ScubaTony Cozumel Sweepstakes – Official Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1. Eligibility

The Sweepstakes (the “Sweepstakes”) is open to individuals who sign up through the official online entry form and who are at least 18 years old at the time of entry.

The Sweepstakes is open internationally unless prohibited by law. Employees of ScubaTony, Stingray Villas Cozumel, participating partner businesses, and their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members or household members are not eligible to participate.

The Sweepstakes is subject to all applicable laws and regulations and is void where prohibited by law.

2. Agreement to Rules

By participating, entrants agree to be fully and unconditionally bound by these Official Rules and represent that they meet the eligibility requirements stated herein.

Participants also agree to accept the decisions of ScubaTony, which are final and binding in all matters related to the Sweepstakes.

3. Sweepstakes Period

The Sweepstakes begins March 15 and ends April 15 at 11:59 PM (GMT-5).

All entries must be received before the closing time to be eligible.

4. How to Enter

Entrants may enter by submitting the official entry form on the Sweepstakes webpage.

Participants may also earn additional entries by completing optional promotional actions, such as following or engaging with participating businesses on social media platforms.

Entry requirements:

• Only one primary entry per person is permitted.

• Additional entries may be earned through approved actions listed on the entry page.

• Use of multiple identities, email addresses, or devices to circumvent the rules may result in disqualification.

• Fraudulent methods, automated entry systems, bots, or manipulation of the promotion may result in removal from eligibility at the sole discretion of the Sponsor.

5. Prizes

The approximate total retail value of all prizes is $3,000 USD.

Prize details will be listed on the Sweepstakes entry page and may include diving experiences, accommodations, services, excursions, or products provided by ScubaTony and participating partner businesses in Cozumel.

Prizes:

• are non-transferable

• may not be redeemed for cash

• may be substituted by the Sponsor for a prize of equal or greater value if necessary

Any taxes, travel costs, transportation expenses, or additional costs associated with claiming or using a prize are the sole responsibility of the winner.

Some prizes may be subject to availability and blackout dates.

Acceptance of a prize grants ScubaTony and participating partner businesses permission to use the winner’s name, likeness, and entry for promotional purposes without additional compensation unless prohibited by law.

6. Odds

The odds of winning depend on the total number of eligible entries received during the Sweepstakes period.

7. Winner Selection and Notification

Winners will be selected in a random drawing conducted under the supervision of the Sponsor.

Winners will be notified via the email address provided during entry within five (5) days of the drawing.

If a selected winner:

• cannot be contacted

• is determined to be ineligible

• fails to respond within 15 days

The prize may be forfeited, and an alternate winner may be selected.

8. Rights Granted by Entrants

By entering the Sweepstakes, participants grant ScubaTony and all participating partner businesses the right, where permitted by law, to use the entrant’s name, likeness, image, voice, statements, and submitted content worldwide in any media for promotional, marketing, advertising, or publicity purposes without additional notice or compensation.

9. Marketing Communications

By entering the Sweepstakes, participants agree that their email address and contact information may be shared with ScubaTony and participating partner businesses contributing prizes to the Sweepstakes.

Entrants may receive promotional emails, marketing communications, or offers from these businesses.

Participants may unsubscribe from marketing emails at any time using the unsubscribe link included in email communications.

10. Travel and Activity Risk Disclosure

Some prizes may include travel experiences, scuba diving activities, accommodations, excursions, or other recreational activities in Cozumel, Mexico.

Participation in such activities involves inherent risks, including but not limited to travel disruptions, weather conditions, physical injury, illness, equipment failure, and other unforeseen hazards.

By accepting a prize that involves travel or activities, winners agree to assume all risks associated with participation and may be required to sign additional waivers, liability releases, or medical disclosures required by the activity provider.

Scuba diving participants must meet all training, certification, health, and safety requirements established by the dive operator.

Sponsors and partner businesses are not responsible for accidents, injuries, delays, cancellations, or other issues related to travel or participation in activities.

11. General Terms

ScubaTony reserves the right to cancel, terminate, modify, or suspend the Sweepstakes if fraud, technical failures, viruses, bugs, unauthorized human intervention, or other factors compromise the integrity or proper functioning of the Sweepstakes.

The Sponsor reserves the right to disqualify any individual who:

• tampers with the entry process

• violates these Official Rules

• attempts to manipulate the promotion through bots, scripts, or other automated means

Any attempt to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may violate criminal and civil laws.

12. Limitation of Liability

By entering the Sweepstakes, participants agree to release and hold harmless ScubaTony, Stingray Villas Cozumel, all participating partner businesses, and their respective affiliates, partners, employees, officers, agents, and representatives from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur from:

• participation in the Sweepstakes

• acceptance or use of any prize

• technical failures or internet issues

• errors in the administration of the Sweepstakes

13. Disputes

This Sweepstakes shall be governed by the laws of Mexico and the State of Quintana Roo, without regard to conflict of law principles.

Any disputes arising from this Sweepstakes shall be resolved individually in a court located in Quintana Roo, Mexico, and participants waive the right to participate in class actions or seek punitive damages.

To request the names of the winners, please email the Sponsor with the subject line:

“Sweepstakes Winners List Request.”

This promotion is not sponsored, endorsed, administered by, or associated with Facebook, Instagram, Twitter/X, YouTube, Pinterest, LinkedIn, or Google.

Participants understand that they are providing their information to ScubaTony and participating partner businesses, not to these platforms.
