Silencer Shop Contest Rules

By entering or attempting to enter or participate in any contest, sweepstakes, or giveaway (“Contest”) conducted by Hill Country Class 3, LLC d/b/a Silencer Shop (“Sponsor”) (each such individual is hereinafter referred to as “You” or “Participant”) agrees to be bound by the terms and conditions stated in these Official General Contest Rules (“General Rules”), as well as by Sponsor’s interpretations of these General Rules and Sponsor’s decisions relating to the Contest, which are final and binding in all matters relating to any Contest.  Some Contests will have specific rules published in connection with those Contests (“Specific Contest Rules”).  In the event of a conflict between these General Rules and the Specific Contest Rules for any particular Contest, the Specific Contest Rules shall control with respect to that Contest.

1. NO PURCHASE NECESSARY TO ENTER OR WIN.  A purchase will not improve your chances of winning.  If the Specific Contest Rules provide a free method of entry, then all submissions must be submitted as provided by the Specific Contest Rules.  If the Specific Contest Rules do not provide a free method of entry, then you may enter by sending an entry via first class U.S. mail, stating your full name, mailing address, email address, and the name of the contest to: Silencer Shop Contest Processing, c/o Marketing Department, 17414 FM 1431, Leander, Texas 78641.  All such entries must be postmarked within the Entry Period.  Any winning entries may be contacted via email; failure to respond to the email within one week (7 calendar days) may result in disqualification of the entry and another winner may be selected. Unless otherwise stated in the Specific Contest Rules, only one entry may be submitted per Participant per Contest; in any event, only one Contest entry is permitted per envelope for a mail-in entry and multiple entries will be disqualified if contained within a single envelope.  If a Contest accepts web entries, Participants must accurately complete all required fields or the entry will be deemed incomplete and will not qualify.

2. ENTRY: Contest entries may be submitted as advertised or otherwise prescribed by Sponsorfor the Contest. IF YOU PROVIDE YOUR EMAIL ADDRESS OR OTHER CONTACT INFORMATION AS PART OF YOUR ENTRY, YOU ARE PROVIDING THIS INFORMATION TO SPONSOR AND YOU CONSENT TO RECEIVE SPONSOR’S EMAILED NEWSLETTER AND OTHER PERIODIC MARKETING MATERIALS AND PROMOTIONS VIA EMAIL OR OTHERWISE.  YOU MAY REQUEST SPONSOR TO STOP THESE COMMUNICATIONS AT ANY TIME. Entries must be made during the time periods advertised or otherwise prescribed for each Contest (the “Entry Period”).  Entries that do not comply with the entry instructions or Specific Contest Rules, or that contain inappropriate or offensive content as determined by Sponsor in its sole discretion, will be disqualified. You may enter only once. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent these General Rules or any Specific Contest Rules. 

3. ELIGIBILITY: Open only to legal residents of U.S. states in which the sale, possession, and ownership of firearm silencers is legal.  Participants must be 21 years of age or older as of the beginning of the Entry Period.  Employees of Sponsor or Sponsor’s affiliates, subsidiaries, and agencies, and members of their immediate family or persons living in the same household are not eligible to participate. To be eligible to participate, all product and service prizes must comply with the legal and governmental requirements in your area and you must be legally allowed to receive and possess all Contest product and service prizes under all federal and applicable state and local laws and regulations in order to be eligible. If, at any time, Sponsor has reason to believe you cannot lawfully receive a prize, or if your application to take transfer of any prize is denied by any federal agency, your entry will be disqualified and you will not be eligible to participate in the Contest.  Participation in this Contest is void outside of the United States and where prohibited or otherwise restricted by law. Any silencer or firearm prize(s) will be transferred through the Silencer Shop Dealer Network to a participating FFL of the winner's choosing, in compliance with all applicable laws. The winner must pass the required NICS background check and any additional screenings as mandated by federal, state, or local authorities. The winner is responsible for completing all NFA transfer requirements, including submitting ATF Form 4 and obtaining a tax stamp prior to receiving any NFA-regulated prize(s). Silencer Shop and the giveaway organizers are not responsible for delays or denials in the ATF approval process.  All services provided by Silencer Shop pursuant to this Contest are subject to Silencer Shop’s standard Terms and Conditions for Sales and Services, located at TERMS AND CONDITIONS FOR SALES AND SERVICES - Silencer Shop.

