Kal Vitamins Sweepstakes Official Rules 

No purchase is necessary to enter or win and a purchase will not increase your chances of winning. 

How to Enter 

The Kal Vitamins Sweepstakes (the “Giveaway) begins December 20, 2024, at 10 am PST. To enter, visit kalvitamins.com and sign up for email capture. The entry must contain all required information, including the entrant’s name and valid email address. In the event of a dispute regarding the identity of any entrant or upon request by Nutraceutical Corporation (“Sponsor”), a form of government issued identification must be provided before receiving the prize. All entries must be received before 11:59 pm on December 31, 2024. 

This Giveaway may be presented in conjunction with different offers sponsored or co-sponsored by Sponsor, its affiliates, and partners, and may be presented in conjunction with offers sponsored by different organizations. 

Sponsor is not responsible for incomplete, lost, late, damaged, illegible, delayed, corrupted, non-delivered or misdirected entries or for any technical problems, malfunctions of any computer systems, servers, providers, hardware or software, lost or unavailable network connections, incorrect or inaccurate capture of entry information or loss of entry information, failed, incomplete, garbled or delayed computer transmissions, or any other human or technical errors of any kind, or any combination of any of the foregoing. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user’s Internet service provider and/or e-mail provider or for insufficient space in user’s e-mail account to receive e-mail. Sponsor is not responsible for any liability for damage to any computer system resulting from participation in or accessing or downloading information in connection with this promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend this Giveaway should a virus, bug, entrant fraud or misconduct, or other causes beyond the control of the Sponsor, in Sponsor’s determination, corrupt the administration, integrity, security or proper operation of the Giveaway. In the event of termination of the Giveaway, a notice will be posted on-line and a random drawing to award the prize will be conducted from among all eligible entries received prior to the time of termination. Entry times will be determined using Sponsor’s computer, which will be the official clock for the Giveaway. 

No automatic, programmed, robotic or similar means of entry are permitted, and individuals engaging in such practices will be disqualified. Incomplete entry forms will be disqualified. 

Eligibility 

To be eligible to win, an entry must follow all Giveaway terms and conditions as described by these Official Rules. The Giveaway is open to current legal residents of the United States aged 21 years or older at time of entry. Limit one (1) entry per person per day. Void elsewhere and where prohibited. 

Current employees or agents of Sponsor, or Sponsor’s affiliates, subsidiaries, and advertising or promotion agencies involved in this Giveaway, as well as members of the immediate family (spouse, parents, siblings, and children) or households of any of the foregoing, are NOT eligible to enter or win this Giveaway. The Sponsor will determine in its sole discretion which entries are valid entries according to these Official Rules. All decisions regarding the selection of winners are final. All entries are property of Sponsor and will not be returned.  

Odds of Winning 

Odds of winning will depend on the total number of eligible entries received. 

Prize 

There will be one (1) prize consisting of one (1) $500 Visa Gift Card and 5 KAL products of their choosing. Each Winner is limited to one prize. All prize details will be determined by Sponsor in its discretion. All expenses and costs associated with the acceptance or use of the prize are the responsibility of the Winner. No substitution, or transfer of right to receive prize is permitted, except in the discretion of Sponsor. Sponsor may, in its sole discretion, offer the Winner a cash prize in lieu of the stated prize. 

The Prize will be shipped by Sponsor to Winner’s home address anywhere in the continental United States. Sponsor is not responsible for any shipments to US territories or Hawaii or Alaska. Shipment will be made within sixty days of Winner’s acceptance of prize contingent upon compliance with these Official Rules. 

Drawing Methodology and Winner Notification 

One entrant will be selected by a random drawing held from among all eligible entries received (“Winners”). One winner will be drawn within five days after the giveaway closes, on December 31, 2024. The winner will be contacted on or before 8 pm PST January 5, 2025. The drawing will be conducted by or under the supervision of Sponsor, whose decisions will be final in all matters concerning the Giveaway. Winners are subject to verification. Winners will be personally notified by text, phone call, or e-mail using the contact information provided in the entry form. If the Winners do not confirm acceptance of prize, if any prize is returned as undeliverable, or in the event a potential winner does not accept the prize or fails to comply with these rules and requirements, the prize will be forfeited to an alternate winner chosen by random drawing. 

Upon prize forfeiture, no compensation will be given. The first Winners of the drawing must confirm either through phone call, reply text, or e-mail their acceptance of the prize no later than end of day January 15, 2024 (11:59 pm PST), otherwise an alternate Winner will be chosen at random. If any alternative winner must be chosen for any reason, alternative winners must confirm acceptance of the prize within 48 hours of notice, or a new alternative winner will be chosen at random. The Sponsor is not responsible for unsuccessful attempts to notify winners. 

Conditions of Participation 

To receive prize, Winners must execute an affidavit of eligibility, publicity release, and release of liability within 10 days of announcement, if required by Sponsor. Noncompliance or return of any of the above requested forms as undeliverable will result in disqualification and selection of an alternate winner. 

All federal, state, and other taxes, fees, and surcharges on prizes are the sole responsibility of each prize Winner. Winners will be issued an IRS Form 1099-Misc by Sponsor or an agent acting on its behalf. By participating and accepting a prize, where permitted by law, each Winner grants to Sponsor (and agrees to confirm that grant in writing), and those acting pursuant to the authority of Sponsor, the irrevocable right to print, publish, broadcast, and use, worldwide in any media now known or hereafter developed, including, but not limited to, the World Wide Web, at any time(s), the Winner’s name (first name and last initial) and or a photo of Winners with the prize for all advertising and/or promotional purposes without additional compensation or review. 

By submitting a Giveaway entry, entrant represents, warrants, acknowledges, and agrees that entrant: (i) has read these Official Rules; (ii) meets the eligibility requirements; (iii) has submitted correct contact information, including a viable e-mail address; (iv) understands that if any of the information submitted is false or incomplete, it will void the Entrant’s entry to the Giveaway; and (v) agrees to be bound by these Official Rules. 

General Terms 

By entering, entrants agree to release and hold the Sponsor, its parent company, affiliates, subsidiaries, distributors, and agents, and each of their directors, officers, employees, and assigns, harmless from and against any and all claims and liability arising out of participation in the Giveaway or use of the prize. Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Giveaway or use or redemption of any prize. By participating in this promotion, entrants agree to be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Giveaway or in the announcement of any prize. In no event will more than the stated number of prizes be awarded. Sponsor reserves the right, in its sole discretion and without any resulting responsibility or liability, to cancel, modify, or suspend this Giveaway or to amend these rules and regulations at any time for any reason. All material changes to these Official Rules will be posted on www.kalvitamins.com. 

The conduct of the Giveaway is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein.

Winners 

To receive a list of Winner(s), as applicable, send an email to Salesoperations@nutracorp.com with “Kal Vitamins Sweepstakes” as the subject line. Requests must be received by January 31, 2025. List will be sent once Winner(s) have been verified.
