Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1. ELIGIBILITY

The GUNNER® Gunner Effect photo/video contest (the “Promotion”) is open to all who are at least eighteen (18) years old at time of entry – barring current and former employees of Sponsor, affiliated companies, advertising agencies, and the immediate families and household members of each. This Promotion shall only be construed and evaluated according to applicable state and federal law. Void outside the fifty (50) United States, and Washington, D.C., and Canadian Territories. The Promotion is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

2. AGREEMENT TO RULES

By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of GUNNER®, as final and binding as it relates to the content. By submitting your photo or video online, you agree to accept emails from the Company, from which you can unsubscribe at any time.  The Promotion is subject to all applicable federal, state and local laws.

3. PROMOTION PERIOD

The Promotion and its Submission Period begins on Thursday, March 2, 2023 at 12:00 a.m. Central Standard Time (“CST”) and ends on Wednesday, March 29, 2023 at 11:59 p.m. CST (the “Promotion Period”).  

4. HOW TO ENTER

To enter the Promotion, upload your photo or video to the GUNNER® #GunnerEffect entry page at gunner.com. Photos may also be submitted via Instagram, Facebook, or TikTok by tagging photos with #GunnerEffect23 and tagging @gunnerkennels (accounts must be public to enter). If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of GUNNER®.

5. PHOTO RULES

All eligible entries must be submitted via the website mentioned or through Instagram, Facebook, or TikTok, during the Submission Period. Photos or videos must not include a competitor's product. Through your entry, you verify the submission is original, does not infringe on the rights of any third party, and does not violate any agreement between you and a third party.

By entering the photo/video contest, you provide GUNNER® the non-exclusive right to publish, use, distribute, reproduce and publicly display your photograph or video, and to create derivative works from your photograph or video, in perpetuity, in any of its online, print or other media publications, materials or exhibitions, for promotional purposes, including but not limited to for editorial, advertising, and publicity, without payment or compensation unless prohibited by law. You grant GUNNER® permission to provide your name, your social media handle, and your state of residence, when publishing, reproducing or otherwise using your photo or video, as well as when identifying the participant as an entrant or prize winner in the Promotion. While GUNNER® will make all effort to credit photographers when using photos, there may be circumstances where it is not possible to do so. Subject to the rights granted to GUNNER®, you retain all other copyrights and rights to future use of the photographs you enter into the Promotion.

If your photograph(s) or video(s) include a recognizable person or people, you must secure permission from each person (or if applicable the minor's parent or guardian) to use his/her image in the photo/video contest. The sponsor reserves the right to disqualify an entry if it finds that an entrant has not secured a necessary release. GUNNER® reserves the right to modify any photo to fit branding requirements.

6. PRIZES

Each grand prize winner will receive a prize package containing their choice of one G1 Kennel, one Food Crate, three GUNNER Wear items, and one of any in-stock accessory on the GUNNER website. If an item or accessory is out of stock, it will not be included in the prize package. Prize package is valued up to $3,000.

7. ODDS

The odds of winning depend on the number of eligible entries received.

8. JUDGING PROCESS

Selection of the Finalist will be chosen by the GUNNER® team, in a pre-designated process determined at the direction of the Sponsor. The overall winning photo and video will be judged by the GUNNER team during the finalist voting period; There will be (1) photo winner and (1) video winner.

The entrants whose photos or videos are selected as the Promotion winners may have their photo(s) or video(s) appear on GUNNER® website and/or in advertisements.

9. PRIZE TERMS & CONDITIONS

Actual/appraised value may differ at the time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor’s discretion. The prize is nontransferable. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. The Sponsor reserves the right to award a substitute prize of equal or greater value, including but not limited to gifted products. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. 

10. WINNER NOTIFICATION 

In April 2023, winners will be notified by GUNNER® using the e-mail address provided with their entry, or the social media handle by which he/she entered. Prize must be claimed within (5) days. To claim the prize, the winner must respond to the prize notification email or social media message and may be required to provide proof of identity, address, liability release and, except where prohibited by law, a publicity release. Prizes not claimed within (5) days will be forfeited. The Sponsor will select alternate winners for any unclaimed prizes. Any portion of a prize not accepted by winner will be forfeited. If an entrant changes his/her email address / any part of this Promotion, it is his/her sole responsibility to notify GUNNER® at marketing@gunner.com by the end of the Promotion Period. 

11. WEB RESTRICTIONS

Sponsor reserves the right to cancel or suspend this Contest should fraud, virus, bug or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Contest. Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature.

All entrants must have a valid email address at time of entry. 

12. PRIVACY POLICY

Please see Sponsor’s privacy policy for details of the Contest policy regarding the personal information collected in connection with this Contest.

13. TERMS

GUNNER® reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Promotion should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Promotion. In such case, GUNNER® may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by GUNNER®. GUNNER® reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promotion or website or violates these Terms & Conditions.

GUNNER® has the right, in its sole discretion, to maintain the integrity of the Promotion, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by promotion rules; or the use of bots, macros or scripts or other technical means for entering.

Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the promotion may be a violation of criminal and civil laws and should such an attempt be made, GUNNER® reserves the right to seek damages from any such person to the fullest extent permitted by law.

14. LIMITATION ON LIABILITY

By entering you agree to release and hold harmless GUNNER® and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

15. GOVERNING LAW

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of Delaware without regard to conflicts of law principles. All entrants consent to the jurisdiction and venue of the state of Delaware.

17. This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter, Instagram, Snapchat, Youtube, Pinterest, LinkedIn, TikTok, or Google. You understand that you are providing your information to the owner of this promotion and not to Facebook, Twitter, Instagram, Snapchat, Youtube, Pinterest, LinkedIn, TikTok, or Google.

Participation in this Promotion and/or entering the GUNNER® Promotion is considered a complete release of Facebook, Instagram, and TikTok by each entrant.

18. RIGHTS GRANTED BY YOU

By entering this content you understand that GUNNER®, anyone acting on behalf of GUNNER®, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner’s name and photo for trade, advertising, public relations and promotional purposes without any further compensation.
