Terms and Conditions: Tropical Getaway in Ibiza

OFFICIAL RULES

Tropical Getaway in Ibiza (the “Competition”). The Competition is sponsored by Black Tomato Ltd. (the “Sponsor”) and our marketing partners The Zoe Report, Afar Media, and Oyster Travel Corporation (the “Promoters”).

One winner will be randomly drawn for the one prize that is offered. Substitutions are not permitted.

To enter, visit the Competition page at < http://swee.ps/DJqfbqmFB > to enter your name, email address, and location of residence. All information provided by entrant must be complete, true and correct. Submissions to the Competition must be received by the ending time stated in these rules in order to be eligible; entries received after the deadlines will be deemed ineligible to win. All submitted entries become the property of Sponsor and will not be acknowledged or returned; Sponsor is not responsible for lost, late, inaccurate, incomplete, damaged, illegible, or misdirected entries. Entries are limited to one entry per person. Each entrant can receive up to three (3) additional entries by sharing a tweet, liking the listed Twitter Account and Instagram Account. Additional entries on Facebook are not permitted. Entries will be deemed submitted by the authorized account holder of the email address submitted at the time of entry. By entering, you agree to be bound by these Official Rules.

By submitting your email address, you will automatically be entered into the Competition. In addition, Black Tomato, The Zoe Report, Afar Media, and Oyster Travel Corporation will collect, share with each other, and use your email address for the purpose of providing you with direct email marketing. You can stop receiving marketing emails from any or all of these organizations at any time by clicking the unsubscribe link at the bottom of any emails.

The Competition prize is non-refundable, non-transferable, has no cash alternative and has no cancelation value once booked. There is one (1) prize to be won valued at a minimum total of US$4,300 (US$2,150 per person). Prize includes:

Roundtrip economy class flights from major US airports

The Sponsor will pay up to US$800 per ticket/guest

Four nights’ accommodation at the Nobu Hotel Ibiza Bay

Complimentary local transfers to and from the Ibiza Airport and Nobu Hotel Ibiza Bay

Blackout dates apply to flights and additional blackout dates may apply to the four-day prize offered by Black Tomato Limited. Additional conditions apply. Suppliers may require agreement and compliance with additional conditions. Please read these rules completely.

Approximate prize value: $4,300

The earliest that flight reservations may be confirmed is 45 days prior to the departure date. 

Winner and his/her companion must be the same persons during the combined flights and accommodation. Winner and companion must both be 18 years of age or older.

Prize does not include food, supplies, spending money or expenses. All other expenses and costs not expressly listed in the prize description above, including but not limited to, food and beverages, gratuities, travel to and from airports, entertainment, ground transportation, applicable taxes (including any income taxes on the value of the Prize), travel insurance are the Competition Winner’s sole responsibility.

The Competition is open to those aged 18 or over, excluding employees of Black Tomato Limited and The Zoe Report, Afar Media, Oyster Travel Corporation, their families, cohabitants, agents and anyone connected to the promotion.

This Promotion is only open to legal residents of the 50 United States and District of Columbia who are at least 18 years old as of the date of entry, except officers, directors, members, and employees of the Sponsors, or any other party associated with the development or administration of this Competition, and their immediate family (i.e., parents, children, siblings, spouse), and persons residing in the same household, as such individuals. This Promotion is void outside the 50 United States and the District of Columbia, and where prohibited.

Entries will be accepted beginning at 12:45 AM EST on August 1, 2017. The closing date for entry to the Competition is August 23, 2017 at 11:59 PM EST. Winner will be announced before midnight September 6, 2017.

The winner will be notified via email. Winner must accept their prize by 11:59 PM EST on September 12, 2017. In the event that the prize is not accepted, the winner will be redrawn.

Prize and travel must be confirmed by winner before 5:00 PM EST on October 15^th, 2017 through Black Tomato.

All flights, accommodation, and travel are subject to booking and flight availability. Dates will be at the discretion of the tour provider. Blackout dates are included between 19th December 2017 – 5th January 2018, 1^st August 2017 – 1^st November, 2017. A limit of only one registration / entry per person will be accepted.

All prize travel will be subject to the flight carrier’s Conditions of Carriage. Additional conditions apply. Suppliers may require agreement and compliance with additional conditions.

All federal, state and/or local income and other taxes, on air flights and car transfers, if any, are the winner’s sole responsibility.

All federal, state and local laws and regulations apply; void where prohibited. NO PURCHASE IS NECESSARY; A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Odds of winning depend upon the number of eligible entries received. ONLY ONE PRIZE PER WINNER. NO CASH OR OTHER SUBSTITUTIONS ARE PERMITTED, EXCEPT BY SPONSOR, WHO RESERVES THE RIGHT TO SUBSTITUTE THE PRIZE WITH ONE OF EQUAL OR GREATER VALUE. Modifications are not permitted.

Competition results and/or a copy of these Official Rules may be obtained by emailing info@blacktomato.com and including in the subject line, “Tropical Getaway in Ibiza: Request for Rules and Results,” and the requested information will be sent via email. Alternatively, where permitted by law, you may send a self-addressed, stamped envelope to Tropical Getaway in Ibiza c/o, Black Tomato Ltd.,40-42, 1^st Floor, Scrutton St, London EC2A 4PP. All requests must be received no later than August 23, 2018.

Registrations must be completed by the registrant only. Registrations made by any other individual or any entity, including but not limited to commercial competitions, subscription, notification and/or entering service sites, will be declared invalid and disqualified from this draw. The use of any device to automate the registration process is prohibited.

Black Tomato reserves the right to select an alternative winner, remove an entrant or withhold or modify a prize in the event that there are reasonable grounds for believing that a winner or entrant has contravened any term or condition of entry or in the event that Black Tomato has reasonable grounds for believing that the winner or entrant has acted or may act in a manner that could damage the reputation of Black Tomato or any of the partners, any company associated with Black Tomato, or any brand or product associated with either Black Tomato, or any affiliate companies. Black Tomato shall not be required to provide any explanation in the event of it exercising any of its rights under this paragraph.

No responsibility can be accepted for entries lost, delayed, misdirected, damaged or undelivered. Incomplete, inaudible, unsuitable and/or illegible entries will be disqualified. Black Tomato or any of the partners involved shall not be responsible for technical errors in telecommunications networks, internet access or otherwise preventing entry to any competition.

By entering the Competition, each entrant releases and discharges the Black Tomato, The Zoe Report, Afar Media, Oyster Travel Corporation, judging organization (if applicable), and any other party associated with the development or administration of this Competition, their parent, subsidiary, and affiliated entities, and each of their respective officers, directors, members, shareholders, employees, independent contractors, agents, representatives, successors and assigns (collectively, “Sponsor Entities”), from any and all liability whatsoever in connection with this Competition, including without limitation legal claims, costs, injuries, losses or damages, demands or actions of any kind (including without limitation personal injuries, death, damage to, loss or destruction or property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, “Claims”). SPONSOR ENTITIES MAKE NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS THIS PROMOTION OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY PRIZE OR ANY COMPONENT OF ANY PRIZE.

The Competition prize winner may be required to participate in any post-event publicity.

By registering, all participants will be deemed to have accepted and be bound by these Terms and Conditions. All entry instructions form part of these Terms and Conditions.

Black Tomato Ltd reserve the right to change these Terms and Conditions at any time.

Our decisions are final and we reserve the right not to enter into detailed responses with you.
