional partners when the entrant enters the PromoEon. If the entrant chooses to opt-in, the Promoter and/ or its promotional partners (as applicable) will use the entrant’s personal data for marketing purposes.
   
   
4. By entering the PromoEon, entrants acknowledge that any personal data provided by the entrant in connection with the PromoEon will be processed as set out above and in accordance with the Promoter’s Privacy Policy which sets out full details of how the Promoter processes personal data and how entrants can exercise their rights as a data subject. Entrants should read and understand the Privacy Policy before entering the Promotion.
   
   
5. Persons whose data the Promoter holds may request the removal of their personal details from the Promoter’s database by contacting ino@volandotequila.com If an entrant requests that their personal details be removed prior to the conclusion of a PromoEon, the entrant will forfeit their right to enter the PromoEon and/or claim any Prize, as applicable.
   
   
6. If the entrant is required to submit a guest’s personal data to enter the PromoEon, the entrant must ensure that the guest(s) have given the entrant consent to provide the Promoter with their personal data.
