The Dearfoams® Game Night, 2024 “Sweepstakes” is sponsored by R.G. Barry Corporation and Promotional Partners, 13405 Yarmouth Road, Pickerington, OH 43147 (the “Sponsor”). You understand that you are providing your information to Sponsor and Sponsor Partners. Any questions, comments or complaints regarding the Sweepstakes should be directed to the Sponsor. Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which are legally binding and final on matters relating to this Sweepstakes. The entrant also unconditionally accepts and agrees to comply with our Privacy Policy, as stated on our website (https://www.dearfoams.com/privacy-policy.html) Sweepstakes is subject to all applicable Federal, State and Local laws.

ELIGIBILITY: 

The Sweepstakes begins at 9:00 a.m. ET on February 19, 2025, and ends at 11:59 a.m. ET on February 28, 2025 ("Promotion Period"). This Sweepstakes is open to legal residents of the United States contiguous 48 states, the District of Columbia, Alaska, Hawaii, the U.S. Territories and APO/FPO/DPO addresses who are eighteen (18) years of age or older at the time of entry. Employees, officers, and directors of Sponsor, and their subsidiaries, licensees, franchisees, distributors, dealers, sales representatives, their advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and each of their immediate family members and/or people living in the same household are not eligible to participate. In addition, anyone found to create or use multiple email addresses to enter will be ineligible. Void where prohibited or otherwise restricted by law. All eligibility is subject to all Federal, State and Local laws and regulations.

HOW TO ENTER: 

Visit Dearfoams.com, or a provide all required information on the form (email address, phone, and contact information), and click "submit information" button to enter Sweepstakes for your chance to win. Limit one (1) entry per person per email address. Email and phone number will be used to contact winners only unless otherwise expressed consent to receive ongoing marketing communication.

Sponsor reserves the right at its sole discretion to disqualify any individual (and his or her Sweepstakes entry) who tampers with the entry process. By entering this Sweepstakes, entrants accept and agree to be bound by these rules and the decision of the Sponsor, which shall be final on all matters. By submitting an entry to the Sweepstakes, the Sponsor reserves the right to use the content for marketing materials used for internal and external purposes. You may opt-out at any time of Dearfoams’ email program. If you are a new email subscriber, you will receive your first welcome email and offer within 48-96 hours of sign up. Sponsor reserves the right to cancel or modify the Sweepstakes if fraud or technical failures destroy the integrity of the Sweepstakes or for any other reason as determined by the Sponsor, in its sole discretion, and to award the prizes based on eligible entries received prior to the cancellation.

DRAWING/PRIZES/ODDS:

1 Winner will be randomly selected by Dearfoams®. The winners’ selection schedule is as follows from among eligible entries received between the Promotional Period and drawing dates outlined below:

The sweepstakes winner will be notified via email within approximately one (1) day of winner selection date. The person who entered may be required to execute and return an Affidavit of Eligibility/Liability/Publicity Release/Tax forms within two (2) days after notification date or prize may be forfeited. If prize notification is returned as undeliverable or winner cannot be located or does not respond within two (2) days of notification, prize will be forfeited, and a new winner will be selected at random.

PRIZE:

The Dearfoams® “Game Night” Sweepstakes prize pack consists of:

• Dearfoams X Monopoly Slippers for you and 4 of your closest friends or family members, retail value up to $220

• Monopoly Vintage Game, $44.95

• Dylan’s Candy ‘Millennial XL Tackle Box, $85

• DoorDash Gift Card, $100

Prizes will be mailed to each winner after successful completion of Affidavit of Eligibility/Liability/Publicity Release/Tax forms. The approximate retail value (ARV) of the winner’s prize pack is valued up to $450.00. The prize will be mailed to the winner only and not to multiple addresses.

The sponsor is not responsible if prize is lost or stolen. This prize is not redeemable for cash. Vouchers will not be reissued for any reason. Winner is responsible for all expenses associated with prizes not specified herein. Odds of being deemed a winner are determined by the number of eligible entries received. Any and all income taxes on the prizes are the responsibility of the winner.

GENERAL CONDITIONS:

All entrants agree to release and forever discharge Sponsor, and its respective distributors, advertising, promotion and advertising agencies, and their affiliates and subsidiaries and the respective employees, directors, and officers of the foregoing entities (“Released Parties”) from any and all claims, demands, losses, and liabilities, of any nature whatsoever, which they may now or hereafter assert, including but not limited to, claims for injury, death, damages, or illness arising out of or claimed to be arising out of Sweepstakes entry, prize acceptance, or use or misuse of the prize. Released Parties and their agents are not responsible for any printing or other errors in Sweepstakes-related material. Released Parties reserve the right, in their sole discretion, to cancel or suspend this Sweepstakes and award the prize in a random drawing from among all eligible entries received prior to such action, should causes beyond the control of Released Parties corrupt the administration, security, or proper play of the Sweepstakes. Information provided by the consumer will be used solely for the purposes of this Sweepstakes and will not be rented, sold, or relinquished. Sponsor undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of the prize awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident, or damage, direct or indirect, relating to or arising out of the Sweepstakes, including (but not limited to) cancellations, postponements, delays, or other scheduling changes; missed events or connections or inability of winner to attend; and accident, injury, death, damage, or expense arising from or occurring during the use of the prize, or travel to/from or attendance at any event relating to the Sweepstakes, by the winner and/or winner’s guest(s). Sponsor is not responsible for damage to a prize or loss of a prize after the prize has been claimed.

GOVERNING LAW/JURISDICTION:

The Sweepstakes is governed by, and will be construed in accordance with, the laws of the State of Ohio, and the forum and venue for any dispute shall be in Ohio if the controversy or claim is not otherwise resolved through direct discussions or mediation.
