TERMS AND CONDITIONS
By means of these terms and conditions (the “Terms and Conditions”), The Tropic Feel, S.L., with registered office in Barcelona, C/ Pujades 60, 1º, 08005, Barcelona and with Tax Identification Number (N.I.F.) B-66.961.095 (“Tropicfeel” or the “Sponsor”), launches the present sweepstakes, free of charge, called “SWEEPSTAKES OF Canyon HDry® Sneakers BY TROPICFEEL” (the “Sweepstakes”).
The Sweepstakes offers the Participants (as defined below) the opportunity to win 1 out of the 5 Canyon HDry® Sneakers by Tropicfeel, as part of the promotion of the launching of this new product.
Those who meet the following conditions will enter into the Sweepstakes and will be considered participants to all effects (the “Participants”):
Tropicfeel’s employees (and their immediate family members and/or flat mates), suppliers, shareholders or similar, are not excluded to participate in the Sweepstakes.
The Sweepstakes will be opened to participate from September 28th, 2023 to October 3rd, 2023 at 9pm GMT +1 (the “Period”). Those entries/sign ups after the Period will not be taken into consideration for the selection of Winners (as defined below).
Tropicfeel gives 5 Canyon HDry® Sneakers, 1 for each Winner; the retail value of each is around € 139.00 (the “Prize”).
Each Winner may choose the color of the Canyon HDry® Sneakers, as long as it is in stock or expected to be within the next 3 months.
No returns or exchanges of the prize are accepted.
To participate in the Sweepstakes it is required to sign up in the link located at the Tropicfeel’s landing page https://shop.tropicfeel.com/pages/canyon-hdry-giveaway, or through signing up link provided by a Participant.
After the signing up, each registered person will receive a confirmation email to the email address provided in the registration form. All of them will also receive a unique link to share with their community, that would increase their odds of winning if third parties sign up to the Sweepstakes through their link.
The signing up is limited to one entry per email address and device. All entries must be received within the valid Period.
By entering the Sweepstakes, entrants fully and unconditionally agree to be bound by these Terms and Conditions, which will be final and binding in all matters relating to the Sweepstakes.
5 Winners will be selected by random drawing on or about October 2nd, 2023, and will be notified via email within [3] days of this date.
Tropicfeel will verify that all the Winners meet the Eligibility conditions, and may request additional information (shipping address, color of the backpack, and other necessary information).
If any of the Winners do not meet the eligibility conditions, they will be excluded and another Winner will be chosen, and so on until there are 5 eligible Winners.
In case a selected Winner does not answer to Tropicfeel’s communication in within 3 calendar days of first notification attempt, an alternate Winner will be selected from all remaining eligible Participants.
The final Winners will be posted on Tropicfeel’s social media (website and Instagram) in the following days.
Any violation of these official rules by a Winner at Tropicfeel’s sole discretion will result in Winner’s disqualification, and all privileges as a Winner will be immediately terminated.
To obtain a copy of any legally required Winners list, send a self-addressed stamped envelope to: “Tropicfeel’s Sweepstakes Winners List”, to Tropicfeel’s address indicated at the beginning.
Tropicfeel will perform the Sweepstakes through the platform “ViralSweep” (https://www.viralsweep.com/Sweepstakess/).
The odds of winning a Prize are determined by the total number of eligible entries received, plus the number of Participants signed up through Participant’s link.
After the Winner’s selection and notification, the Winner shall follow the procedures given by Tropicfeel in the communication to get the Prize.
As the Prize is a newly launch product, it will be available for shipping from September onwards, to the address provided by the Winner. The availability of the Prize might be slightly delayed, which does not affect the terms and conditions herein. In no event the Winners would be entitled to the return or exchange of the Prize, or to any compensation or indemnity of any kind.
The cost of shipping is covered by Tropicfeel. In the event of additional delivery costs that may arise for unforeseen circumstances not attributable to Tropicfeel, the Winner is responsible for the additional expenses.
Tropicfeel does not assume any additional cost (customs duties and fees, among others), which shall be assumed entirely by the Winner.
No returns or exchanges of the prize are accepted.
In case the delivered prize proves to be damaged, the Winner shall notify Tropicfeel by filling out the form in order to exchange the product. In general, the product will be replaced by another Canyon HDry® Sneakers. If this would not be possible, the Winner will receive another product of similar retail value (+/- 15%), at Tropicfeel’s discretion. The cost of the exchange due to this matter, is covered by Tropicfeel under the same conditions as for the first shipping.
