Santa Barbara International Film Festival Giveaway (the “Sweepstakes”)

1. General Information 

2. NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE DOES NOT IMPROVE YOUR ODDS OF WINNING. ODDS OF WINNING DEPEND UPON NUMBER OF ENTRIES. SWEEPSTAKES VOID WHERE PROHIBITED BY LAW.

3. Eligibility: Participation in the Sweepstakes is open only to legal residents of the United States and District of Columbia (excluding New York, Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and where prohibited by law) who are twenty-one (21) years or older at time of entry. Employees, officers & directors of Sweepstakes Sponsor, its franchises or licensees, their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies and the immediate families or members of the same household of such employees/officers/directors are not eligible to enter.  

4. Sweepstakes Dates:  The Sweepstakes Dates begin at the Sweepstakes Start Date and ends at the Sweepstakes End Date as described in Section 1 above.

5.  Prize: The Winner will receive the Prize as described in Section 1 above. Winner will be selected by Sponsor on Wednesday, January 25, 2017, and the Winner will be notified by e-mail to the address submitted in their Entry. The Winner will receive two (2) All Access, VIP passes to the Santa Barbara International Film Festival held in Santa Barbara, California from February 2, 2017 through February 5, 2017. All access passes are subject to availability/seating. The Winner will also receive an American Express gift card valued at one thousand, three hundred dollars (USD $1,300) to be used for travel expenses. All travel expenses above one thousand, three hundred dollars (USD $1,300) shall be at the sole cost of the Winner.  Prize Winner will be drawn randomly from the pool of eligible entries received during the Sweepstakes Dates.

No prize substitution is allowed by winner. The prizes are nontransferable and will be subject to the Sponsor’s discretion. The prizes are provided "AS IS" and without any warranty of any kind. Sponsor reserves the right to substitute prizes in which case a prize of equal or greater value will be awarded.  No cash substitutions.  Winner is responsible for any and all taxes, as well as any other costs and expenses not specified herein. Limit one prize per individual. 

6.  How to Enter:  To enter the Sweepstakes you must (1) enter a valid e-mail address through Viral Sweep during Sweepstakes Dates and (2) indicate the state in which you live (“Entry”). Only one (1) e-mail Entry per participant. Additional Entries are available through performing various actions as outlined below.

In case of dispute as to identity of participant, entry will be declared made by the authorized account holder of the email address or social media account used to submit the entry. “Authorized Account Holder” is defined as the natural person who is assigned the account by the email provider, online service provider, social media provider or other organization.  Any other attempted form of entry is prohibited; no automatic, programmed; robotic or similar means of entry are permitted.

All entries become the sole property of the Sponsor and receipt of entries will not be acknowledged. Sponsor is not responsible for telecommunications, network, electronic, technical or computer failure or any kind of lost, late, incomplete, mutilated, invalid, unintelligible, misdirected entries, all of which will be disqualified.  Only completed entry forms with valid email addresses or social media accounts, as applicable, are eligible.  All ineligible entries will be disqualified. 

9. Drawing: Winners will be selected in a drawing from all eligible Entries received. Viral Sweep will select the Winners based on the top number of Entries. The drawing will be conducted by Viral Sweep on Wednesday, January 25, 2017. In the event that the first Entry form selected is discovered to be invalid for any reason whatsoever, or if the person who submitted the first Entry form does not respond as described in section 11 below, Prize will be awarded to a runner-up Winner who shall be subject to the same rules and conditions set forth herein.  All decisions of Sponsor are final and binding.

10. Notification: Winners will be notified by e-mail to the address provided in their Entry by Wednesday, January 25 2017. If unable to make contact with the Winner within twenty-four (24) hours after Sponsor first attempts to notify the Winner, Sponsor will select a runner up Winner in accordance with the above.  Likewise, if the original Winner is ineligible or fails to return the signed Affidavit of Eligibility and Publicity/Liability Releases as described in section 11 below or in the event of non-compliance with any other requirements of this Sweepstakes, the Winner shall forfeit the prize in its entirety, and Sponsor shall award the prize to an alternate Winner selected in accordance with the above. 

11. Redemption: To redeem the Prize, the potential Winner must respond within twenty-four (24) hours of Prize notification. The Winner will have to provide their mailing address in order for Sponsor to send the American Express gift card. The remainder of the Prize will be redeemed at Deckers Brand Showcase, located at 250 Coromar Drive, Goleta, CA 93117, on the first day of the Santa Barbara International Film Festival (February 1, 2017). The Prize Winner will be required to sign and return, via email, by end of day Thursday, January 26, 2017, an affidavit of eligibility, and Waiver and Liability Release for injuries and Image Permission granting Sponsor rights to use Winner and guest’s name, imagine and likeness in advertising. Failure to comply will result in the forfeit of the Prize and the selection of a substitute Winner from remaining eligible Entries. All prize claims are subject to verification and compliance with the Official Rules.

12. Conditions: All taxes and other expenses associated with the receipt or use of the Prize are the sole responsibility of the Winner. Participation in the Sweepstakes constitutes participant’s permission for the Sponsor to use his/her name, hometown city and state, likeness, biographical information and any statements made by participant regarding the Sweepstakes or Sponsor for editorial, advertising, public relations, and promotional purposes without notice or additional compensation, except where prohibited by law.

By entering the Sweepstakes, each participant warrants that he or she has read and agrees to abide by all of these Official Rules and that he or she is not prohibited from participating in the Sweepstakes.  Each participant agrees to release, discharge, indemnify, defend and hold harmless Sponsor and its parent, subsidiaries, affiliates, shareholders, employees, officers, directors, agents, representatives, advertising and promotion agencies and prize suppliers from any liability arising from or related to the Sweepstakes, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. 

13.  Email/Data Protection Notice:  If you submit an email address to enter this Sweepstakes, entrants agree to receive communications with information or carefully selected commercial opportunities from Sponsor or its subsidiaries or agents on their behalf. Sponsor will hold any personal details it is entitled to hold on its own or a duly authorized agent’s database for the purposes of optimizing its commercial offering to consumers, actual or potential. Any individual (or duly authorized person) may elect to exclude the name and email address of that individual from all lists used by Sponsor by submitting a removal request in writing to Sponsor at Sponsor’s Mailing Address above or by clicking “unsubscribe” in any communications.  PLEASE VISIT SPONSOR’S PRIVACY POLICY ON THE WEBSITE LISTED IN SECTION 1 ABOVE.

14. Additional Terms: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend this Sweepstakes for any reason.  Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or Sponsor’s website. Sponsor reserves the right to prosecute any fraudulent activities to the full extent of the law.

15. Winners List or a copy of the Official Rules: To obtain name of prizewinner or a copy of the Official Rules, send a self-addressed, stamped envelope after the Sweepstakes End Date to the “Sponsor Mailing Address” as described in Section 1 above, attention: “Santa Barbara International Film Festival Giveaway”

16.  The agreement contained in these Official Rules is governed by the laws of the California.

This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Instagram®, YouTube®, Facebook®, Twitter®, Snapchat®, Pinterest®. By entering, you understand that you are providing information to Sponsor.
