NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1. ELIGIBILITY

The Big Frig® Ditch & Switch Sweepstakes (the “Promotion”) is open to all who are at least eighteen (18) years old at time of entry – barring current and former employees of Big Frig (the “Sponsor”), affiliated companies, advertising agencies, contract companies, and the immediate families and household members of each. This Promotion shall only be construed and evaluated according to applicable state and federal law. Void outside the fifty (50) United States and D.C. The Promotion is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

2. AGREEMENT TO RULES 

By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of the Sponsor, as final and binding as it relates to the content. By entering you agree to accept emails from the Sponsor, from which you can unsubscribe at any time. The Promotion is subject to all applicable federal, state, and local laws.

3. PROMOTION PERIOD

The Promotion Period begins on May 1, 2021 at 12:00 a.m. Central Daylight Time (“CDT”) and ends on May 31, 2021 at 11:59 p.m. CDT.

4. HOW TO ENTER

There are two (2) methods of entry in the Sweepstakes. 1) Upload your qualifying photo or video on the Big Frig® Ditch & Switch Sweepstakes entry page at bigfrig.com. Your photo or video must meet the criteria specified in the Photo & Video Rules section below to qualify for a valid entry. Multiple entries of the same or similar (determined at the sole discretion of the Sponsor) photo or video will be disqualified. OR 2) Mail-in: To receive one (1) free entry, on a 3 inch by 5 inch piece of paper, hand-print your name, complete address, daytime and evening phone numbers (including country code and area code), email address, and date of birth, and mail in a properly stamped #10 envelope to: Big Frig - Ditch & Switch Sweepstakes, 310 N Derby Ln Unit 1577, North Sioux City, SD, 57049. Mail-in entries must be postmarked by May 31, 2021 and received no later than June 4, 2021 to be eligible.

You may enter once during the Promotion Period by submitting a photo or video. Up to ten (10) "Bonus Entries" in the grand prize drawing can gained by an entrant by having new entrants enter the sweepstakes via the unique referral link generated on the post-entry page. Entries must fulfill all sweepstakes requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsor. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of the Sponsor.

5. PHOTO & VIDEO RULES

All eligible entries must be submitted via the website mentioned during the Promotion Period. Through your entry, you verify the submission is original, does not infringe on the rights of any third party, and does not violate any agreement between you and a third party.

By entering the Promotion, you provide the Sponsor the non-exclusive right to publish, use, distribute, reproduce and publicly display your photograph or video, and to create derivative works from your photograph or video, in perpetuity, in any of its online, print or other media publications, materials or exhibitions, for promotional purposes, including but not limited to for editorial, advertising, and publicity, without payment or compensation unless prohibited by law. You grant the Sponsor permission to provide your name, your social media handle, and your state of residence, when publishing, reproducing or otherwise using your photograph or video, as well as when identifying the participant as an entrant or prize winner in the Promotion. The Sponsor, at its sole discretion, may or may not give you credit when using your photograph or video. Subject to the rights granted to the Sponsor, you retain all other copyrights and rights to future use of the photograph or video you enter into the Promotion.

If your photograph or video includes a recognizable person or people, you must secure permission from each person (or if applicable the minor's parent or guardian) to use his/her image in the Promotion. The sponsor reserves the right to disqualify an entry if it finds that an entrant has not secured a necessary release. The Sponsor reserves the right to modify any photo to fit branding requirements.

6. PRIZES

There will be one (1) grand prize winner who will receive one (1) 175 Liter Dunes Dry Box with Wheels, with the approximate retail value of $549.99. All entrants will receive either a forty percent (40%) off coupon code if submitting a video or mail-in entry or a twenty percent (20%) off coupon code if submitting a photo. Bonus Entries will not result in additional coupon codes being grated to an entrant. Coupon codes will be subject to the following terms: Expires on June 30, 2021. Valid on plain Badlands series coolers on bigfrig.com only. May not be combined with other discounts, offers, or special pricing.

7. ODDS

The odds of winning depend on the number of eligible entries received.

8. WINNER SELECTION

The grand prize winner will be chosen randomly from amongst all of the valid entries under the supervision of the Sponsor.

9. PRIZE TERMS & CONDITIONS

Actual/appraised value may differ at time of prize awarding. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at the Sponsor’s discretion. The prize is non transferable. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. The Sponsor reserves the right to award a substitute prize of equal or greater value, including but not limited to gifted products. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner.

10. WINNER NOTIFICATION 

The grand prize winner will be notified by the Sponsor using the e-mail address provided with their entry no later than June 11, 2021. Prize must be claimed within (5) days. To claim the prize, the winner must respond to the prize notification email and may be required to provide proof of identity, address, liability release and, except where prohibited by law, a publicity release. Prizes not claimed within (5) days will be forfeited. The Sponsor will select alternate winners for any unclaimed prizes. Any portion of a prize not accepted by the winner will be forfeited. If an entrant changes his/her email address / any part of this Promotion, it is his/her sole responsibility to notify the Sponsor at info@bigfrig.com by the end of the Promotion Period. 

11. WEB RESTRICTIONS

The Sponsor reserves the right to cancel or suspend this Promotion should fraud, virus, bug or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Promotion. The Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature.

All entrants must have a valid email address at time of entry.

13. TERMS

The Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Promotion should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Promotion. In such a case, the Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promotion or website or violates these Terms & Conditions.

The Sponsor has the right, in its sole discretion, to maintain the integrity of the Promotion, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by promotion rules; or the use of bots, macros or scripts or other technical means for entering.

Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the promotion may be a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

By entering the Promotion or voting you agree to receive email newsletters periodically from the Sponsor. You can opt-out of receiving this communication at any time by clicking the unsubscribe link in the newsletter.

14. LIMITATION ON LIABILITY

By entering you agree to release and hold harmless the Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries; (vi) any element or circumstance of or related to the entrant’s preparation or production of his/her photograph or video for entry in the Promotion.

15. GOVERNING LAW

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of South Dakota without regard to conflicts of law principles. All entrants consent to the jurisdiction and venue of the State of South Dakota.

17. This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter, Instagram, Snapchat, Youtube, Pinterest, LinkedIn, or Google. You understand that you are providing your information to the owner of this promotion and not to Facebook, Twitter, Instagram, Snapchat, Youtube, Pinterest, LinkedIn, or Google.

Participation in this Promotion is considered a complete release of Facebook and Instagram by each entrant.

18. RIGHTS GRANTED BY YOU

By entering this content you understand that the Sponsor, anyone acting on behalf of the Sponsor, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner’s name and photo for trade, advertising, public relations and promotional purposes without any further compensation.