4. DISQUALIFICATION.  All participants agree to be bound by these General Rules. Non-compliance with any of these General Rules may result in disqualification and all privileges as a Participant in such case will be immediately terminated. Sponsor, in its sole discretion, further reserves the right to disqualify any person for: (i) tampering with the entry process or the operation of the Contest; (ii) gaining an unfair advantage in participating in the Contest; (iii) obtaining winner status using false, fraudulent or deceptive means; or (iv) engaging in otherwise unsportsmanlike, disruptive, annoying, harassing, or threatening behavior.

5. ENTRIES ARE THE PROPERTY OF SPONSOR: All Contest entries and/or related submissions become the sole and exclusive property of Sponsor upon transmission. Contest entries will not be returned and may be used by Sponsor and any Promotion Party for any purpose whatsoever, without additional compensation to the Participant or any other individual or entity. FURTHERMORE, IF YOUR ENTRY INCLUDES THE SUBMISSION OF A PHOTOGRAPH, VIDEO, COMMENT, WRITTEN WORK, OR OTHER CREATIVE OR ARTISTIC WORK (THE “SUBMISSION WORKS”), YOU GRANT SPONSOR (AND THOSE AUTHORIZED BY SPONSOR) A ROYALTY-FREE, WORLD-WIDE, PERPETUAL, NON-EXCLUSIVE LICENSE TO PUBLICLY DISPLAY, PUBLISH, DISTRIBUTE, REPRODUCE AND CREATE DERIVATIVE WORKS OF THE SUBMISSION WORKS, IN WHOLE OR IN PART, IN ANY MEDIA NOW EXISTING OR LATER DEVELOPED, FOR ANY PURPOSE, INCLUDING, BUT NOT LIMITED TO, ADVERTISING AND PROMOTION OF SPONSOR’S OR OTHERS’ PRODUCTS, SERVICES, OR WEBSITE, EXHIBITION, AND COMMERCIAL PRODUCTS (THIS INCLUDES ANY SALES OF PRODUCTS UTILIZING THE PHOTOGRAPH), INCLUDING BUT NOT LIMITED TO SPONSOR PUBLICATIONS. SPONSOR WILL NOT BE REQUIRED TO PAY ANY ADDITIONAL CONSIDERATION OR SEEK ANY ADDITIONAL APPROVAL IN CONNECTION WITH SUCH USES.

6. SELECTION OF PRIZE WINNER(S): The prize winner(s) will be selected in accordance with the Specific Contest Rules as interpreted and determined in the sole discretion of Sponsor.  The Specific Contest Rules control over and supersede any conflicting portions of these General Rules.  

(a) If the Contest is a sweepstakes to be determined by random drawing, a random drawing will be conducted at the time specified in the Specific Contest Rules or else on or about the first business day after the close of the entry period, by which Sponsor will select the winners from among all eligible entries received. Odds of winning depend on the number of entries received. Potential winners will be notified via the method stated in the Specific Contest Rules and must respond within one week (7 calendar days) from the date of the direct message.  

(b) If the Contest is a contest of skill or quality of submission, such skill or quality will be determined in accordance with the factors or submission prompts stated in the Specific Contest Rules, and the determination will be by Sponsor at Sponsor’s sole and absolute discretion.  Sponsor reserves the right to disqualify any submission, regardless of skill or quality, which Sponsor determines, in its sole discretion, does not reflect the spirit or intentions of the Contest, or violates the values of Sponsor or the Second Amendment of the U.S. Constitution. 

