1. WIMCO Photo Contest Terms & Conditions
   1. Individuals need to certify that they have (or will have) a valid passport so they are able to travel internationally on the date of redemption to claim the prize.
   2. There is a limit of one entry per unique email address
   3. Entrants are required to submit between one and four vacation photos in order to enter. Any photos submitted to WIMCO may be used by WIMCO in an unlimited and unrestricted manner, in perpetuity.
   4. All entrants must be at least twenty-one (21) years of age to be eligible to participate in the St. Barths Vacation Sweepstakes (the "Sweepstakes"). Employees, agents, representatives, or affiliates of participating sponsors, and their immediate family members and household members, and those employed by media companies, are not eligible to participate. The term "immediate family members" includes spouses, parents, siblings, grandparents, children, grandchildren, roommates and cohabiting significant others.
   5. No purchase or payment of any money is necessary to enter. A purchase will not improve the chances of winning. Odds of winning will depend on total number of entries received. Void where prohibited by law or where bonding, registration, or other requirements exist but have not been met. By entering this Sweepstakes, you agree to these Official Rules.

2. Entry and Promotion Period

   5. The Sweepstakes will begin on August 20,  2020. (the "Entry Period"). All online and mail entries must be received by the specified end date at 11:59PM EST. Late, incomplete or illegible entries will be disregarded.
   6. The end date is Tuesday, September 15 at 5pm EST.
   7. The winner will be selected within 5 business days after the end date, from all eligible entries received during the Entry Period by employees or representatives of the Participating Sponsors, and will be notified by email within those 5 business days.
   8. To enter please use the online entry form on the participating sponsor's website. Please note that illegible entries shall be discarded. All entries must be received no later than the end date specified. Normal time, toll, connection, and usage rates, if any, charged by your Internet Service Provider may apply. Entries generated by script, macro, or other automated means are void. By submitting your email address you agree that any information collected may be used by the Participating Sponsors in accordance with the Sponsor's respective Privacy Policies.

3. Prize

   7. The Grand Prize for the selected winner is a 7-night  vacation in St Barts with WIMCO Villas at Villa WV KNG from November 9-16, 2020; roundtrip airfare for two from San Juan to St. Barths with Tradewind Aviation; and two (2) tickets to the Rum Awards festival. One winner will be selected, and may bring one companion.
   8. Travel must take place from November 9-16, 2020. WIMCO will provide travel services including assisting with international and local flights, reserving a rental car, providing airport pick-up and drop-off service, pre-stocking the villa with a first night gourmet buffet, and providing personalized concierge service for the length of the villa vacation. Please note cost of the domestic airfare and rental car is not included. Expenses not specifically included in the prize are the sole responsibility of the winner.
   9. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner. All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 by WIMCO to report their winnings.
   10. All prizes are awarded "as is." Prizes are nontransferable and cannot be exchanged. No substitute prize will be awarded to a winner who declines to accept a prize
   11. The odds of winning depend on a number of factors, including the number of eligible entries received. In the event of a dispute regarding the identity of the person submitting the entry, the entry will be deemed to have been submitted by the person in whose name the entrant's email address is registered. Winner will be notified by email after the end of the Entry Period. Sponsor reserves the right to determine and to alter the method of notification.
   12. Winners must claim their prize within 48 hours of the date of notification of such prize. A winner's failure to respond to the prize notification mail ewithin the specified 48 hours will be considered such winner’s forfeiture of the prize and an alternate winner may be selected from the pool of eligible entries. If an entrant is found to be ineligible, an alternate winner may also be selected from the pool of eligible entries.
   13. Proper identification must be presented by any winner to claim the prize. As a condition to receiving the prize, any potential winner must complete and sign a Winner's Affidavit and Release, releasing participating sponsors, as well as their employees, owners, heirs and assigns, from all liability in connection with winner's participation in the Sweepstakes and acceptance, use, or non-use of the Sweepstakes prize. An entrant or winner may be disqualified from the Sweepstakes if he or she fails to comply with any provision of these Official Rules, as determined in the sole discretion of Sponsor.
   14. To receive a complete list of winners or a copy of the Official Rules: send a self-addressed, stamped envelope to Sweepstakes Manager, WIMCO, PO Box 1401. Newport, RI 02840. Specify winner’s list for which Sweepstakes and supply the Official Rules in your request. Please allow 6–8 weeks for delivery of the information.