By entering in the Sweepstakes, entrants and Winners agree to release and hold harmless, Tropicfeel, Viralsweep, Instagram and their respective advertising and promotion agencies and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (the “Released Entities”) from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.
In no event will the Released Entities be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and use of the service and/or the Sweepstakes, downloading from and/or printing material downloaded from any websites associates with the Sweepstakes. Without limiting the foregoing, this sweepstakes and all prizes are provided “as is” without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow the limitations or exclusion of liability for incidental or consequential damages or exclusion of implied warranties so some of the above limitations or exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding these limitations or exclusions.
In the event an insufficient number of eligible entries are received and/or Tropicfeel is prevented from awarding prizes or continuing with the Sweepstakes as contemplated herein by any event beyond their control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Tropicfeel’s control then subject to any governmental approval which may be required, Tropicfeel shall have the right to modify, suspend, or terminate the Sweepstakes. If the Sweepstakes is terminated before the designated end date, Tropicfeel may (as its own discretion) select the Winners in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. Only the type and quantity of prizes described in these Terms and Conditions will be awarded.
Tropicfeel reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes in case virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Tropicfeel will select the Winner(s) from all eligible entries received prior to and/or after (if appropriate) the action taken by Tropicfeel.
Tropicfeel reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or website. Tropicfeel may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Tropicfeel representatives.
If by technical reasons or any other error, more Prizes are claimed than the number set forth in these official rules, all Participants making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of Prizes will be awarded.
Participation in Sweepstakes and acceptance of Prize constitutes each Winner’s permission for Sponsor to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information and/or any statements made by each winner regarding the Sweepstakes or Tropicfeel for advertising and promotional purposes (including paid media) without notice or additional compensation, except where prohibited by law.
Any costs associated with the shipping of the Prize (i.e. customs fees/duties and any other additional expenses that may arise), shall be borne entirely by the Winners.
The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
The Prizes will be subject to the provisions of the applicable tax legislation in force at any given time. The value of the Prizes in some cases may be subject to retention and income tax. For this reason, the Winners must provide, prior to receiving the Prize, the necessary data to be able to issue the corresponding tax certificate. Apart from this provision, the impact on the tax obligations of the Winners will be at their own risk, so that Tropicfeel is relieved of any other responsibility. Tropicfeel reserves the right to request the Winner’s ID for the purpose of issuing the corresponding tax certificates.
Participation in this promotion implies full acceptance of these terms and conditions.
Tropicfeel complies current legislation on the protection of personal data, in particular with regard to Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (“LOPDGDD”) and the General Personal Data Protection Regulation (“GDPR”).
The processing of the “Personal Data” (email address, personal information, etc.) of the Participants is carried out for the purpose of handling the Sweepstake. The Personal Data is used to identify the Participants, to notify them of winnings and to process any winnings. The legal basis for such data processing is Art. 6 (1) lit. b) of the GDPR.

By participating in the Sweepstakes, entrants hereby agree to Tropicfeel’s collection and usage of their Personal Data and acknowledge that they have read and accepted Tropicfeel’s privacy policy.
Tropicfeel is the responsible of the Personal Data provided (as data controller), and will share some of the information with providers of services (i.e. ViralSweep, shipping services…), if this is necessary for the handling of the Sweepstake. Those providers will be data processors, so Tropicfeel will be the responsible of the Personal Data in all cases. The Personal Data will be deleted as soon as the Sweepstakes has been completed. Under no circumstances the Personal Data will be stored for more than one year.
Participants may exercise their rights of access, rectification, cancellation, opposition, portability, deletion and limitation of treatment legally guaranteed to the data controller and direct any questions you have to the data protection coordinator of Tropicfeel: dpo@tropicfeel.com.
Without prejudice to the foregoing, the data subjects may submit any claim to the Spanish Data Protection Agency or the competent supervisory authority.
Any controversy or claim arising out of or relating to these Terms and Conditions and/or the Sweepstakes, shall be governed by, and interpreted under, the laws of Spain.
The Parties expressly waive any other jurisdiction to which they may be legally entitled, and expressly submit the resolution of any disputes or claims arising over the interpretation or performance of the Agreement, including those relating to any noncontractual obligations arising from or related to it, to the jurisdiction of the courts and tribunals of the city of Barcelona (Spain).
