“NOVEMBER TRIM DOWN CHALLENGE” COMPETITION TERMS AND CONDITIONS

VOID WHERE PROHIBITED. ENTRY IN THIS COMPETITION CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.

TERMS AND CONDITIONS

1.    This competition is sponsored and promoted by Promoter, d/b/a Gofinity® with its principal place of business located at 840 Oak Harbor Blvd., Slidell, Louisiana 70458 hereinafter referred to as the “Promoter.”

2.    The rules of the competition, the prizes and route to entry for the competition and details of how to enter are located herein.

3.    Employees of Gofinity, Inc. or their family members or anyone else connected in any way with the competition or helping to set up the competition shall not be permitted to enter the competition.

4.    There is no entry fee and no purchase necessary to enter this competition.

5.    No responsibility can be accepted for entries not received for whatever reason.

6.    The Promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by means of social media.

7.    The Promoter is not responsible for inaccurate details or information supplied to any entrant by any third party connected with this competition.

8.    No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.

9.    The Promoter’s decision in respect of all matters to do with the competition will be final and shall not be reviewed under any circumstances.

10.    The competition and these terms and conditions will be governed by Louisiana law and any disputes will be subject to the exclusive jurisdiction of the courts of Louisiana, United States.

11.    Promoter retains ownership of all intellectual property rights in and to the entries submitted for this competition.  As a condition of entry, you grant Promoter a perpetual, irrevocable, worldwide, transferable, royalty-free, and non-exclusive license to use, reproduce, adapt, modify, publish, distribute, publicly perform, create a derivative work from, and publicly display the entries for any purpose, including display on any and all websites and social media accounts owned and/or operated by Promoter, without any attribution or compensation due unto you. 

12.    Entries may also be used for press and media purposes, and you agree to waive any rights and not assert any intellectual property rights that you have or may have in the entry.

13.    Any personal data relating to the winner or any other entrants will be used solely in accordance with current and regional data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.

14.    Entry into the competition will be deemed as acceptance of these terms and conditions.

15.    This competition is in no way sponsored, endorsed or administered by, or associated with, Twitter, Instagram and/or Facebook. You are providing your information to Promoter not to Twitter, Instagram and/or Facebook. By participating in this promotion you agree to a complete release of Twitter, Instagram and Facebook from any claims. Participation in this promotion is subject to the all rules, terms and conditions. The information provided will be used in conjunction with the following Privacy Policy found at https://shopgofinity.com/policies/privacy-policy.

16.    Promoter and the employees, officers, directors, shareholders, agents, and representatives of Promoter, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Promoter that may cause the competition to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the competition; or (vi) any printing or typographical errors in any materials associated with the competition.

17.    Promoter reserves the right to disqualify any participant or winner who, in its sole suspicion, tampers with the entry process, intentionally submits more than the allowed entries, violates these rules or the Terms and Conditions of Instagram and/or Facebook, or acts in an unsportsmanlike or disruptive manner.  Any false information provided within the context of the competition by you concerning identity, mailing address, telephone number, email address, ownership of right or non-compliance with these rules herein or the like will result in immediate elimination from the competition.

18.    Under no circumstances shall any participant in the competition, the awarding of a prize, or anything in these rules be construed as an offer or contract of employment with Promoter or any third party individual or entity involved in the competition.  

19.    You acknowledge that you submitted an entry and followed Promoter’s page voluntarily and not in confidence or in trust.  You further acknowledge that no confidential, fiduciary, agency or other relationship or implied-in-fact contract now exists between you and Promoter or any third party individual or entity involved in the competition and that no such relationship is established by your submission under these rules.

20.    If any provision(s) of this agreement is held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. 

21.    Any inquiries or questions regarding this competition, including any request for the names of the winners, may be sent by email to Contests@brockbeauty.com or by regular mail to Promoter at the address set forth above.

22.    By submitting your entry and email address you consent to being placed on Promoter’s mailing list. You may unsubscribe at any time. 