(c) Participants may only win a Contest once every thirty (30) days from the date of selection. However, where a Participant has won a prize valued over $500, the Participant is ineligible to win another prize for a period of twelve (12) months from the date of selection. Participants who have won a Sponsor Contest in the last thirty (30) days or who have won prizes valued over $500 in the last twelve (12) months are ineligible.

(d) If requested by Sponsor, each winning Participant must sign and return a required Affidavit of Eligibility and Release within three (3) days of the date notice is sent or such other date set by Sponsor. Failure to respond within the applicable time period will result in forfeiture of prize and Sponsor shall have the option to award the prize to an alternate winner. The return of any prize notification or prize as undeliverable may result in disqualification and an alternate winner may be selected. 

(e) Sponsor reserves the right to cancel, terminate, modify or suspend any Contest if the Contest is not capable of being completed as planned for any reason, including, but not limited to, infection by computer virus, “bugs,” tampering, unauthorized intervention, fraud, or technical failures of any kind or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of any such Contest. The decision of Sponsor to cancel, terminate, modify or suspend any Contest shall be final in all respects.

(f) The Participant prize-winner is solely responsible for determining and paying all federal, state and local taxes (including any sales taxes). A winner may be required to fill out a 1099 tax release form.  All income taxes resulting from acceptance of prize are the responsibility of winner. Any other costs or expenses relating to the prizes are the sole responsibility of the winner.

(g) By entering this Contest, Participant accepts and agrees to the Specific Contest Rules as well as these General Rules and the decisions of the Sponsor, which shall be final in all matters. Acceptance of a prize also constitutes permission and consent to the Sponsor’s to use winner's name, likeness, and biographical information, as well as any other materials submitted in the Contest entry, for marketing purposes without further compensation or right of approval, unless prohibited by law. All federal and state laws apply.

7. LIMITATION OF LIABILITY: By entering any Contest, and as consideration for entering such Contest, Participant on behalf of Participant and all others claiming by, through, or on behalf of Participant releases, covenants not to sue, and holds harmless Sponsor, as well as Sponsor’s employees, owners, officers, parents, subsidiaries, affiliates, contractors, insurers, and agents (collectively the "Promotion Parties") from or for any claim, liability, loss, action of any type or nature (whether sounding in tort, contract, warranty, product liability, breach of privacy, misappropriation of likeness, or identity theft) damage (including punitive, incidental, and consequential damages), or expense (including attorneys' fees) arising out of or in connection with the Contest, Participant’s or any other person’s entry or participation in the Contest, the submission or acceptance of any Contest entry or Submission Works, the selection or determination of any winner, or the acceptance, use, or misuse of any prize, EVEN IF ALLEGED TO BE CAUSED BY THE SOLE OR PARTIAL NEGLIGENCE OR STRICT LIABILITY OF SPONSOR. Without limiting or otherwise diminishing the effect of the preceding language, Promotion Parties will not be responsible for: late, incomplete, or incorrect entries; a Participant's failure to receive prize notices due to Participant’s spam, junk e-mail, or other security settings or for Participant’s provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Contest; by any human error which may occur in the processing of the entries in this Contest; or any typographical, technological, or other error in the publishing of the offer, administration of the Contest, or announcement of the prizes. If, in the Sponsor’sopinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Contest, or if technical difficulties (including viruses and bugs) compromise the integrity of the Contest, Sponsor reserves the right, in its sole discretion, to cancel or modify this Contestin a manner deemed appropriate by the Sponsor. In the event of termination, winners will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning Participant, determination of the identity of the winner will be determined by Sponsor in its sole and binding discretion. 

8. INDEMNIFICATION.  Additionally, as consideration for entering the Contest, all Participants agree to INDEMNIFY, HOLD HARMLESS, AND DEFEND the Promotion Parties in any action or proceeding from and against all claims, damages, charges, injuries, losses, proceedings, suits, action of any type or nature (whether sounding in tort, contract, warranty, product liability, breach of privacy, misappropriation of likeness, or identity theft), expenses and attorney fees that they or anyone on their behalf (including but not limited to their heirs, representatives or next of kin) have or might have for any death, injury, damage or claimed injury or damage arising out of, involving or relating in any manner to their participation in the Contest or for their failure to comply with the terms of the above release provision. This agreement to indemnify, hold harmless and defend applies even if the act or omission complained of was allegedly caused in whole or in part by the strict liability or negligence in any form of the Promotion Parties.