4. Participation

   14. By participating in the Sweepstakes, each participant agrees to receive email communications from the participating sponsors regarding exclusive offers, promotions, events and Sweepstakes. Any participant that opts-out of these mailings during the sweepstakes will also remove themselves from the Sweepstakes.
   15. By participating in the Sweepstakes, participants agree to be bound by the decisions of participating sponsors personnel with respect to eligibility and award of the prize. Persons who violate any rule, gain unfair advantage in participating in the Sweepstakes, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited.
   16. Participating sponsors will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Sweepstakes and participating sponsors' decisions concerning such disputes shall be final. If the conduct or outcome of the Sweepstakes is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond any Sponsor’s control, participating sponsors' reserves the right to terminate this Sweepstakes, or make such other decisions regarding the administration or outcome as they deem appropriate.
   17. All decisions made by participating sponsors are final, and they may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS SWEEPSTAKES, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PARTICIPATING SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
   18. By participating in this Sweepstakes, each participant agrees to waive any and all claims for damages for death, personal injury, loss of property or property damage that he or she may sustain as a result of his or her participation in the Sweepstakes and/or the use of any prize, and any damages or losses arising from the implementation or carrying out of the Sweepstakes or any participant's failure to win the Sweepstakes or receive the prize, and to release all Sponsors, and their parent companies, subsidiaries, affiliates, directors, officers, employees and agents (collectively, the "Releasees") from any and all liability arising out of or connected in any way with his or her participation in the Sweepstakes, even though that liability may arise out of an intentional act, omission, negligence or carelessness on the part of the persons or entities mentioned above.
   19. Releasees shall not be liable for 1) failed, returned, or misdirected notifications based on inaccurate information provided by the winner on the Sweepstakes entry form); entries and responses to winner notifications which are lost, late, incomplete, illegible, unintelligible, postage-due, misdirected, damaged, or otherwise not received by the intended recipient in whole or in part or for computer or technical error of any kind; 2) any electronic miscommunications or failures; technical hardware or software failures of any kind; lost or unavailable network connections; or failed incomplete, garbled, or delayed computer transmissions which may limit an entrant’s ability to participate in the Sweepstakes; 3) any technical malfunctions of the telephone network, computer online system, computer equipment, software, program malfunctions, or other failures; delayed computer transactions or network connections that are human, mechanical, or technical in nature; or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from downloading any part of this Sweepstakes; or 4) any warranty of fitness or merchantability of any prize or the function or operation thereof.
   20. Releasees do not make any, and hereby disclaim any and all, representations or warranties of any kind regarding any prize. Unless prohibited by applicable law, the acceptance of the Grand Prize by the winner constitutes winner's permission for Sponsor to use winner’s name, address (state), biographical information, and testimonials for advertising and/or publicity purposes in connection with this Sweepstakes only, worldwide and in all forms of media now known or hereafter developed, in perpetuity, and without further compensation.
   21. By entering or accepting a prize in this Sweepstakes, winner agrees to be bound by these Official Rules and to conform to all federal, state, and local laws and regulations. The winner will be required to execute and return to Sponsor within five (5) business days of accepting the Grand Prize, an Affidavit of Eligibility and a Liability and Publicity Release (where imposing such condition is legal) and any additional documents required by Sponsor in connection with the possibility of receiving the Grand Prize. Winner may be required to furnish proof of identity, address, and birth date in order to receive a prize. Any person attempting to defraud or in any way tamper with this Sweepstakes will be ineligible for prizes and may be prosecuted to the full extent of the law. Sponsor reserves the right to modify these Official Rules in any way or at any time. Sponsor reserves the right, in their sole discretion, to modify, cancel, or suspend this Sweepstakes should viruses, bugs, or other causes beyond Sponsor’s control corrupt the administration, security, or proper play of the Sweepstakes, or for any reason that Sponsor believe in good faith would be fair to the entrants and the conduct of the Sweepstakes. In the event of cancellation or suspension, Sponsor shall promptly post a notice on the Sweepstakes entry page to such effect.
   22. This Sweepstakes shall be governed by Rhode Island law without regard to its conflicts of laws provisions. By participating in this Sweepstakes, entrants hereby irrevocably consent to exclusive jurisdiction and venue in the state and federal courts of Rhode Island for any dispute, mediation, arbitration or litigation arising from or relating to this Sweepstakes.
