Blue Willow Bookshop's Gift Certificate Sweepstakes Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN.

This sweepstakes ("Promotion") is only open to residents in the 50 United States and the District of Columbia.

1. Eligibility: Participation open only to legal residents of the fifty United States and the District of Columbia, who are 13 years or older as of Promotion Start Date. Void outside of the 50 United States and the District of Columbia, and where prohibited, taxed or restricted by law. Employees, officers and directors of Hachette Book Group, Inc. ("Sponsor"), the featured author(s) (“Author(s)”), if applicable, and their respective parent companies, subsidiaries, affiliates, partners, advertising and promotion agencies, manufacturers or distributors of Promotion materials, the respective immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of any of the foregoing are also not eligible to enter. All federal, state and local laws and regulations apply.

3. Promotion Start/End Dates: Please Sponsor's Sweepstakes Page for details. Promotion begins 12:00 AM ET on April 21, 2020 and ends at 11:59 PM ET on April 27, 2020 (“Promotion End Date”).

4. Random Drawing/Odds: On or about five (5) business days after the Promotion End Date, Sponsor will select potential winner in a random drawing from all eligible entries. Odds of winning depend on the number of eligible entries received for the drawing.

5. Prizes:  One (1) prize available. The prize consists of one $50 gift certificate via email to Blue Willow Bookshop. The total ARV for all the prizes is $50.

6. Notification: Potential winner(s) selected will be notified by phone or email on or about 10 business days after the Promotion End Date and may be required to sign and return, where legal, an Affidavit or Declaration of Eligibility and Liability/Publicity Release ("Winner Eligibility Documents") within 7 days of prize notification. If a potential winner is considered a minor in his/her jurisdiction of residence, the Winner Eligibility Documents must be signed by potential winner's parent or legal guardian and such prize will be delivered to minor's parent/legal guardian and awarded in the name of parent/legal guardian. If any potential winner cannot be contacted within 5 days of first prize notification attempt, if any prize or prize notification is returned as undeliverable, if any winner rejects his/her prize or in the event of noncompliance with these Official Rules, such prize will be forfeited and an alternate potential winner will be selected from all remaining eligible entries. Upon prize forfeiture, no compensation will be given. Limit one prize per person/ household.

7. Conditions: Participation in Promotion constitutes entrant's permission for Sponsor to use his/her first name and city and state. By participating, entrants and winners agree to release and hold harmless Sponsor, Author(s) if applicable, and their respective advertising and promotion agencies and each of their parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors and their parent companies, subsidiaries, affiliates, partners, advertising and promotion agencies, manufacturers or distributors of Promotion materials, (collectively, "Released Entities"), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Promotion, or possession, acceptance and/or use or misuse of prize or participation in any Promotion-related activity and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. There is no purchase or sales presentation required to participate. A purchase does not increase odds of winning.

8. Rights Granted by you: By entering this content you understand that Hachette Book Group anyone acting on behalf of Hachette Book Group or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

9. Terms: Hachette Book Group reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Hachette Book Group may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Hachette Book Group. Hachette Book Group reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Terms & Conditions.

Hachette Book Group has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void votes for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by sweepstakes rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Hachette Book Group reserves the right to seek damages from any such person to the fullest extent permitted by law.

Limitation of Liability: By entering you agree to release and hold harmless Hachette Book Group and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

11. Disputes: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF United States of America AND New York, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in New York having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
