TERMS AND CONDITIONS: BUILD IT WIN A HOUSE COMPETITION

• The promoter is Build it (“the Promoter”).
• This promotional competition is open to all South African, Namibian, Lesotho and eSwatini residents who are 18 years or older and in possession of a valid identity document, except any director, member, partner, employee, agent or consultant of the Promoter, the marketing service providers or any person who directly or indirectly controls or is controlled by these entities, including their spouses, life partners, business partners or immediate family members.
• This promotional competition starts on 25 February 2021 and ends at midnight on 23 April 2021. Any entries received after the closing date will not be considered.
• To enter, Participants will be required to:
  • Fill in all details on the entry form
  • Upload a Picture of their Family
  • Like the Build it Facebook page www.facebook.com/BuilditSA
• Participants must follow the above steps correctly. If a Participant drawn as a finalist/winner has not followed the correct entry steps or adhered to the relevant terms and conditions, the Promoter reserves the right to select another finalist/winner in terms of the rules.
• Participants may only enter once per valid Facebook page/profile and accept the Facebook terms of use as stipulated by Facebook and so provided to the Participants in creating/managing his/her Facebook profile.
• Participants understand (and hereby acknowledge) that the picture of the house depicted in the promotional material is illustrative only and is simply a representation of a house, not a diagrammatic representation of the structure that any winner may wish to commission. Moreover, the Participants hereby acknowledge that he/she understands the prize to be:
  • Limited to building materials (maximum of R250 000) and labour (maximum of R50 000) valued at a total of ZAR300,000.00 (including VAT) to build a home independent of (and without any further support or supervision from) the Promoter (the “Labour & Materials”) and to which the warranties and disclaimers (set out in law and in contract) will apply as if the Labour & Materials had been purchased from the Promoter in the ordinary course;
  • excluding any costs associated with the delivery of the Labour & Materials; and
  • without any obligation on the Promoter, its agents, affiliates, or associates to ensure the completion (or valid certification of any element) of the home to which the Labour & Materials are applied[1];
•  Twelve (12) finalists will be selected from all valid entries and will go into a final draw.
•  All finalists will be required to provide their names, ID numbers and contact details (email address or phone number at a minimum), and consent to the processing of such information for the purposes of the promotion.
•  By entering this competition and supplying their details, Participants agree to receiving marketing material from Build it as and when necessary.
•  Short-listed finalists (of which there will be 12) and the Winner (of which there will be only 1) will be selected by means of a random draw by 03 May 2021 and will be notified telephonically where the winner will be required to verify their details. The Promoter (or their agent) will endeavour to contact the prize winner once every day for 5 consecutive working days after their name is drawn. If the prize winner cannot be contacted during this period, the prize will be forfeited and another winner will be selected in accordance with the rules.
•  The Promoter reserves the right to name finalists/winners publicly. By entering this promotional competition, prize winners/finalists agree to the publication of their names, photographs and videos by the Promoter. Participants hereby agree and provide parental consent, that images uploaded that may include minors (under the age of 18 years) under his/her care, can be shared on social media as part of his/her participation in the promotion.
•  Any personal data submitted by you will be used solely in accordance with current South African data protection legislation, the Consumer Protection Act and the Promoter’s respective privacy policies. The Promoter may contact you for marketing purposes, on the basis that you will have the election to opt out at each interaction.
•  Build it shall not be responsible for any lost, damaged, delayed, incorrect or incomplete entries for any reason whatsoever. Proof of sending will not be accepted as proof of receipt.
•  Build it shall not be responsible for the failure of any technical element relating to this promotional competition that may result in an entry not being successfully submitted.
•  The Promoter reserves the right to disqualify any finalist/winner if fraud or cheating is suspected, including without limitation, through the manipulation of code or otherwise frequently falsifying data.
•  Entries generated by script, macro, bot, commercial contest subscription, incentives or other means not sponsored by the Promoter, vote-swapping sites, voting software, entering service sites or any other automated means and entries or votes by any means that subvert the entry/voting process or do not conform to the terms or spirit of these competition rules, will void the entry/votes and may disqualify the entrant/participant.
•  No applications from agents, third parties, organised groups or applications automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted. Entries will only be accepted if they comply with all entry instructions.
•  The prizes are not exchangeable for cash and are not transferable.
•  The Promoter reserves the right to use the images taken of the entrants/participants/finalists/winners for publicity purposes in any manner they deem fit, without remuneration being made payable to the entrants/participants/finalists/winners. However, an entrant/participant/finalist/winner has the right to object to these images being used by written notification to the Promoter at 22 Chancery Ln, New Germany, Pinetown, 3610.
•  The Participant agrees that any images of him/her/his associates and/or home may be combined with text, other images and graphics, and cropped, altered or modified without any further approval and may be used in any other way that the Promoter sees fit in association with the exploitation of these images. The Participant acknowledges that by accepting these terms and conditions, all claims of ownership, income, editorial control and use of these images are given up and that all rights to the images belong to the Promoter and anyone to whom the Promoter has assigned or licensed rights in such images.
•  The Participant (for himself/herself and on behalf of any minor under his/her care) acknowledges and agrees that the images or other reproductions of their physical likeness may be used in the exploitation and advertising of the images or for any other purpose and in any medium (including online use).
•  The Promoter shall have the right to change or terminate the promotional competition immediately and without notice, if deemed necessary in their opinion and if circumstances arise outside of their control. In the event of such change or termination, all Participants agree to waive any rights that they have in respect of this promotional competition and acknowledge that they will have no recourse against the Promoter or their agents.
•  Neither the promoter, their agents, their associated companies, nor any directors, officers or employees of such, shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise arising from any cause whatsoever, which may be suffered by the participant, or suffered by any other person associated with the participant, as a result (directly or indirectly) of the participant’s participation in the competition [promotion]. The participant hereby indemnifies, releases and holds harmless the promoter, its agents and employees and agrees that they shall not be liable for any loss of life or injury to person/s or damage to property or damage or loss whatsoever, whether caused by negligence or otherwise, in relation to the competition.
•  To the fullest extent permitted by applicable law, the promoter and its agents, or associates assume no responsibility and are not liable for: (i) any inaccuracy of the prize description, (ii) the non-availability, loss or interference with the prize, (iii) any representation, warranty, condition or guarantee in respect of the prize, or (iv) any costs, injuries, losses or damages of any kind, due in whole or part, directly or indirectly, to an entrant’s participation in the promotion, or arising out of a person’s participation in any promotion-related activity, or their receipt, use or misuse of any prize that may be awarded to them.
•  The judges’ decision is final and no correspondence will be entered into.
•  Participation in the promotional competition constitutes acceptance of the promotional competition rules and Participants agree to abide by the rules.
•  This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook and the Participants acknowledge that they are providing information to the Promoter and its agents only and not to telephone networks or any other platform (available online or otherwise).
•  All entrants/participants in this competition release Facebook from all liabilities, claims and responsibilities arising out of or in connection with this competition and these terms and conditions.

[1] This includes the fact that the Promoter, its affiliates or associates are not entitled or expected to provide any certification or confirmation as to the fitness for purpose of the Labour and/or Materials in the manner in which the winner(s) may apply the Labour/Materials and/or the structural safety/viability of the home to which they are applied. The Promoter, its affiliates or associates cannot be held responsible or liable for the certification, approval or engineered specifications of any structure created using the Materials or with application of the Labour.