ENTRY RULES

Competition Period

The qualification period shall begin on November 1, 2023 at 12:00 AM CST and end on November 15, 2023 at 11:59 PM CST. 

Prizes will be given away at the end of competition period. Entries will be accepted until November 17, 2023 at 11:59 PM CST and winner will be announced before November 24, 2023 11:59 PM CST.

Entry Procedures

1.    Competitionants must be current users of Gofinity products;

2.    Competitionants will submit a “before and after photo or video testimonial” for their chance to win. 

3.    Entries must be submitted via the link. To submit via Instagram, you must tag @gofinityofficial and use hashtag #novembertrimdownchallenge 

4.    The main content of the photographs must feature your before and after, depicting your progress with Gofinity products

Duties of Participants

Participants agree to abide by the Photograph and Video Requirements below and to be bound by these Official Rules and the decisions of Promoter, which shall be a final, binding agreement between you and Promoter. All federal, state, and local laws apply. 

Photograph and Video Requirements:

1.    Photographs/Videos must not be derogatory, offensive, threatening, defamatory, disparaging, libelous or contain any content that is inappropriate, indecent, sexual, profane, tortuous, slanderous, discriminatory in any way, or that promotes hatred or harm against any group or person, or otherwise does not comply with the theme and spirit of the competition.

2.    Photographs/Videos must not contain content, material or any element that is unlawful, or otherwise in violation of or contrary to all applicable federal, state or local laws and regulation including the laws or regulations in any state where the photograph is created.

3.    Photographs/Videos must not contain content, material or element that displays any third party advertising, slogan, logo, trademark or otherwise indicates a sponsorship or endorsement by a third party, commercial entity or that is not within the spirit of the Competition, as determined by Sponsor, in its sole discretion.

4.    Photographs/Videos must be original, unpublished works that do not contain, incorporate or otherwise use any content, material or element that is owned by a third party or entity.  

5.    Photographs/Videos cannot contain any content, element or material that violates a third party’s publicity, privacy or intellectual property rights.  Therefore, you warrant that you have obtained the permission and a valid release from each individual captured in your photograph/video prior to its submission. Upon request, you agree to acquire and submit a release for and from any individual captured in your photograph/video, including the individual(s)’s names and contact information.  You agree that it is your sole responsibility to obtain all permissions necessary for the grant of the rights to submit your photograph/video.

6.    By submitting your photograph/video, you warrant that the photograph/video is not the subject of any actual or threatened litigation or claim.

7.    The photograph/video and any material submitted in conjunction therewith must not contain any disparaging remarks relating to the Promoter or any third party.

8.    By submitting your photograph/video, you warrant that all of the above and foregoing Photograph/Video Requirements have been met and that you have the right to submit the photograph/video in this competition and grant all required licenses herein. 

9.    Applicants may submit more than one photograph/video; however, each photograph shall be submitted and judged individually.

Selection of Winner

The entries will be judged, based on the quality of image, creativity, overall transformation. Winners are not randomly selected. Once a submission is entered into the Competition, voters will be allowed to cast their votes.

Description of Prizes

First place - $1,000 

Second place - $500

Third Place - $250

Notification of Winner

Promoter will announce the winner before November 24, 2023 at 11:59 PM CST by posting the official announcement to Instagram.com/gofinityofficial. The winner will be notified by means of the email address provided when submitting entry. Promoter will forward notification email with information on when and where the prize can be collected. If the winner cannot be contacted or does not claim the prize within twenty-four (24) hours of Promoter sending email, Promoter may withdraw the prize from the winner and pick a replacement winner.

BY ENTERING YOU AGREE THAT YOU ARE 18 YEARS OR OLDER.

BY ENTERING YOU AGREE THAT YOU HAVE READ THE ABOVE “OFFICIAL RULES,” THAT YOU UNDERSTAND THE RULES, AND THAT YOU AGREE THE RULES CREATE A BINDING AGREEMENT BETWEEN YOU AND PROMOTER.