9. PRIZES: The actual prizes and value of each prize will vary for each Contest. Descriptions of prizes will be announced for each Contest separately. Prizes consist of only those items specifically listed as part of the prize in the Specific Contest Rules. 

(a) Limit one prize per family or household. 

(b) No substitution or transfer of prize permitted by winner. Sponsor reserves the right to substitute a prize of equal or greater value. If a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner from among all remaining eligible entries. 

(c) In order to receive or use certain prizes, including but not limited to silencers, firearms, Full AutoTM or NFA services, and tax stamp credits, the winning Participant will need to have or create a Silence Shop account, and may need to provide additional information such as fingerprints, a photograph, demographic information, and other information required by federal law or regulation.  In such case, Participant must create a Silencer Shop account and provide all necessary information and materials in order to be eligible to claim the prize.  Participants must be lawfully able to receive and possess the prize to be eligible.  

(d) Sponsor makes no warranty, guaranty or representation or any kind concerning any prize and SPONSOR DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE.

(e) Winners may be required to execute an Affidavit of Eligibility/Release of Liability, a completed IRS W-9, Assignment of Submission Works, and a Publicity Release before any prize is awarded. By entering a Contest, Participant agrees to execute these documents if selected as a winner in order to receive their prize. Except where prohibited by law, failure to execute any of these documents or comply with any of these terms will result in forfeiture of the prize.

10. PUBLICITY.  Unless prohibited by applicable law, Participant authorizes and irrevocably grants, without compensation, to Sponsor and the other Promotion Parties (as defined above) permission to, from time to time, reference and discuss Participant and their participation in the Contest in publications and/or on their website(s) in photographs, video recordings, digital images, audio recordings, as well as in newsletters, news releases, other printed materials, and in materials made available on the Internet or in other media now known or hereafter developed for any purpose Sponsor and/or the Promotion Parties deem proper. Such reference and discussion may involve Participant’s name and voice, and other personal/biographical material or their participation on-air.

11. CHOICE OF LAW AND FORUM: Participant agrees that all matters arising out of or relating to the Contest, these General Rules, and any applicable Specific Contest Rules, including interpretation of any of the foregoing, are governed by, and will be construed in accordance with, the laws of Texas, without giving effect to any of its conflict of laws provisions. Participantfurther agrees that any legal suit, action, or proceeding arising out of or relating to this Contestand these General Rules shall be brought exclusively in the applicable federal or state courts located in Travis County, Texas.  Participant hereby irrevocably submits and consents to the exercise of personal jurisdiction over Participant by such courts for any matter, claim, lawsuit, action or proceeding arising out of or relating to the Contest, these General Rules, and any applicable Specific Contest Rules.

12. WAIVER OF JURY TRIAL.  PARTICIPANT IRREVOCABLY AND UNCONDITIONALLY WAIVES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY RIGHT PARTICIPANT MAY HAVE TO A TRIAL BY JURY IN ANY LEGAL ACTION, PROCEEDING, CAUSE OF ACTION, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THE CONTEST, THESE GENERAL RULES, AND ANY APPLICABLE SPECIFIC CONTEST RULES.

13. PRIVACY:  Information submitted with an entry is subject to the Privacy Policy stated at https://www.silencershop.com/silencer-shop-privacy-policy. 

14. WINNERS LIST: To receive a copy of these General Rules or the names of all prize winners(winners list available after four weeks from the end of the entry period), send a written request as well as a self-addressed, stamped #10 envelope to: Silencer Shop Contest Processing, c/o Marketing Department, 17414 FM 1431, Leander, Texas 78641. Limit one copy or list per Participant.
