TERMS OF SWEEPSTAKES

Sweepstakes begins at 12:00:01 a.m. Eastern Time (“ET”) on October 6, 2024, and ends at 11:59:59 p.m. ET on November 5, 2024.

1. ELIGIBILITY

Sweepstakes is open only to legal residents of the fifty (50) United States, the District of Columbia, or Puerto Rico, who are eighteen (18) years of age or older as of the age of majority in their state of residence (which is nineteen (19) in Alabama, Nebraska, twenty-one (21) in Mississippi, and eighteen (18) in all other states) as of the date of entry (the “Entrant”). Void outside of the fifty (50) United States, the District of Columbia, Puerto Rico, and where prohibited, taxed, or restricted by law. Employees, directors, managers, and employers of Skytails, LLC (the “Sponsor”), and each of its respective agents, subsidiaries, affiliates and related companies and their respective advertising and promotion agencies, consultants and agents, as well as immediate family members and/or those living in the same household of each, and any others engaged in the development, production, execution or distribution of said Sweepstakes, including American Sweepstakes & Promotion Co., Inc. (the “Sweepstakes Administrator”) (collectively the “Sweepstakes Entities”) are not eligible to participate. For purposes of this Sweepstakes, “immediate family members” shall be deemed to mean husband, wife, children, mother, father, sister, brother, grandparents, grandchildren, and in-laws (mother-in-law, father-in-law, brother-in-law, or sister-in-law). Sweepstakes may only be entered in or from the fifty (50) United States, the District of Columbia or Puerto Rico, and entries originating from any other jurisdictions are not eligible for entry. All applicable federal, state and local laws and regulations apply.

2. HOW TO ENTER

There are specific steps entrants must follow to be eligible to enter and win the Sweepstakes:

    1.    Follow Requirements: Entrants must follow all participating brands on Instagram and Facebook, including Skytails LLC (@pawsandpjs), Fable Pets (@fable), and Tidal Jets (@tidaljets).

    2.    Share the Post: Entrants must share the official Sweepstakes post on their Instagram and/or Facebook stories and tag each participating brand (@pawsandpjs, @fable, and @tidaljets).

    3.    Tag People in the Comments: Entrants must tag up to eight (8) people they would bring on the trip if they won in the comments of the official Sweepstakes post.

    4.    Complete Entry on Official Site: Entrants must visit www.tidaljets.com/giveaway and complete the entry form in its entirety, including first name, last name, mailing address, city, state, zip code, phone number, and email address.

Bonus Entries: Bonus entries will be awarded for any purchases made during the Sweepstakes Period. Purchasing specific items from Skytails LLC or affiliated brands, such as Skytails or Tidal Jets merchandise, will result in additional entries based on the value and quantity of items purchased. The more items purchased, the more bonus entries awarded. However, no purchase is necessary to enter or win. All entrants have a fair and equal chance to participate in the Sweepstakes without making a purchase. The purchase of goods merely increases the number of entries, thereby increasing the odds of winning but does not guarantee a win.

Weekly Entry Opportunity: In addition to the initial entry, there is a weekly entry opportunity where entrants can submit one additional entry per week. Multiple weekly entries or attempts to falsify accounts will result in immediate disqualification, and legal action may be taken if cheating or fraudulent activity is detected. Entrants found to be manipulating or tampering with the entry process, creating multiple identities, or using automated tools to enter will be permanently banned from this and all future Sweepstakes or promotions conducted by Skytails, LLC or any of the participating brands.

3. PRIZES

The Sweepstakes will have a total of ten (10) winners:

    •    One (1) Grand Prize Winner: The winner will receive a private jet charter valued at up to $15,000 (USD), valid for up to eight (8) passengers on a mid-sized jet within the contiguous United States, and a PR kit in collaboration with Fable Pets, including various items from toys/treats to leashes.

    •    Nine (9) Additional Winners: Each will receive a PR kit in collaboration with Fable Pets, including various items from toys/treats to leashes.

The Grand Prize private jet charter cannot be booked for eight (8) months and cannot be flown for a period of one (1) year from the announcement of the winner, which will take place on November 10, 2024, at 8:00 p.m. Eastern Time. This means that the winner will be eligible to book the charter starting July 10, 2025, with the first possible flight date being November 10, 2025. The charter trip must originate and terminate within the 50 contiguous United States. All prizes are non-transferable and may not be substituted or redeemed for cash. Winners are solely responsible for all applicable taxes and any other costs not specifically mentioned as part of the prize.

4. LIMITATION OF LIABILITY

By participating, entrants agree to release and hold harmless Skytails, LLC, Fable Pets, and Tidal Jets, Inc., and each of their respective parents, affiliates, subsidiaries, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property, including but not limited to death, resulting from participation in the Sweepstakes or receipt or use or misuse of any prize. Entrants agree that the Released Parties have no liability whatsoever for, and shall be held harmless by entrants against, any liability for any injuries, losses or damages of any kind, to persons or property, resulting in whole or in part, directly or indirectly, from participation in the Sweepstakes; from acceptance, possession, misuse or use of any prize; or from the downloading or use of any material downloaded or otherwise obtained through participation in the Sweepstakes.

5. DISPUTES

Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court or the appropriate Virginia State Court located in Virginia; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the State of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Virginia.

By entering the Sweepstakes, entrants agree to irrevocably waive any right to seek legal recourse against the Released Parties, including but not limited to the right to bring any claim, lawsuit, or legal proceeding for any damages or losses related to the Sweepstakes, whether under contract, tort, or any other legal theory.
