1. Eligibility: Giveaway (the "Giveaway") is open only to those who sign up at the online giveaway page and who are at least 18+ years old at the time of entry. The giveaway is open to the legal residents of the United States and is void where prohibited by law. Employees of Get Away Today (the "Sponsor"), Disney Destinations, LLC (“Disney”), and their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Giveaway. Sponsor is the sole sponsor of the Giveaway. The Giveaway is not sponsored or co-sponsored by Disney, which is acting solely as a provider of certain prizes (as described in Section 5, below).  The Giveaway is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

2. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Get Away Today, as final and binding as it relates to the content. The Giveaway is subject to all applicable federal, state and local laws.

3. Giveaway Period: Entries will be accepted online starting on or about 3/12/2024 at 2024-03-12 00:00:00 and ending 3/22/2024 at 2024-03-22 23:59:00. All online entries must be received by 3/22/2024 at 2024-03-22 23:59:00. All times are (GMT-07:00) Mountain Time (US & Canada).

4. How to Enter: 1. Visit the “Get Away Today to the Magic” Giveaway landing page 2. Complete all Giveaway Entry Methods: Subscribe to Get Away Today’s email newsletter, SMS marketing, and Follow Get Away Today on Instagram, Facebook, or TikTok 3. Post a video on Instagram or TikTok following the prompt “Post a video of how you would react if you could Get Away Today" OR "Post a video of your favorite Disney memory" using the #getawaytodaytothemagic hashtag. 4. Tag Get Away Today (@getawaytoday) in your video on Instagram or TikTok. 5. Wait for the Winner to be contacted on or before March 29, 2024.  The Giveaway must be entered by submitting an entry using the online form provided on this site and posting a video using the Giveaway prompt on Instagram and TikTok. Please note that if/when posting a video with additional adult(s) (18+) other than the individual who shared the content, all adult individual(s) must provide consent before the video can be shared/posted. The entry must fulfill all giveaway requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Get Away Today. You may enter only once and you must fill in the information requested. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Get Away Today.

User Generated Content. In connection with the Giveaway, you may be asked or allowed to communicate, submit, upload or otherwise make available text, chats, images, audio, video, Giveaway entries or other content (“User Generated Content”), which may be accessible and viewable by the public. Whether the Giveaway appears on Sponsor’s website, service and/or platform or is integrated with a third-party website, service, application, and/or platform, you may not submit or upload User Generated Content that is defamatory, harassing, threatening, bigoted, hateful, violent, vulgar, obscene, pornographic, or otherwise offensive or that harms or can reasonably be expected to harm any person or entity, whether or not such material is protected by law.

In most instances, neither Sponsor nor Disney claims ownership of your User Generated Content; however, you grant each of Sponsor and Disney a non-exclusive, sublicensable, irrevocable and royalty-free worldwide license under all copyrights, trademarks, patents, trade secrets, privacy and publicity rights and other intellectual property rights for the full duration of those rights to use, reproduce, transmit, print, publish, publicly display, exhibit, distribute, redistribute, copy, index, comment on, modify, transform, adapt, translate, create derivative works based upon, publicly perform, publicly communicate, make available, and otherwise exploit such User Generated Content, in whole or in part, in all media formats and channels now known or hereafter devised (including in connection with the Giveaway and on third-party websites, services, applications, and/or platforms), in any number of copies and without limit as to time, manner and frequency of use, without further notice to you, without attribution (to the extent this is not contrary to mandatory provisions of applicable law), and without the requirement of permission from or payment to you or any other person or entity. You agree that submission of User Generated Content does not establish any relationship of trust and confidence between you, on the one hand, and Sponsor or Disney, on the other hand, and that you have no expectation of compensation whatsoever (except as may be specifically stated in the provisions of the Giveaway in connection with the submission, or arising from it).

You represent and warrant that your User Generated Content conforms to these Rules and that you own or have the necessary rights and permissions including, without limitation, all copyrights, music rights and likeness rights (with respect to any person) contained in the User Generated Content, without the need for payment to any other person or entity, to use and exploit, and to authorize each of Sponsor and Disney to use and exploit, your User Generated Content in all manners contemplated by these Rules; and you agree to indemnify and hold each of Sponsor and Disney harmless from any claims or expenses (including attorneys’ fees) by any third party arising out of or in connection with our use and exploitation of your User Generated Content resulting from your breach of these Rules. You also agree to waive and not to enforce any moral rights, ancillary rights or similar rights in or to the User Generated Content against Sponsor, Disney or their respective licensees, distributors, agents, representatives and other authorized users, and agree to procure the same agreement to waive and not to enforce from others who may possess such rights.

To the extent that you are authorized in connection with the Giveaway to create, post, upload, distribute, publicly display or publicly perform User Generated Content that requires the use of Disney’s copyrighted works, Disney grants you a non-exclusive license to create a derivative work using the specifically referenced copyrighted works as required for the sole purpose of creating such a work, provided that such license shall be conditioned upon your assignment to Disney of all rights worldwide in the work you create for the duration of copyright in the User Generated Content, in all formats and media known or unknown to date, including for use in the Giveaway and on third party sites and platforms. If such rights are not assigned to Disney, your license to create derivative works using our copyrighted works shall be null and void.

Each of Sponsor and Disney may monitor, screen, post, remove, modify, store and review, or may cause to be monitored, screened, posted, removed, modified, stored and reviewed, User Generated Content or communications submitted in connection with the Giveaway, at any time and for any reason, including to ensure that the User Generated Content or communication conforms to these Rules, without prior notice to you. Sponsor may disqualify, or Disney may require Sponsor to disqualify, your entry and participation in the Giveaway if your User Generated Content violates these Rules, including unlawful postings or content, without prior notice to you. Neither Sponsor nor Disney shall be responsible for, nor endorses or guarantees, the opinions, views, advice or recommendations posted or sent by users.

5. Prize: The approximate retail value of the prize is $7,000. The prize is a vacation package for winner and up to three (3) guests consisting of: (1) 4 nights’ accommodations in one (1) standard room at a Disney Moderate Resort hotel of Disney’s choosing at the Walt Disney World Resort for up to four (4) individuals; (2) up to four (4) 5-Day Theme Park Tickets; (3) roundtrip airfare for four (4) individuals to/from Orlando International Airport (MCO) departing from any airport in the United States of America; (4) Lyft transportation to/from Orlando International Airport (MCO) to Walt Disney World Resort;  (5) a $500 Disney Gift Card for the winner; and (5) a Character Dining experience at the Walt Disney World Resort, to be selected by Disney in its sole and absolute discretion, for up to four (4) individuals. This prize can only be redeemed for travel on May 1 - May 5, 2024. This prize cannot be redeemed for any other timeframe or travel period other than the date(s) listed above. You are not guaranteed to win a prize and your chance of winning is dependent on the total number of eligible entries received. Actual/appraised value may differ at time of prize award. Any costs associated outside of the prizes stated above will be the sole responsibility of the individual winner. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor's discretion. The prize is non transferable. The prize is fulfilled in part by Disney. Any and all prize related expenses, including without limitation any and all federal, state, and local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winner is permitted. Acceptance of prize constitutes permission for Get Away Today to use winner's (and additional participants’) name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

Terms and Conditions applicable to Disney prize components:

•  Package must arrive on May 1, 2024. Travel must be completed by May 5, 2024.  The requested arrival date is subject to Disney’s approval in Disney’s sole and absolute discretion. Disney will require that the accommodations be used during a period of greater room availability.

•  Arrangements must be made a minimum of 30 days prior to the intended travel dates.  Party must contain a minimum of one adult over the age of 18. 

•  To enter a park, both a park reservation and valid admission for the same park on the same date are required for Guests ages 3 and up. To learn more, please visit https://disneyworld.disney.go.com/experience-updates/park-reservations/.

•  Theme park reservations and admission are not guaranteed.

•  Certain parks, hotels, restaurants, events, experiences and other offerings may be modified or unavailable, limited in capacity and subject to limited availability or closure, and park admission and offerings are not guaranteed.

•  All tickets and options are nontransferable and nonrefundable and exclude activities/events separately priced.

•  Any lost or stolen tickets, gift cards or vouchers, including this voucher, will not be replaced.

•  Parking is not included.

•  Any element of the Vacation Prize may be substituted for equal or greater value at Disney’s sole discretion.    

•  Actual final retail value of Vacation Prize may be higher or lower.  Winner will not receive difference between actual final and approximate retail value.

•  Disney Gift Cards are subject to all terms and conditions available at www.disneygiftcard.com/ProductInformation/Terms.

6. Odds: The odds of winning depend on the number of eligible entries received.

7. Winner selection and notification: Winner of the Giveaway will be selected by a predetermined Committee under the supervision of the Sponsor. The Committee will select a Winner based on the following criteria/guidelines: 25% Creativity, 25% Execution of the Prompt, 25% Positive Messaging, 25% Quality/Effort. Winner will be notified via e-mail to the e-mail address they entered the Giveaway within five (5) days following the winner selection. Get Away Today shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected. The receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal and state laws and regulations. Giveaway Winner must abide by Travel Trade Influencer Guidelines while onsite at the Walt Disney World Resort and whenever publicly posting or sharing about the Giveaway. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

8. Rights Granted by you: By entering this content you understand that Get Away Today, anyone acting on behalf of Get Away Today, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Giveaway, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

9. Terms: Get Away Today reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Giveaway should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. In such a case, Get Away Today may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Get Away Today. Get Away Today reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Terms & Conditions.

Get Away Today has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void votes for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by giveaway rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the giveaway may be a violation of criminal and civil laws and should such an attempt be made, Get Away Today reserves the right to seek damages from any such person to the fullest extent permitted by law.

10. Limitation of Liability: By entering you agree to release and hold harmless Get Away Today, Disney Destinations, LLC, and their respective subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

11. Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF United States of America AND Utah, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Utah having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway), and participant further waives all rights to have damages multiplied or increased.
